"MOMENTS after he was told his fiancee had fallen to her death, Simon Gittany said to a police officer: "I hope the cameras were working", his murder trial heard yesterday.

But the Supreme Court was told yesterday the cameras Gittany installed to record inside their unit weren't working, and no device captured the 69 seconds between Gittany dragging Lisa Harnum inside and her fatal fall on July 30, 2011."


"Gittany had installed three cameras to record inside their apartment and in the hallway.

Sergeant Brett Wall told the court yesterday at least one of the cameras "wasn't visible to the naked eye" and that he and another officer detected a small, concealed camera "in a small frayed area" of the wall."

"Gittany's lawyer, Elias Tabchouri, said the witness's evidence could not be relied upon, as it was seen from a distance and through trees.

"He doesn't see a human; (he sees) luggage. There's a big difference," Mr Tabchouri said, placing a large black suitcase on a desk to illustrate the point."

He then saw a man 'load' what he thought was a duffel bag over the balcony, before calmly walking back into the flat."

I hope they have a psychologist in there (or eyewitness testimony expert) - i am sure they would. Of course he thought it was 'luggage' or something because he probably wasnt paying THAT much attention, and I imagine he was from a distance. To a certain extent you see (or rather perceive) what you EXPECT to see. No-one expects to see a body dropped off a balcony in the middle of the morning in busy Hyde Park Square. The fact that he saw SG drop SOMETHING over the balcony in my opinion is pretty strong evidence.

And yes Enzeder, I think that she must have been unconscious if it was the case that she 'appeared to be luggage dropped over the balcony' as I cant see her going peacefully if she was conscious. I wonder if the autopsy found evidence of strangulation or being punched/knocked out.

This must be so distressing for her family. Even the passers by have been traumatised according to reports in the papers.

The impact of seeing such a traumatic death has stayed with those who were on Liverpool St that morning. Dr Angus Gray was driving past the building when he saw Ms Harnum "lying on her side". "I'm sorry," the orthopaedic surgeon said as he remembered her "broken back, ribs and leg". The court heard the doctor, trying to resuscitate her with chest compressions, felt no pulse in Ms Harnum's body.

"NONE of Lisa Harnum's fingerprints were found on the glass balcony where her fiancée says she stepped over and fell to her death, a court has heard today.

Two marks identified as coming from Simon Gittany- a fingerprint and partial palm print- were located on the railing and glass surface, an expert told his trial."

Balcony death: Police found accused's fingerprint on railing, court told

"During Mr Gittany's murder trial on Thursday forensic specialist Lisa Gordon said she was unable to find Ms Harnum's fingerprints on the balcony's glass panels, railings or anywhere in the outdoor area of the unit.

The NSW Supreme Court heard police found Mr Gittany's fingerprint on the railing and his left-hand palm mark on glass panelling."

Watching that video .. seems so fake doesn't it? The body language ... Rachelle Louise placing herself in front of him, holding his opposite hand across his body (who does that?!) Seems more like a photo opportunity for her. And who acts like that going into Supreme Court?!

She seems like a 15-year old walking home from school with her boyfriend. He looks worried (good! alleged murdering swine!). His family trailing behind, ignored, meek and mild ....

I must say that Rachelle Louise looks VERY inappropriate and out of place in the video. If she is paid PR, it's not working!

Fake, fake, fake, fake ... feel like I'm watching a pantomime. "Here, let me pick these bits off your face, how do I look? Are they filming? Let's have a smooch."

She doesn't look concerned or personally invested in his court dramas at all. Not sure what they are trying to prove - but they certainly do not portray a united family who is concerned about the upcoming lengthy jail term of SG. Just taking a stroll along the street on a nice Spring day. I wonder in what capacity he has known her for the previous 5 years? 'Friend', indeed!

Both of them are absolutely disgusting. If she thought this was going to get her 15 minutes of fame, I hope she is wrong. I pray that when this trial is over, no media outlet will want her story, because I don't doubt that she will be trying to sell it
 
Ch 10 are advertising that Video of SG the moments before and after Lisa's death will be shown on their 5pm News
 
God, no matter how many times I see the footage of him grabbing Lisa, it is still as horrifying as the first time I saw it.

He put a shirt on... Why would that thought even enter your head?
 
The elevator part I find rather disconcerting.

If my husband had jumped off a balcony - I would be pulling at the doors - restlessly bashing at them until they opened. Even though I knew inside that there was no hope. Every fibre of my being would be screaming at me to get there. And I wouldn't be able to stand still and wait.

He also seemed to be checking himself out in the mirror - at the height of his portrayed distress. To me, this strikes me as odd. It rings a chord of when we come across pseudo seizures in healthcare. Someone pretends, very convincingly to be in status epileptus - a full blown tonic/clonic event. They don't respond to painful stimuli, often because the ruse is psychologically so deep they can withstand it. What they cannot withstand is a mirror in front of their eyes. They glance at themselves, however fleetingly. The irresistible urge to confirm their own skill.

For some reason, the look in the elevator was that. There was too much overall composure - and definite glances at the mirror.

Then again, I am a female, and a particularly prone to emotional displays at that. Maybe it's just personality / gender differences at play. But still, I could understand totally numb and emotionless more than the behaviour displayed in the video.
 
I think the two video segments are pretty damaging to the defence. Would it matter what experts were trotted out afterwards? What could be said that could rationalise those images? If she was suicidal , why cover her mouth and drag her inside? Let her scream - let the neighbours get further help for you!

I haven't been following this case closely - just MSM when it pops up, but the latest developments - these videos, that chilling note and the missing footage from the apartment are certainly adding weight to my early assumption in this case.

Hopefully justice comes sternly and swiftly!

Great comparison.
The footage of him with his hand over her mouth and forcibly controlling her is haunting. He is angry.
And his actions and behaviour in the footage don't convince me that this is a person who has just witnessed someone (his partner) committing suicide.
As for the pictures of him (in todays paper) kissing his new girlfriend - no words :banghead:
