It truly is a war of attrition and I have always said their backup plan is to try to reduce the jury members to under 12. The longer they can keep throwing BS motions, then the longer there is a chance to have more jurors removed for any number of reasons like health, hardship, finding another juror misconduct, exhaustion, family emergency, etc. etc.

I just read that scathing post by SusieD. And although I do respect your opinion, I respectfully disagree.
It is my belief, because of the 4th of July holiday those jurors wanted to GO HOME. Many of them were told by HHJP they would be home way before then. They knew if they found her guilty, it would mean another month or so with everything that goes along with finding someone guilty. Hearing victim statements, deciding her fate, etc. I truly believe that's why the jurors copped out. If they aren't careful, this jury may do the same.

Surrebuttal is only allowed if the state brings in new evidence during rebuttal. The defense cannot address their entire case all over again during surrebuttal but only the new evidence. Considering the new information we're hoping to see from JM I think the Judge will allow surrebuttal. It won't take long though. I don't think...

Every one I have chatted with agrees with that statement. I often felt HHJS was actually afraid to say NO to the DT! If she lets in the Dr., she is going to lose a lot of respect in her professional circle as well!

Even if he hasn't already evaluated her, JM has several more witnesses I believe, who will also have to go through cross, jury questions, re-direct, re-cross . . . . This new guy will have plenty of time to talk to her, if the judge grants the motion, which I'm not convinced she will.

It's like a football game. By the end of the game the fans on both sides should be convinced the refs were in the tank for the other team.
