Thanks for this. How long will this trial last?
Verdict expected after the last hearings. So if there are no delays, lets say December this year. Supreme Court then decides within some months. So middle 2014 this could all be over and extraditions will be requested. Sollecito has fled to the Dominican Republic it seems which 'coincidentally' does not have an extradition treaty with Italy. I wouldn't be surprised if Knox would join him or flees to some other country at some stage but first we will see how this trial goes. It is already bizarre that they don't show up at their own appeal trial.

I suspect she was being coerced in that half hour interview or feeling a bit sleepy. Either one (or maybe both?), otherwise it would have been horrible to say such things about the Kercher family and Meredith's grave. Disgusting.

I agree that if she is guilty it's a horrible thing to say. But then, if she's innocent it's actually rather spot on.

We just don't know, and will probably never know, which one it is. We can only speculate.

That's the problem with these behavioural arguments. Unless you know the truth of what happened it doesn't really tell you anything of note.

Of course we know what it is. There is so much evidence that there is not much left to speculate. We don't know exactly how it started and what the dynamics between the 3 were. That is all that is left for speculations.

As far as telling the victims family that 'they need to let Knox visit Meredith's grave or else they won't heal' is pure taunting. No way that would be spot on for an innocent person. An innocent person would show respect to the victims family. JMO.

Do you honestly believe that you KNOW?

From the link:

“I truly believe that the only way that any of us are going to be able to heal from all of this is if we come together and acknowledge the pain that we have all gone through.”

Meredith is the victim, and Knox was convicted in the first trial. In what universe does the victim's family have to meet with the suspect to heal?

It appears that Knox wants to remove Meredith's lawyer from the mix in the upcoming trial, and that she thinks her chances are improved if she can buddy up with the victim's family. She tried all of this earlier. I really have to wonder why she is so relentless when it comes to publicly contacting the victim's family to tell them what she wants.

Do you honestly believe that you KNOW?
Beyond reasonable doubt is what matters in legal terms. This goes for any case. That is how convictions are determined. There is evidence and judges have to conclude based on that. Judges do not come together to just do some speculations. Of course you are free to disagree with the results of the trial but saying that everybody is just speculating is a strange way of formulating the decision process IMO.

After reading through every post in this thread I just have to say that I find it appalling that for those who believe that Amanda and Raffaele are guilty of murder and who are crying out for justice for Meredith Kercher, have not a single word of outrage that Rudy Hermann Guede, Meredith's convicted murderer, may be paroled in 2014 to walk the streets a free man.

<respectfully snipped>
BBM

Rudy will be eligible for parole in 2016, not 2014. Being eligible for parole does not mean that he will be granted parole. He has been sentenced for 16 years and could very well serve the entire sentence. The murder occurred in 2007 and he was arrested right away, just like the other two. In 2016, he will be 9 years into his sentence. We need to keep in mind that because he opted for the fast track trial, essentially acknowledging involvement in the murder, but not the murder itself, the length of his sentence was reduced from 24 years to 16.

"Amanda Knox, Kercher’s former roommate turned author and tabloid darling who, along with her erstwhile Italian boyfriend, Raffaele Sollecito, were first convicted and then acquitted of Kercher’s murder, only to have those acquittals thrown out by Italy’s high court in March of this year. They, along with Ivory Coast native Rudy Guede, who was convicted for his role in Kercher’s murder in a separate fast-track trial, currently stand responsible for Kercher’s horrific end in the eyes of the Italian court. All three are essentially currently convicted of Kercher’s murder.
...
Guede’s murder conviction is final, having passed all three levels of the Italian judicial system (first level, second level and high court). He is eligible for parole in 2016."

Meredith Kercher family asks Amanda Knox to Stay Away from Grave

"In a carefully worded statement issued through their Italian lawyer, the British family made it clear Knox's presence would not be welcome. "It took us as a family nearly five years to even begin to feel ready to lay Mez to rest and it is still extremely painful now," said her elder sister Stephanie.

"However, she now has a place near to us that we and her friends can visit to take flowers and spend time … Her grave is now her safe place to sleep in peace and be with us and we hope that is respected by all."

:seeya: Thank You, otto, for posting this ...

Good for the Kercher Family ! They have been through ENOUGH !

They don't need Knox trying to make amends at this point ... Knox has had MANY opportunities to tell the TRUTH, but she has NOT and will NOT !

:please: Thoughts and Prayers for the Kercher Family during the upcoming legal proceedings ...

