Oland trial witness adds ambiguity on timing of multimillionaire’s killing (with clip)

"A man who probably heard Richard Oland being bludgeoned to death in his office has told a Saint John court he cannot pinpoint the time the strange thumping noises were made.

John Ainsworth’s testimony at the second-degree murder trial of Dennis Oland on Thursday leaves open the possibility that the multimillionaire businessman was killed during his son’s visit to the uptown Saint John office on July 6, 2011.

Ainsworth cannot corroborate the testimony of his friend, Anthony Shaw, who was also working in the building, below Richard Oland’s office, on the evening of the killing....

Crown prosecutors are close to concluding their case against Oland and may be able to wrap it up on Friday. The defence will cross-examine Ainsworth on Friday afternoon.

The defence is expected to present its case in a couple of weeks. Defence lawyer Alan Gold said he plans to ask the court to allow a visit to the crime scene for better visualization of the cramped conditions in the office.

Justice Terrence Morrison said such requests are not usually granted, but he said Gold is free to make the application.
In addition to Ainsworth’s testimony, prosecutors are playing video of blood and DNA testimony from Oland’s first trial in 2015....

Friday will be day 39 of the Oland retrial."

Wow, seems the Ainsworth fellow has a bit of an anger problem. Also obviously wants Dennis to be convicted. Even going so far as to change his original statements, even though the statements and memory would have been a helluva lot 'fresher' at the time. Hmm.
 
Would be interesting to know if police confiscated any of Dennis' other jackets and shirts and pants, to see if they had also been drycleaned, and to see if they may also have had remnants of blood from Richard on them. If Richard's scalp tended to bleed, and Richard was a touchy-feely guy, then it may make sense that little bits of his blood and/or DNA may have also been found on other clothing of his son's? Would be nice to know if they had done this testing, for comparison purposes?
 
Wonder why no yelling/screaming/etc was heard? Was the first blow the killing blow?
 
Whoever did this obviously took Dennis' phone with them when they left. Why? What would be found on his phone, which wouldn't have been able to have been determined via other means? I'm thinking texts? The cellphone provider may have records of texts being sent and/or received, but not necessarily be able to see what was in them - that info would have to come directly from the phone, if I'm not mistaken.

In the video Ainsworth mentions the timing of the noises as 730, quarter to eight. In the first and second trial he would state they would occur between 6 and 8:11 when a fax was sent. He was challenged on those inconsistencies by the defence @Global_NB #Oland

I was thinking the same thing yesterday- why no screaming, etc.

You are probably correct that the 1st blow was what killed him.
 
Prosecution evidence concluding in Dennis Oland murder trial

"SAINT JOHN, N.B.—A bloodstained jacket, a missing cellphone, a multitude of police errors and the bludgeoned body of one of the wealthiest men in New Brunswick — Crown prosecutors are concluding the evidence portion of their case against Dennis Oland....

Final evidence for the prosecution on Friday included testimony from blood and DNA analysts who identified four small bloodstains on the jacket Dennis Oland was wearing when he visited his dad on the day of the murder. Richard Oland’s DNA profile was found within three of the bloodstains.

But defence lawyer Alan Gold said during cross examination of the forensic experts that there are limitations to the blood and DNA evidence — there is no way to know when or how they came to be on the jacket.

“We can’t say when DNA was deposited, how it was deposited, the order in which it was deposited or how long it was there,” Thomas Suzanski, a forensic specialist from the RCMP crime lab in Ottawa, said in his testimony."
