IMHO, BF wanted to do his best Clint Eastwood impression and come back and kill someone with the justification that he cannot possibly be in the wrong.

Know the law people, this was a 100% total intent to muder

IMO, it doesn't seem like the law is going to favor the shooter here.

However, I will say it's probably going to be quite difficult to get a clear picture of what happened since only two people truly know what happened here and one of them is deceased.

It doesn't appear that WA state is a "stand your ground" or "no duty to retreat" type state. The fact that he left the house and came back with a gun doesn't help his case, especially that he reportedly did not sustain any injuries that would make him fear for his life etc.

But this is WA, had this happened in FL, TX the outcome could have been totally different. I'm not saying what he did was necessarily right or logical but, I'd be curious to hear what exactly led to him pulling the trigger.

I found this:

Belfair-area man’s murder trial moves to February

Fanning’s attorney Richard Woodrow told Mason County Superior Court Judge Toni Sheldon that his client was asked by a psychologist to undergo a neurological examination. He asked Sheldon to move the trial forward for the examination and results.

That moves Fanning’s trial date forward to Feb. 13.

Court docket added May 1st as an another hearing. Hearing on June 25th & July 10th trial still there.

I know that discussion of the actual case has pretty much ended, and it'll mainly be about the upcoming trial from now on. In spite of that, I wanted to mention something I was surprised not to have been said already. If I had been at a friend's house and gotten into an argument, etc., etc. (with all the other details mentioned about him coming back and thinking he was in the friend's house), and someone yelled at me to leave while I was in a shower with my head under running water, I'd probably assume it was the friend (who was still mad because of the argument). I wonder if what he yelled at BF was that he'd leave when he finished up and got dressed - possibly saying that he was half frozen and needed to thaw out first.

As far as premeditation goes, when he left to get a gun to shoot him with, that made it premeditated. If he had come back, told him he had the gun and shot him because he still didn't leave, I'd say there would be a much better case for 2nd degree murder; at least that way he could say he had gotten the gun for protection rather than just to murder him. MOO
