If there was an appeal, why would not the DT be shouting this from the rafters? They are not shy! Why was not JB in chambers? That is just flat out odd. Everyone else on "ICA's Team" was present (per HHJP's comments to the DT and ICA in his last remarks) does no one else find it odd, that HHJP said, "her defense team is present" but yet JB was not, wouldn't HHJP as smart and savvy as he is have said, "Are all but JB present here" he said the team was present...and yet JB was MIA...
 
I think Jose' wife is pregnant (remember how KC was supposedly upset about that). Maybe his wife is in labor or a complication and he had to leave abruptly. Just a thought.
 
I smell CA and GA somewhere. Maybe a death or injury in the family, one of ICA's grandparents. Perhaps a confession from one of the A's or new evidence/statements. MOO she will not plea out, ever.

Wasn't there still some pending investigations on JB's bar license? Has anyone checked on that?
 
This is not a plea. JB and HHJP were butting heads this morning and everything changed after that. JB is trying to get rid of HHJP through whatever maneuver he can use.... If it were a plea JB would have been much less combative. :twocents:

Have they asked this Judge to recuse himself because of ( insert another fake reason here) ? JB keeps complaining about how he does things.....
After all, JB did try to use a peremptory strike on the judge- Freudian slip???:waitasec:
 
I'm a firm believer in one staying home when sick, however, sometimes this ain't an option. I've had jobs that would fire you if you dared stay out sick. Just sayin. Been there done that.

And finances could have bearing on this too. If you're a waitress depending on tips, if you miss a day, you've lost a whole week financially. Miss a week, you've lost the month financially. Been there done that.

Me too. You were allowed to call in dead, that's all.
 
Could Judge Perry be wrong, Defense right?

Have no idea what happened, but suspect it was due to jury selection procedure. So could for once Judge Perry be wrong and the defense right?

Ironically named, Perry v. State, 675 So. 2d 976 (Fla. 4th DCA 1996), might hold the answer.

RH is not the only one. Every lawyer I have heard anywhere the last few days have discussed this strange process HHJP came up with to pick a jury.

If it turns out that a appeal court says HHJP was wrong will he step down from this case?
 
Could Baez be trying to get rid of HHJP? When he didn't get his way with JS,
He was successful in getting him to recuse himself. He could be attempting the same with HHJP, after all we are talking about Baez. Need I SA more.Moo
 
This might be a silly question but I'll ask it

What happened to the PJ's that they were suppose to see this afternoon.Would it need to be discussed in court that they were dismissed for today and told not to discuss the case?

I just rewatched the end of JP's statment...he was breathing heavy and as he says this court is adjoined until 8:30 tomorrow morning he was visibly upset..to me it was anger!

The DT is up to something big and I'm thinking it's all about JP! I put nothing past them...
 
Baez didn't appear to be sick this morning. How can his being sick delay this with 3 other DP qualified attorney's?

He is lead counsel, court can not be in session without him.
It can become an appellate issue. The issue could be raised that ICA did not receive a fair trial because the court proceedings continued without him, blah, blah, blah.
 
Questions I hope TruTV would entertain:
1) Why was JB not present in Judge's chambers regardless?
2) What is the deal with ICA wearing black? I am not trying to go against TOS at all, but much has been mentioned about this...her wearing black. That it is odd to see a defendent wearing that...and that apparently there is some type of precedent(?) for this...?
3) Absolutely no appeal...no comment to the media...not even a no comment...
4) Has anyone else seen visually, the sort of separation between ICA and JB over the last few months...like there may be no love lost...I don't mean to use the word "love" lightly
5) If CM is withdrawing for health concerns then why wouldn't JB be in chambers?
6) If there is a plea negotiation, is it a sleazy ploy by the Defense to get that information in front of a potential jury?
7) TruTV now speculating that JB may have been ill this morning...didn't appear that way to me...no reason for such secrecy if that is the case...

I guess if it is my best guess, I am going with ICA fired JB...jmo. Though it could very well be a plea negotiation.

That makes a lot of sense. JB seems to have been distancing himself from ICA for quite a while. Only one visit last year between August and Christmas? The "two-year old" comment was also made several weeks after another incident where it was clear he told her to stop touching him after she grabbed at his coat when he was trying to address the court. If he has any brains at all he should have been orchestrating something along those lines. He has seen how quickly she will turn on people and throw them under the bus after they have outlived their usefulness. I can just see her screaming about his "inappropriate behavior" (best-case scenario - worst case who knows what allegations she would claim?) all along if the jury came in with a verdict she didn't like and she needed a scapegoat. He is ripe for the picking on that one.
 
I caught anger from the judge as well...
Don't believe this is about illness...I think he would have addressed it in open court, for the record. They would have to determine what sort of illness would actually stop court in its tracks and have it on the record. JMO

That is my thought... this illness story doesn't pass the sniff test.

Question: Then why would HHJP upon concluding this "session" today ask if the Defense counsel was present for ICA and not account for the fact that JB was clearly MIA at the Defense table?

OK. Looking at Richard Hornsby's most recent blog Could Judge Perry be wrong, Defense right?. In short he says that the Defense could be right about their argument over "piecemeal" jury selection and HHJP wrong. He cites Perry v. State, 675 So. 2d 976 (Fla. 4th DCA 1996) as authority (this case, incidentally may be the "just one" which HHJP and AZLawyer wanted).

Anyhow question to the lawyers: Why are the DT taking this point now as an interlocutory appeal when they have already made their objection and (I assume) preserved this point for appeal? Surely it is better for the defense (or at least ICA) for the DT to get on with this trial, not piss off HHJP anymore than they already have and try this case to conclusion. Should ICA get acquited hoorah for the DT/ICA, if she gets convicted they have a good shot of getting the verdict overturned and a second bite at the cherry?
