• First up is investigative hours motion.
• Baez says there is "a plethora of witnesses that need to be interviewed"
• 110 witnesses
• Baez does not believe they warrant depos.
• But they do need to be interviewed he says
• Baez wants computer generated reports on the witnesses that tell things like last known address and ph numbers
• JP asked for more details on the request.
• JP asks of Baez has looked at JAC guidelines for use of investigative hrs
• JP referring to a specific invoice. JP not sure if it is all reimbursable. Baez ok with that

Can somebody please explain to me what the highlighted line means??
What does he mean by "computer generated reports"?
What does "on witnesses that tell things" mean?
He wants the "phone numbers and addresses" of who? Don't they already have that info on TES searchers? That is how the Defense has been able to call TES searchers, and how the P.I. has been able to show up at their doors.

I'm sure he wants his people available to chase down TES searchers, JMO.

The Deadline has already passed for the Defense to do depositions on all the State witnesses! What difference does it make how the State's witnesses are listed, in what category?

The Deadline has already passed for the State to add any new witnesses.
What is Baez talking about???? The Defense does not have to find anybody on the State Witness List in order to do depositions - that ship has sailed.

The only permissable new witnesses, are the TES searchers that the Defense can add by the end of this month, so the State can depose them by March 2011.

JB is pretending to do busy work, as if he is hot on the trail of the Defense that is going to save ICA. JB has nothing but has to appear to be doing something -- calling it due-diligence -- and HHJP is accomodating him.

CM alluded to the fact that there are not as many folks to 'investigate' as was alluded to in the media. This is damage control. Keep up the appearance.

You gotta feel sorry for the guy. The circumstantial evidence is over-whelming so the 'Helper Elves' are busy, busy, busy.

Doing what? No-one knows, just busy making noises and waiting for May 2011.

All of the witnesses on the State Witness List have current addresses listed.
The State amended every time there was a change of address on their witnesses.

Bold, Red by me. Exactly, the defense is using the real witness list numbers as a distraction to get the State to pay for the TES fishing expedition.
 
At the end of the day JP really can't deny Baez, or he risks an unfair trial. We don't want that, so I say give him the hours he needs -- then he has no excuses!

I remember this from the Westerfield trial here in San Diego. He was allowed to keep his private attorney after being declared indigent. It wasn't until after the trial we learned how much San Diego was changed (an enourmous amount). Westerfield is now on death row -- money well spent!

So while I want to balk at the extra money, I don't want to see a mistrial here, or having issues go to the supreme court.

ps: eta that JB will most likely turn out like Feldman and thrown out of the inner circle of trusted attorney's. I don't think Feldman (Westerfield's atty) has taken on a DP case since then because no one trusts him. After this, JB will be lucky to get a shoplifting case. MOOOOOOO
 
If Judge P sticks to his own Deadlines - the Defense has until the end of this month to depose (66) State witnesses (if they want to). I think JB was whining about all State witnesses being Category A again, because he is going to complain (AGAIN) that he did not get all of the depositions done by the end of this month, because they did not know which ones were important to depose and had important information, because they were all listed in the same Category. I really doubt that Judge P. would deny the defense a deposition of any of the remaining 200 witnesses, even past the Deadlines.

Deadline Dec 31, 2010 - Defense depose State "late filed" witnesses (filed after May 24, 2010)

Deadline for Defense to depose all other (non Expert, non late filed) witnesses - civilian and law enforcement - was Oct 31, 2010.

Bingo.
JB even mentioned it in the 5/6/10 budget hearing when they were trying to settle investigator hours. He started to say something about TES searchers and HHJP cut him off and said lets stick to the point. I think its in Patty G's WFTV links part 3 or part 4. Neither JAC or the court has time to track all this I am sure...

I am certain that HHJP is aware of this on some level, perhaps he is just giving them plenty of rope to hang themselves and their client.

Automatic appeal, probably, but it doesn't have to be successful.

If Judge P sticks to his own Deadlines - the Defense has until the end of this month to depose (66) State witnesses (if they want to). I think JB was whining about all State witnesses being Category A again, because he is going to complain (AGAIN) that he did not get all of the depositions done by the end of this month, because they did not know which ones were important to depose and had important information, because they were all listed in the same Category. I really doubt that Judge P. would deny the defense a deposition of any of the remaining 200 witnesses, even past the Deadlines.

OT Witness 95 saw mama doll at remains sight Aug 2008, I thought the doll was found in the car. So long ago I could be mistaken.

There is more than one doll I think, but I'm not sure which one is Mamma doll and where she was found.
I remember seeing the police report from this witness way back in the early discovery and thought it was very interesting. Not much has been made of it I guess because I think the report was filed after the remains were found.
But I'm not sure about that.
Is there a thread on the dolls?
