GUILTY Yoselyn Ortega charged with 2 counts ea-1st and 2nd Degree Murder of Krim Children

since she's in police custody, who pays for her care? YO or the state?

Oh, you can be sure YO isn't going to be paying a dime for that hospital bill. :furious:

  • #562
Then again she might NOT be in a psych ward. Since she has been charged with a crime, LE could have told the hospital their jail does not have the facilities to care her for after her hospital stay and for the hospital to please keep her until she is able to be admitted to jail.

Would LE normally take their jail patients to Bellevue (Manhattan's public hospital)? It is my understanding that Bellevue has problems because of the storm and all patients were transferred out.

Does anyone think they are waiting for a Grand Jury to meet and Indite before there is an arraignment?

A grand jury has voted a throw-away-the-key indictment -- charging first degree murder -- against Yoselyn Ortega, the nanny accused in the bathtub slashing deaths of two young Upper West Side children under her care.

The rare charge -- brought only 27 times in all of New York in 2011, according to state stats -- carries the maximum sentence of life without parole, meaning zero chance of daylight.

"No date has yet been set for Ortega to be arraigned on the indictment, which charges her with two counts of murder one and two counts of murder two. A call to Ortega's lawyer, Valerie Van Leer-Greenberg, were not returned."

...

Ortega, who has been hospitalized and under police guard in the hospital since the incident, was arraigned at her bedside last week after officers were finally able to interview her about the crimes.

Detectives were initially unable to question Ortega because she remained in a catatonic state after being put in a medically-induced coma, sources said.

Ortega's Supreme Court arraingment could happen as early as Wednesday, according to a law enforcement source.

Sources say Marina Krim is "devastated" by the loss of her two children...

NY Times has a blip about it which is opened up for comments.

http://cityroom.blogs.nytimes.com/2012/11/13/upper-west-side-nanny-is-indicted-on-murder-charges/

Sounds like she has yet to be arraigned:

"The nanny, Yoselyn Ortega, 50, remains hospitalized at NewYork-Presbyterian/Weill Cornell Medical Center. Her arraignment on murder charges is expected to take place via a video link to State Supreme Court in Manhattan, but has not been scheduled."

I guess we will hear from YO's attorney after the arraignment...hopefully!

yes... saw that one to earlier also... - same thing basically .. nothing new there...

as to comments .. at most of those articles one can comment generally (in some, though, have to register at their site first, ... basically can't comment in anonymous mode .. at some other sites.. - anonymous posting of comments is OK)

Seems like 2 arraignments were mentioned in the Media (one of them maybe is incorrect info? .. and actually was her "being charged" not "arraigned", or is it the same thing basically?)

Talking about this:

1. ... was arraigned at her bedside last week after officers were finally able to interview her about the crimes.

Thought that was when she got charged, not arraigned...

2. Ortega's Supreme Court arraingment could happen as early as Wednesday, according to a law enforcement source.

It is my understanding when one is arraigned they submit a plea of guilty or not guilty. YO's attorney was not with her during the interview, so i don't think there has been an arraignment yet. I assume the bond hearing will be at the same time the arraignment is held and the Judge most likely will not allow any type bond.

Ny post said there were only 27 or so cases in all of 2011 in all of New York where they charged first degree murder which means a sentence of LWOP. So hopefully she will get that - twice over!

Why would it be going to the Supreme Court already? I thought cases only went to the Supreme Court when they were on appeal?

I think in NY the "Supreme" Court is more like a main or central court.I think a felony criminal cases must be tried there. Here in CA it would be at Superior Court.

ETA: here is some information for you:

>>The Criminal Branch of the Supreme Court is the only Court that can decide felony cases. Most people are indicted for criminal violations in Criminal Court, which is a lower court. But if the person is indicted on a felony charge, any pretrial proceedings, guilty pleas, trial and sentencing must take place in the Criminal Branch of the Supreme Court and not in Criminal Court. (There is a section on Criminal Court later in this booklet.)<<
