After a thorough & exhaustive search, #rcmpmb has not been able to substantiate the tip in York Landing. RCMP resources will continue to be in the York Landing & Gillam areas.

We thank the community for their patience & understanding & ask them to continue to be vigilant.

I have reservations, especially if Bryer was doped up with ADHD drugs all his life, his parents have been at war non-stop, and there is mental illness in his family.

I think if ADHD meds caused violent behavior in the manner you're suggesting it would be Purge night every night everywhere.

In any event I looked up the insanity defense in CA and it looks like it is very similar to US laws but it is somewhere between what some states call guilty but mentally ill and not guilty by reason of insanity.

It looks like it's not criminally responsible due to mental illness.

However, it appears similar to here. Hard to mount a successful insanity defense and the person has to be pretty much psychotic.

So, dude with a history of psychosis who cuts off head of fellow bus rider and runs around in the bus yelling and holding the decapitated head for all to see? Insane.

Dudes who plan, evade and cover their crimes? Not insane.

And in Canada, just like the USA, the suspects are entitled to a trial before being pronounced guilty!!!!!!
I’m pretty sure everyone is aware of that fact.

They are entitled to a trial by a court.

We are free to judge them in the court of public opinion.

I’m under no illusion that the RCMP is chasing around two innocent men.
 
Maybe the fugitives have internet service but the RCMP radios don't work........!!!

Do we know their radios still aren’t working? Or maybe in the rush to arrive at York Landing communications hadn’t yet been established?

So we still have no idea where this pair is now, or have been, for the last 5-6 days now ?.........moo
 
In Canada, the litmus test for a finding of NCR (not criminally responsible by reason of mental disorder) is left up to a Provincial Review Board after a preliminary judicial decision - this differs quite a bit from the US. Once a finding of NCR has been made, the person will sit the review board every twelve months until discharged.

In the R v. Chaulk case, the SCC found that one must not be able to understand that something is both legally AND morally wrong. These test for 'insanity' in Canada uses a quite different process, and relies upon a different set of case-law than in the USA. We do not have a 'not guilty by reason of insanity' option at judgement.

In Canada, the process and name have been changed, but the test is the same. In an international forum, I don’t think that there’s a benefit to getting into local minutiae. This CBC quote accurately states the test:

“That designation [not criminally responsible] is made if it's determined a mental disorder made it impossible for the accused individual to appreciate the nature of the actions in question or know that those actions were wrong.”

This will be well-understood by Americans, Australians and others in English speaking countries.

Damn. That sort of thing does happen a lot, and I can’t fault this guy on account of he hadn’t been informed they were wanted.

He’s really lucky these two didn’t decide to shoot him, as he was unarmed.
Canadian policing at its best. The RAV4 didn't show up as stolen? Did they bother to check the plate? Check for ownership? If they were acting so sketchy, why didn't they check these basic things?
 
Yes,but they took the lives of three kind, innocent people who, had the killers asked, would have shared what food, money and transportation they had. The killers decision to brutally slaughter people who were likely unarmed and no threat to them indicates a cold blooded level of hate and depravity. They killed these people for the thrill of it, not because they were confused or impulsive. It's their choice of victims and means of killing them that defines these killers.

wow. let's just not even bother with a trial; let's just kill them outright........

This is because he was a peace officer with the local band, not an RCMP officer. He may not have had access to vehicle registry databases. His job was to check for alcohol and contraband.

Anyone able to parse Mountie twitter speak for us: does this mean they can't find proof they were in York Landing or that they aren't even sure there was a sighting in York Landing?
