Yes, but it was Baez who wanted the gag order denied. It was the defense counsel who did n't want the media trial to end. Really strange doings.

I don't know how this will affect his request for a change of venue, if that motion is filed. Arguing against the gag order might later haunt him in some ways.....

Black said the defense has made "numerous attempts to preserve the evidence" near where the child's remains were found, but police and prosecutors have been uncooperative.

"This has become a malicious, nasty case," Black said on Thursday. "Even in the worst cases, like O.J. Simpson, I've never seen an investigation tell a defense team to go to hell."

Though he admitted police haven't actually uttered those words, he said "their conduct tells you that," because they haven't kept the defense team informed and won't let them observe their work at the crime scene.

"Some of their comments are blatant lies," Black said. "History has shown that in some cases authorities have been caught tampering with evidence. That is something we hope is not happening. We're not accusing anyone of anything."

Among the lies he is accusing the sheriff's office of telling are statements about clothing found with the child's remains and the implication that the area where they were discovered hadn't been searched before.

Black said EquuSearch volunteers were the only ones who hadn't previously scoured the wooded lot.

"When [police] started searching for that child, they went into that area several times — with dogs, with people. Not once, but several times," Black said. "It's kind of suspicious."

He suggested the bones might have been dumped there by the person Anthony says took her daughter.

"It seems like somebody may have been waiting ... somebody may have thought, they're done with that area, so let's dump it," Black said. "If that occurred, Miss Anthony was locked up all that time."

The defense is backing Anthony's claim that her daughter was kidnapped by a baby sitter named Zenaida Gonzalez, a name police say is made up.

I have viewed this as if it were a different crime, to gain even more perspective.

Say a murder happens in a house.

One day later, the alleged killer is arrested.

The home where the murder took place is still filled with LE and forensics people of all kinds.

How often do you see the defense attorney for the accused killer sitting outside on the sidewalk, tapping his fingers, and asking the Court to let him go in with a team whose goal it is to have the crime remain unsolved???.

LOL, I was just thinking CSI. Since Casey listed it as one of her favorite shows, maybe she should advise her attorney that is not how Grissom does it.

Cindy, George, and the defense all claimed for weeks and weeks when the car and evidence was being processed that "it doesn't take this long for DNA to come back.......so they must not have anything!!!"

Wonder what the big rush is to get on that crime scene? They don't even know that it's Caylee yet. I hope the owner of that "private" property puts up a huge fence, and posts a bunch of no trespassing signs everywhere the minute LE leaves the scene. Baez will flip!!!!

LOL - that is exactly what I was thinking. I believe I heard this last night but can't recall now which show. Someone from the OCSO said that it is private property and will be up to the property owner to allow access to anyone once the crime scene work is finished.

No defense attorney gets the right to work the scene with the cops. Period. They get discovery later, the evidence found. They may well get the right to get some things to test themselves. Later. They don't get to do the autopsy with LE. They can get the consent from the next of kin after body released to do another at their expense. There needs to be a gag order now to shut up Baez. He is simply trying to taint the jury pool. The judge ruled on his request, it was denied and he needs to shut up and quit lying.

I hope the property owner does deny all access. Baez can then try to get a judge to force this, but, I don't think he would get it.

We should call Det Yuri and see what he could find to leave there for Baez and team. Maybe he could leave a trail of bread crumbs that lead straight to the jail with a note, explaining to JB to look to his client for answers because she has them all!! And he doesn't have to climb around in the muck to find them!!

Dear Jose',

Somehow she has convinced you that these tactics will sway people into believing that you are owed the right of observation, let alone assistance to an ongoing investigation into a crime scene. Whether this crime scene is eventually indicated in the case you have set before the court to try, until it is identified as such, you and your glory-seeking publicity hound "experts" will simply have to sit on the sidelines in your collective bad wardrobes.

Please be patient. The State is making certain that there is nothing missed in this investigation.

I would not allow anyone onto my property after LE is finished unless they sign a full waiver waiving responsibility if they are hurt. If they get hurt on your property you can be responsible for damages and medical treatment. If it was JB I would not allow them access regardless. They do not have the legal right to be there.
