In the Simon Gittany trial, the lack of fingerprints on the glass barrier were a crucial part of the case - problaby the most damning piece of evidence. In the Tostee trial, why has the Crown brushed over the fact that only a single handprint of Warriena's was found on the balcony rail? If she actually climbed over, her finger/hand prints would surely have to be all over it. The Crown case that she climbed over is not even consistent with the evidence the presented. If I was on the jury I would be very confused about why the Crown has blatantly ignored crucial forensic evidence. Makes one wonder what other evidence was ignored by the Crown.

The difference between the Gittany trial and Tostee trial is that the Crown wanted to secure a conviction in the Gittany trial.
 
I am with you, I simply don't get it. So many things left unanswered. I mean did anyone bloody ask GT what the long thing in his hand is which can be seen in the CCTV footage of him leaving the lift. Simple question, but it seems like a very pertinent one to me.

Why also wasn't it mentioned in court the sounds which were so obviously Warriena struggling for breath, why wasn't he asked what was happening on that part of the tape? Was he ever asked to explain? Why couldn't this be questioned in court? I just don't get it.

I choose to think that they are all asleep at the wheel. The only other option is 'friends in high places'. I have sleuthed stuff that is out of bounds to comment on here. GT was not the only one who had his phone confiscated. His mate that had his examined is party and pleasure central at the Gold Coast (by his own definition) and stood firmly by his side. Fast forward a couple of years and I dunno.

I wonder if the scope was partially dismantled at some time during the evening, long before Warriena met her death, so it could be used on the balcony by them to look at people on the street (as Tostee stated he wanted to do and enquired about on the bb forum)?

Could that account for the noises of something dropping on a hard surface and another being screwed or unscrewed?

Did the object GT had in his hand in the basement have Warriena's fingerprints and/or DNA on it? I'll make a wild guess it did.

He was too shocked to retrieve his shoes from the balcony (yeah, right, he knew there were witnesses to Warriena's death that could see or hear him) but he had the presence of mind to spend the time, and the ability to use his fine motor skills, to screw something together or dismantle it.

I have been trying to find out how Prosecutor Glenn Cash performs, as far as securing a conviction.

So far, I have found 3 murder cases where he has secured convictions. Have not yet found one where he hasn't secured a conviction.

There is a case here that Glenn Cash tried ... an iffy one that could have gone one way or the other. The charge was manslaughter, the jury decided on guilt of the lesser charge of dangerous interference with a motor vehicle causing death.

Not looking for any more of his cases now. He has had no dramatic lack of convictions, that I can see. Let's hope he performed well in the areas that have not made it to MSM.

Earlier, Bruce and Denise Morcombe arrived this morning for the special leave hearing in the High Court to decide whether the man convicted over their son Daniel&#8217;s murder can appeal his guilty verdict and life sentence.

Director of Public Prosecutions Michael Byrne QC has also arrived along with the prosecutor for the case, Glenn Cash.

Ahhh .... see, it is not all doom and gloom with him. He should know what he is doing, and should be able to secure a conviction.
 
Sorry, point being.. that fat 'bracket' was probably used on the balcony (as opposed to the tripod) - needs to be sturdy, with bolts heavy enough to make that 'unscrewing' sound. Look where it is.. about where this pic was taken... how far from the door.

in the tape, it sounds like they were right by the door? Can anyone hear her being dragged out, before the door opens? Note also how small that balcony is -- he was out there with her for about 70 seconds, every moment of which, she was screaming NO. And this is what I hope the jury wants some answers for.

Among his more recent high-profile cases was his successful prosecution of the man who stabbed Brisbane teenager Phillip Halipilias to death on the dance floor at the Alexandra Hills Hotel.
Mr Cash is also involved in the case against accused wife-killer Gerard Baden-Clay.

I think this has been a case of lazy prosecution work, an expert witness has not been employed to interpret the tape, the evidence of feet pointing out has not been adequately dealt with, explanations for the one finger print on the balcony rail has not been dealt with sufficiently, the metal object has not been identified and they have not been able to cross examine Tostee. Would it have been better for the tape not to have been found?

The police were not lazy. They investigated. The evidence is there - enough for a murder conviction. The tape, the single hand print, the mystery object, the unscrewing, the timing of what witnesses below and saw and heard. If the prosecution had put it all together, securing a conviction would have been easy. The evidence is there. The PROSECUTION has clearly disregarded it, even obscured it. No lawyer with any integrity would have run a trial the way this has been run. This is a travesty of justice

The evidence photo at post # 503 The telescope looks silver.

Cash says there was a hair found on the clamp consistent with being Tostee's. For them to conclude how it got there.
 
Hi I'm new here and I've actually decided to have enough courage to join in.
I was just looking at the photos of what possibly GT was carrying and it's definitely nothing fluid like a lanyard.It doesn't seem to flow with his body and in actual fact it defies gravity which makes the item rigid IMO.
As to the possibility of keys, would these be in this building the electronic credit card type?,or would they be a physical metal one .
Another thing that I really can't get out of my mind is that I have listened to the audio way to many times that I care to admit,I wonder that when GT is saying let go...let go, could this be that WW was holding the balcony railing , as it seems that would equate to WW one and only palm print found on the railing.
These are just my opinions

WW was a strong intuitive woman and in the end she became a societal victimised woman
It was all about victim blaming
Mr Holt used this as his advantage
He knew it was easy
Easy to blame the victim
Easy to make the victim needy
Easy because she was female
That's what society accepts

This photo is one Tostee posted and not a Police pic - I thought that was a remote control or maybe a cordless entry phone?
