Gonna ask this for the 3rd time this morning!!
Did the ME say JA was stabbed first? If so, wth does all the gun testimony matter????
--------------------------------------------------------------------------------------------------
Jodi wants the jury to believe she shot Travis first for these reasons:
1. If she shot first and he didn't die, then it helps explain why she had to repeatedly stab him. Because, in theory, he was still threatening her life and just wouldn't stop. So since the gun wound didn't stop him, she had a "right or need" to get the knife, to try a different tactic to self-protect.
2. Conversely, if she stabbed him first and he died from the knife, what was the point of adding a gun shot? This would double-over-kill. It looks extra cruel to shoot a man you already stabbed to near-death. Therefore, she doesn't want the jury to think she shot him LAST (i.e., for nothing). If the jury believes she caused unusual cruelty, pain and suffering, the law says her sentencing will be MUCH tougher.
In some states / cases, self-defense laws say you're only allowed to use equal force to stop an attack. Doesn't sound like Travis had a gun or knife on Jodi, so right there she's in trouble re: self-defense.
What's more, it appears that she double-killed him, out of spite. So her best bet is to say she shot him -- but that didn't stop him. So she had to switch gears to the knife to self-defend (and lost her mind going over-board out of terror that he'd still get up again and get her).
