IF ICA takes the stand, whatever she states must match the evidence presented, IMO...She will have to admit to an accidental death but came up with a kidnapping idea so not to look negligent to her parents. But she must also state why she googled Zenaida, household weapons, neck breaking and cholorform and missing people websites...remember CA claims she looked up cholorphyll, much different spelling, CA seems to have no qualms covering for ICA...so, If that train is head for GA, she'd be okay...heading for CA...she will take offense...I can't wait for opening statements...that will tell all...JMHO

Justice for Caylee

CA will also have to explain how she used the home computer while she was at work.
KC will have to explain her angry, cuss-filled rants and bold money schemes with parents she was scared of, as well as why she has chosen to spend 3 years in jail getting spit on by other inmates-Her attorneys may want to explain why they would let a client sit in jail who was only guilty of failing to report an accident-Not that the attorneys can spill without KC's permission, but they will have a hard time getting clients in the future if they admit to letting this client rot in the hole.
 
Cindy is not the only parent here. As I understand it, George is the father and let a whole lotta things slide.

He did let a whole lotta things go ... but during his interview he more or less said Casey did it. I always look at GA and think .... under the thumb ... he has taken it for so many years he is numbed.

Maybe I'm wrong and Casey will do whatever she thinks she has to do to have the best chance, but I still don't know if she would be willing to admit that she had anything to do with Caylee's death at all, even as an accident. It's going to really ruffle her tail feathers if she has to admit any culpability at all, IMO. She probably won't like anything the DT puts forward that could put her fabulous self in a bad light in any way. IMO she'd really like to say SODDI.

I agree, and this puts the DT in a bad position. If they try to just IMPLY it was an accident, hoping for reasonable doubt, by sprinkling that idea about through various questions and various witness testimonies, then the SA will refute it with each rebuttal. They will bat it down each time. And easily so by asking WHY is she allowing herself to go on trial for Capital Murder after sitting in jail for 3 years if it was a simple accident?

It will be very hard to overcome those questions without hearing from Casey.
The jury will want to know HOW the accident happened, and what she did after she found the child unconscious. Did she attempt to revive her? Did she know foir sure she was beyond help? How did she know that for sure. How long was she in the water for example? When did she get the idea to wrap her face in the duct tape?

These are just a few of the many hard questions which will come up if they try and imply 'accident.' I really think Casey will have to take the stand if she wants to try and sell that theory. I believe that the DT is hoping that the state cannot PROVE beyond all doubts that it was not an accident.
They are counting on that in my opinion. Thus all of the talking in JS about proving 'all of the elements' to be found guilty. They figure " No cause of death" = no guilty verdict.


But I disagree. There is plenty of other circumstantial evidence which shows that Casey was not a mother grieving after a tragic accident. The body was not disposed of in a way that implied that either. So if they want to push the accident theory then the jury will want to hear it from her lips. And there is no way she will be able to stand the ferocious onslaught from the state once they get to cross examination. imoo
 
I agree with NeJame EXCEPT I am shocked that even he would say KC will take the stand. She will be proved to be a liar and a murderer in five mintues with Ashton asking her questions. No way will she take the stand. She is not good enough to do it. This is not KC going up against Cindy; it would be KC going up against Ashton. Who do you think would win and how long would it take?

And I read someplace in another thread that Cheney Mason has come up against Ashton in several trials over the years and NEVER WON any of them. Surely CM will be against putting ICA on the stand since he has seen Ashton in action.

It is hard for any of us to listen to Mason; hope he improves if he is the one giving the opening statement; because he stutters and uses words such as "trickery" from 1890s and is all around difficult to listen to. He really is. I would rather listent to Baez any day.

But Ashton leaves them in the dust. If I were Ashton, I would speak a little softer when he speaks of Caylee though. It is important that she be looked at and spoken about only in the nicest way.

But Drane Burdick imo is the best. She is just thorough and answers every question as you ask it in your brain.

Didn't Dr. G. say it was her opinion the duct tape was applied pre-decomp? So how is ICA going to explain away her decision making process...

Oh darn! Caylee looks like she is dead. OMG what to do - what to do? I can call 911 or I can slap some duct over her nose and mouth...OMG what to do? Oh heck I've got a date with Tony in an hour or two...if I call 911 I could be held up here for hours while they try to revive her - well's that easy - the duct tape it is!