:please: Justice for Meredith !

oh ok you guys just want to inform you that even if Amanda is convicted she cannot be extradited to Italy from the United States, because the US has a double jeopardy clause

oh ok you guys just want to inform you that even if Amanda is convicted she cannot be extradited to Italy from the United States, because the US has a double jeopardy clause

Is this true? Is there a precident for this or any other basis? Obviously the Italian legal system is different and an aquittal can be be appealed and reversed without being "Double Jeoprady". It is hard to tell how this will play out.
There have been a few situations where EU countries have refused to extradite to the US (sometimes involving the Death Penalty) but they have been far and in between. It is uncertain if this will create any diplomatic issues with either England or Italy.

Other defendants who have been acquitted in other countries and then convicted on appeal have attempted to raise the double jeopardy principle to avoid extradition, without much success, said Mary Fan, a law professor at the University of Washington who specializes in cross-border criminal law.

The text of the treaty prevents extradition if the person has already been convicted or acquitted of the same offense by the "requested" country, which would be the United States in Knox's case because Italy would be requesting extradition from the United States. Because Knox was never prosecuted or acquitted for homicide in the United States, the treaty's double-jeopardy provision would not prevent Knox's extradition, said Fan.

While the issue is rare in the United States, several courts have rejected the double jeopardy argument in similar cases. In 2010, a federal court in California found that a man who was acquitted of murder in Mexico and later convicted after prosecutors appealed the acquittal, could not claim double jeopardy to avoid extradition to Mexico. That court cited a 1974 decision from the 2nd U.S. Circuit Court of Appeals in New York, that reached the same conclusion with respect to Canadian law, which also allows the government to appeal an acquittal.

Amanda Knox retrial begins without her

(CNN) -
The latest chapter in Amanda Knox's long legal battle began Monday in Florence, Italy, with a retrial over the 2007 killing of her British roommate Meredith Kercher.

But Knox, 26, who has expressed concern about returning to a country where she spent four years behind bars, was not in court.

She was convicted in 2009 of murdering Kercher, a 21-year old British exchange student who was found stabbed to death in November 2007 in the villa the two young women rented in the central Italian university town of Perugia...

Amanda Knox's 2nd appeals trial for murder opens

Colleen Barry/Associated Press

Florence, Italy — U.S. student Amanda Knox’s second appeals trial in the murder of her British roommate opened Monday, but the star defendant was absent.

Italy’s highest court in March ordered a new trial for Knox and her Italian ex-boyfriend, Raffaele Sollecito, overturning their acquittals in the gruesome 2007 slaying of Meredith Kercher. The Court of Cassation gave a harsh assessment of an appeals court acquittal in 2011, saying it was full of “deficiencies, contradictions and illogical” conclusions.

During opening statements, lawyers for Knox and Sollecito requested an array of new expert opinions and evidence to reach a definitive verdict, including examining the handle of the knife that was the purported murder weapon and the handling of the crime scene...

Hope she's convicted in absentia!!! She's another Casey Anthony/OJ Simpson/Robert Blake/Michael Jackson. Guilty, but got off.:moo::moo::moo:

Respectfully snipped and BBM:

:twocents: This is a huge insult to those who are suffering with REAL PTSD ...

What a crock that Knox is now claiming to have this ... hmmm ... I remember when Jodi Arias "claimed" to have PTSD also ...

It is really getting "old" that when these knife-wielding "damsels in distress" run out of "excuses" they turn to PTSD ...

:twocents:
I just watched an episode of Snapped last night where the murderess claimed to not have remembered pouring an accelerant on her kitchen floor to light her house on fire to cover her dead husband's body!!!
The arson investigators sure found it! Her young son witnessed it.:banghead::banghead::banghead:

Knox's memory functions when she thinks that it will help her case. For example, she needed an alibi and claimed that she and Sollecito at dinner late, perhaps 9:30, 10, perhaps even 11. When Dr Sollecito demonstrated, with his 8:30 phone call, that the pair had finished dinner at 8:30, Knox's memory again becomes fuzzy. That is, she lies, and when the lie is exposed, she doesn't remember.

The appeal has not started off favoring Knox and Sollecito. All requests to retest evidence have been denied except for using more modern DNA analysis to examine Meredith's DNA on the knife. That will be examined by the Carabinieri. This is a good thing. Aviello, the mafia prisoner that claimed during the Hellman appeal that his brother murdered Meredith, will testify on Friday. The question that will come up is whether he received a bribe for his testimony. If he received a bribe, that will be very problematic for the defense.

 I totally agree, LinasK !
