I don't think any of the car/forensic evidence will matter. JB would have gotten it anyway. He wanted the forensics before they are "unusuable."

Judge tells JB he could depose the handlers, etc. Motion denied.

Grants forensics---test reports, logs, documentation from Body Farm.

ITA! Why isn't the state standing up for themselves and bringing up this issue.

They are actually arguing that right now

They are saying that Jose's motion goes way beyond the rules of Discovery even if he is allowed access to the evidence

The Prosc. said "His motion is very Broad - He's basicall asking for everything - Logs, documentation, ect. ect.

There probably aren't going to be any traces of decomp (air samples) in the trunk anymore at this late date. So JB will claim none exists.

That's exactly what I was thinking!

whats the difference between him getting the car this week or next week, really? they seem to be sure that she will get the murder charge and then he will have access to the car then anyways...

ITA for me the biggest motion today is allowing KC to travel.
I agree, it's a stupid motion. Makes no good sense from a legal standpoint. I just don't get it. :waitasec:

IMO any defence motion that is granted is pretty much for appelate reasons. In the event of a murder conviction, they will not be able to say that they were not granted access to evidence.

Well since all of this stuff is discoverable does that mean we will get to see it now?

I can't help but notice that the state is stressing "used in the child neglect case"--they are holding on to the relevance of discovery on the murder charge.

Wait it's confusing - they get to inspect the car but not test the car - they get statements but not to test - is that what I'm hearing? Because I'm not hearing that they can bring in their own experts and to get actual evidence to test - they get the reports and statements - thats totally different