I'm convinced that the duct tape was the murder weapon. There is no viable explanation for THREE pieces of duct tape to be on Caylee's face if Casey was trying to set up an accident as a kidnapping/murder. One piece would have been enough to make it appear to be a kidnapping/murder. Maybe two pieces... but three pieces on a two-year-old babies face? Not to mention that we don't know where the 4th pieces was on Caylee at the time of death. Three pieces of duct tape, imo, was Casey wanting to silence Caylee for good. She did not want her to ever breathe another breath again.

The defense is not going to be able to explain the duct tape and the trash bags.

You know I sit and watch KC in court and she is organizing the files, wiping down the table, writing notes up the kazoo and now I think about what you just said and I can see her thinking in her mind when Caylee died, "I really don't have time for this. I have a date tonight." Duct tape was the easier way out.

All this talk about blocking things out mentally about Caylee being kidnapped. KC certainly could have blocked out the fact that she killed her child just as well so that excuse could also backfire. I think that in the jailhouse letters KC states (oddly) that maybe Caylee is better off where she is because she never has to worry about someone hurting her (paraphrased). I'm thinking KC is talking about Brandon Snow because he broke up with her. She usually initiates the breakups in her relationships so I don't think she has dealt with that relationship because she had no control when it ended. jmo

I wonder how DT will deal with it if those last minute pictures that LDB was talking about Friday in court are from the FBI. What if their labs had the technology to bring out that outline and the measurements matched Caylee's? I would think the FBI could get ahold of Caylee's medical records to see what her measurements were at her last visit.

I was joking when I wrote that of course, but I don't think she was blocking - I just think she is an empty shell and just doesn't care.

I wouldn't be a bit surprised that a lot of those letters were "staged/scripted" so to speak. I think there's been so much subterfuge behind the scenes I'm wondering if the players even know what's real anymore.

I personally can't wait to hear what the defense strategy is, but I don't have a theory of my own. The reason for that is because I feel that a lot of what non-experts/those people lesser informed on the workings of legal proceedings like me (some of you really know your stuff here) think would count as evidence actually isn't or is simply circumstantial.

I bet those hours that have seemed so long to Casey are flying by right now. Isn't that always the case when something you dread looms in the near future? It's almost time, Casey.

I do believe we all will be surprised with what the SAO beings out and pleased too.

Without going back and reading Dr Gs report, didn't she say there were no medical records for Caylee? I remember we all had discussions about how Caylee got her shots and whether or not Caylee even had been to a doctor.

I had not followed this case for almost two years and spent many hours over the weekend reviewing videotapes of motions (never did know exactly what they were), and realized that every court hearing was about the mistakes that LE made in handling their client.

The very first interview JB did was with NG and he said his only objective is to find Caylee. Not once, not even once have I heard him mention her name. ALL of his talk was about poor Casey. He would say, "you cuffed her (five min) and didn't follow procedure. Then he would say "You didn't follow procedure and record you uncuffed her". GMAB!! I was upset watching his nonsense. It is pitiful that an attorney can make such a mockery of a system. It is intolerable that our justice system lets this keep occurring. Every single minute of this debacle was about poor Casey and her rights..and not a peep about Caylee and a search for her.

So I imagine we are in for quite a lot of frustration listening to this *Unusual Person* (TOS holding me back here) utter his foolishness and attack LE the entire trial. His objective is to attack, befuddle and confuse the jury. He has honed these attributes of his to rise to the level of acceptability in a courtroom.

His smirks and his downright pounding of Yuri M. shows me has watched the OJ trial and is trying to replicate the antics of the "Dream Team". The jury has their hands full as they will have to try to follow his disorganization and silliness in questioning State's witnesses. That is all he will do..confuse and befudder. He will object to interrupt the State while they are presenting and sit back and smirk. Heck, he and casey have already objected and the trial hasn't started. Object, object and then object some more. It will be like an harrasement and I predict that will be his case. Barrys Sheck did that and I never did hear the closing arguemtne...he was objecting about every 20 seconds. I don't expect JB to put on a defense because he will attempt to do all the damage when the State is presenting.

I hope the jury has the patience and the intelligence to see through him. I hope there is a picture of precious Caylee up at all times. I hope he doesn't succeed at any of the antics he tries. I hope I have enough beer.
