Jurors see video of Phoenix woman admitting Ame Deal was placed in footlocker

Video presented Thursday showed Sammantha Allen telling McKay that she knew Ame was still inside of the 31-by-14-by-12 inch box when she fell asleep, and that multiple members of the family had used the small plastic box as a form of punishment for the child.

Jurors saw McKay ask Allen in the video what she would call putting a child in a small, hot container overnight.

"Abuse," Allen replied.

"Know what I call it? Murder. That's what I call it," McKay said.

Sammantha Allen was found guilty of first-degree murder and other charges Monday in the death of Ame Deal, her 10-year-old cousin, who suffocated inside a padlocked plastic box at her home.
The verdict was delivered Monday by a Maricopa County Superior Court jury.
Another hearing was scheduled to begin at 10:30 a.m., Tuesday to determine whether aggravating circumstances were involved in Ame's death. If aggravating factors are found, the trial will proceed to a third phase that will determine if she gets life in prison or the death penalty.

John Allen is set to face trial Aug. 7. The two are the only people still facing murder charges in connection with Ame's death.
 
Jury says Sammantha Allen eligible for death penalty in Ame Deal murder

Sammantha Allen should receive the death penalty for her role in the suffocation death of her 10-year-old cousin, Ame Deal, a Maricopa County Superior Court jury decided Wednesday.

For Allen to be eligible for the death penalty, jurors had to agree that there were aggravating circumstances in Ame's death, meaning Allen's actions were especially cruel and heinous.

It took jurors 15 hours of deliberation to come up with a unanimous decision.

Sammantha's trial will enter the death-penalty phase on Monday. John Allen's trial is scheduled for August 7th.

PHOENIX - Day two of the penalty phase of 28-year-old Sammantha Allen's trial included intimate details of her past in Utah where she married her first husband and suffered a devastating miscarriage.

The defense called to the stand Joe Evans, who said he met Allen and her mother in 2006 when they came through a McDonald's drive-thru in Utah, where he worked at the time. Shortly after, he began dating Allen and saw first-hand the family's living conditions.
"There was feces on the walls, cockroaches, drawings on the walls, food on the floor," Evans said. "It was filthy."
He described hearing the family talk about the children having lice and observed a very crowded home with several adults and children, including Ame Deal. The couple would occasionally babysit Ame and her siblings.
"Who was the best behaved out of all those children?" asked Deputy Maricopa County Attorney Jeannette Gallagher.
"Ame," Evans said.

The defense also questioned the family dynamics, which Evans said were controlled by Allen's mother, Cynthia Stoltzman, and her grandmother, Judith Deal. Both women are behind bars after being found guilty of child abuse charges connected to Ame.
"Were there ways this Stoltzmann-Deal family struck you as a cult?" asked John Curry, Allen's defense attorney.
"Yes. If you didn't fit in with them, you were just cast aside," Evans said.

Sammantha Allen's defense attorney on Thursday tried to discredit earlier testimony by her mother by showing clips of young family members telling Phoenix police about horrific abuse that Ame Deal endured long before her death.

Attorney John Curry sought to counter Cynthia Stolzmann's claim that she never told Allen it was OK to discipline Ame by locking her in a box and that only a few family members knew about the punishment method.

Stolzmann previously said only she, her mother and brother were involved with Ame's discipline. However, after watching the clips, Stoltzmann admitted that every adult in her family was involved in abusing her.

Sammantha Allen's death-penalty hearing will likely continue for two more weeks. The next hearing is set for 10:30 a.m. July 17.

The coverage for the trial felt inconsistent. She was in court this past week but no ruling has been made.

Death or life in prison? Jury soon will decide Sammantha Allen's fate

Defense attorney Jeremy Bogart said Allen forgot to let Ame out of the box.

The defense has listed mitigating factors that could have influenced Allen's actions, in an effort to persuade jurors to impose a life sentence instead of the death penalty.

Deputy County Attorney Jeannette Gallagher said Allen chose to let Ame suffocate and die in the box overnight.

"Defendant (Allen) took Ame's life for no reason," Gallagher said.
