New Brunswick prosecutors say they will ask the Supreme Court of Canada for leave to appeal a court ruling overturning Dennis Oland’s murder conviction — while the defence says it may ask the top court for an outright acquittal...

Lawyers are still waiting for the full, printed and translated decision of the Court of Appeal, which is to be released on Jan. 12.

The Crown will then have 10 days to review it before making their application for leave to the Supreme Court. At that point, the defence will have 60 days to prepare any application for a cross-appeal.

Dennis Oland's new second-degree murder trial in the 2011 bludgeoning death of his father, multimillionaire Richard Oland, is expected to last up to 65 days, New Brunswick Court of Queen's Bench records show.

That's the same length of time that was set aside for his first jury trial in 2015 — one of the longest criminal trials in New Brunswick history.

The trial date is tentatively scheduled to be set on August 8th.

The Crown is "hopeful" Dennis Oland's new murder trial in the bludgeoning death of his father, New Brunswick multimillionaire Richard Oland, six years ago, will be held next year.

P.J. Veniot, the lead prosecutor, made the statement to reporters after a brief court appearance in Saint John on Tuesday morning.

"The Crown is ready to proceed whenever the dates are set," he said.

Court of Queen's Bench Justice Terrence Morrisson, of Fredericton, who will preside at the retrial, suggested Tuesday that a pre-trial conference should be held first and set a date of Nov. 2 at 10 a.m.

"It seems to me … there are a number of factors which are going to have an impact on when this trial starts," he said, citing as examples how many voir dires on the admissibility of evidence will be required, whether there will be any pre-trial or Charter motions, and how many Crown witnesses will be called to testify.
 
Smiles all around now, but by end of this 2nd go around, the smiles will be gone when the truth is proven for a second time with a guilty verdict in this farcical and un-necesary re-trial. The original trial had a %100 correct verdict that was overthrown by a double-standard and with nothing but speculation,...... something the original jury was, and correctly so, forbidden to use. Lawyers and the amoral games they play aside, know that this is simply a delay of the inevitable. Why do you think this was postponed to go past Christmas this time? So the jury wouldn't feel rushed, as was incorrectly speculated? Well folks, they weren't. It is so Dennis can enjoy one more yeultide season before he's off to jail where he belongs. Even his lawyers know they will lose once again and all of the denial, including that from Dennis' family will not change the inevitable & correct outcome - GUILTY. Dennis knows. Enjoy your freedom now, Dennis - pack your bags and get ready to serve your time behind bars where you belong. Nice guy or not & while I don't know him personally or even think he is is a danger to society, murder is a crime and he is guilty of murdering his father and must be held accountable and do his time. The end is near and 'without prejudice, sympathy or fear', by end of January 2019, Jury - Version 2.0 will also be able rest easy at night knowing they did the right thing and put this to bed. Dennis should have accepted the original verdict and served his time,...the 2nd go around may have the jury have less empathy and recommend Dennis go away for a bit longer. MHO.
 
Police investigators’ actions under the spotlight at Dennis Oland murder trial
SAINT JOHN, N.B. — The activities of police officers at the Richard Oland murder scene will be under close scrutiny as his son’s retrial moves into its second week, resuming Tuesday.

Dennis Oland’s defence lawyers describe the conduct of the murder investigation by the Saint John Police Force as “inadequate” and they have made it clear police activities will be a focal point of the defence strategy.
 
The trial has heard initial evidence suggesting that one person working in the same building on the night of the murder heard noises coming from Oland's office at a time that would exclude his only son, Dennis, as the perpetrator. Naseemuddin said there is no way Richard Oland could have lingered for several hours and made thumping noises at a later time on the night of July 6, 2011.

Dennis Oland left his father's office at around 6:30 that evening — the last known person to have seen Richard alive. The witness believes he heard the noises between 7:30 and 8 p.m., when Dennis was shopping some distance away in Rothesay,N.B.

Prosecutors contend Dennis killed his father "in a rage" when they were alone in the office between 5:45 and 6:30 p.m. The main motive, they say, was Dennis Oland's financial difficulties.

What is it with police forces alllll over nowadays, who don't do their basic jobs in investigating because they're focusing too intently on who they *think* the perp is? Seems like it's happening everywhere, and we hear about it after the fact.. meanwhile the criminal gets away. :mad:

"Police also did not check on a report by a woman who said she heard shouting in the area of the crime scene on the night of the murder. As well, Gerry Lowe, a member of the New Brunswick legislature, was sitting in a restaurant near the crime scene and said he saw a man leave the building at around 7:30 p.m. But Lowe was not sure if he saw the man on the night of the murder or the day before.

Davidson said police did not investigate to see if Lowe had been at the restaurant the day before the killing.

Oland’s defence team is arguing at trial that the Saint John police investigation was inadequate. Almost every police officer who has been on the stand during the trial’s first two weeks has been asked pointed questions about weaknesses in procedures and problems in protecting the crime scene.

The Oland trial adjourned on Thursday until Jan. 7, 2019. It is expected to last until March"

I will wait until the next band of evidence comes out, but in the meantime, I find it difficult to figure out who would want to violently kill this man, other than someone emotionally close to him.

Was he liked? No. Did he deserve to be massacred? No.
Why would a stranger want to kill him?
