‘Killer nanny’ psychiatric fitness hearing scheduled for June 24

Yoselyn Ortega will go before the court to challenge finding that she is mentally fit — as found by court doctors — to stand trial for the terrible murder of Lucia and Leo Krim, 6 and 2, a Manhattan judge said Tuesday.

A hearing over the psychiatric fitness of "killer nanny" Yoselyn Ortega will be held in about a month, a Manhattan judge said Tuesday.

Ortega — who swapped her jail jumpsuit for a grey sweatshirt and blue jeans for her first court appearance in street clothes — was there so a June 24 hearing date could be scheduled.

"Both sides agree we can start on June 24th," said Manhattan Supreme Court Justice Gregory Carro, after a bench conference with prosecutor Stuart Silberg and Ortega's attorney Valerie Van Leer-Greenberg.

Van Leer-Greenberg is challenging a finding by court doctors that Ortega, charged with slaughtering two small children in her care, is mentally fit for trial.

A June 24 date has been set for an open court hearing to determine if accused killer nanny Yoselyn Ortega is mentally fit for trial.

The hearing date was set this morning, as Ortega appeared briefly before Manhattan Supreme Court Justice Gregory Carro. The hearing will consist of testimony by psychiatric witnesses for Manhattan prosecutors and the defense.

Ortega, who uses a Spanish interpreter, wore a loose-fitting sweatshirt and jeans and remained handcuffed during today's appearance.

Two court-appointed psychiatrists have determined that Ortega is able to understand the charges against her and assist in her defense. Her lawyer, Valerie Van Leer-Greenberg, is challenging the finding.

I think the parents cannot go through a case after all they already went through.
Marina saw her children in the tub stabbed and dead – she screamed for hours – it was the saddest think in the world I will never forget her screams, and her 3rd child clutched to her chest.
She is pregnant now, and could not handle a court. Nor should she have too. This “B” was caught red handed. I think she is going to jail in a mental ward for life. I don’t want to see a case, but if there is one I will go.
I just pray there will NOT be one. I expressed this to the investigators.

I do hope you are right, But since criminals now have more rights than their victims do, I'm not so sure. Being caught red-handed doesn't seem to matter, either. It seems like very few defendants plead guilty anymore. Defense lawyers today will just invent a good sounding story out of whole cloth.

Let's say YO is found not to be fit for a trial. I would imagine that at some point, with medication and therapy, she will be deemed fit enough. At that point, wouldn't she go on trial? I don't think they can keep her imprisoned without a trial. And I'm sure these psych units are all filled up, so they wouldn't keep her in there forever.

It would just kill the Krims to have to re-live the horror. But many inmates die quickly after getting locked up, so maybe YO won't even make it to trial. We can only hope.

I believe that many cases are handled without a trial.
but first they have to go through all the preliminaries.
I am sure some here from legal can tell us how it works.
While I am not clear on the process I am clear that it can happen without a trial.
If there is one I will be there. DEFINITLY if they let me in... But I think I will be called in....

I stay on top of the facebook postings yes Neisse will have a sibling and that is so important since she lost Leo and Lulu.

Pull my strings if you know of a court date. Yes you may know before I do – stuff happens.

PS: next weekend I am meeting a group of lovely ladies - We will meet on the top of one of the NYC buildings looking down on NYC for some drinks. (NYC at night is amazing).

Most are coming from out of town - they have been very involved with the
Leo and Lulu fund the run in Central Park.
We will celebrate Leo and Lulu's life...
as you can see on Facebook Mom is always pulling out more photos and art
to post from the children.
I think they are amazing parents they have to be to keep Nessie going strong....

Prosecutors can examine mounds of "Killer Nanny" Yoselyn Ortega's psychiatric records and privately interview defense doctors, who are expected to say she's too crazy to stand trial, a Manhattan judge ruled Tuesday.

The development came as her lawyer, Valerie Van Leer-Greenberg, prepares to fight a finding by court physicians that Ortega is mentally fit to proceed in her high-profile murder case. A hearing is set for June 24.

Manhattan Supreme Court Justice Gregory Carro shot down Van Leer-Greenberg's bid to keep prosecutor Stuart Silberg from speaking to defense witnesses without her present, saying she isn't entitled to privacy protections.

"Nothing in the law requires defense counsel to be present at any interview by the people," Carro said at a brief court appearance Tuesday.

Ortega "has waived any privacy rights in her treatment for that mental condition," and is in "a situation where (she) has put her mental condition at issue," the judge said.

Ortega is currently being held without bail at the women's facility on Rikers Island.

Sorry I don’t care who Valerie Van Leer-Greenberg is PRO...
I don’t understand how any human being can defend Ortega.
I know the law - she deserves her day in court.
HOWEVER she was caught red handed, so HOW can a person defend this "B"

I saw the children with her about half an our before I heard the screams of Mrs. Krim....

Her attorney is a jerk for taking a case where someone kill innocent beautiful angels.
Sometimes they take it to be famous, well nobody will hire Jose Baez.. but he got famous.
