The burden of proof is less in a civil suit than a criminal suit. The OJ Simpson case is a perfect example. He was found not guilty in a criminal trial, but lost the lawsuit in a civil trial.

It is possible he was dead (from hypothermia) while the chimney was not in use and only burned after he died.
It would make sense that someone would choose to explore a chimney not actively in use at the time. One of the posts above shows the hours the furnace operated per day.
By the time assets are split, alimony and child support are paid - there can be a substantial financial "reason" for murder over divorce (since most criminals figure they will be the one who doesn't get caught).
