I was thinking the same thing yesterday- why no screaming, etc.

You are probably correct that the 1st blow was what killed him.
I'm thinking the first blow *wasn't* the killing blow.. but who knows? But weird that no yells or anything were heard, and no running down the stairs after the noise of the falling the men downstairs heard.. I wonder if RO was quickly banging on the floor after he fell onto the floor, to alert the people downstairs? Otherwise, what were the quick banging noises they heard after the big 'fall' noise? The weapon hitting the floor really quickly?? Missing the victim and getting the floor instead??

Interesting that the husband of RO's girlfriend said he didn't know about his wife's 8-year affair with RO, until 15 months after the murder (October 2012).. and he was already divorced from her (who knows for how long?? I can't find that info, has anyone seen it??) by the time the trial started (fall 2015). And even though he admitted that had he known, he would have been very upset.. the police didn't bother to even look at his cellphone, vehicle's GPS, etc. I wonder why the Defence didn't want the Crown to put him on the stand at this second trial?

Defence lawyer raises new questions about timing of Richard Oland's killing

February 22, 2019

"SAINT JOHN, N.B. — A tense cross-examination of the final prosecution witness at the Dennis Oland murder trial has raised new questions about the time Richard Oland was killed.

John Ainsworth, the owner of the uptown Saint John building where Richard Oland was murdered on July 6, 2011, was grilled by defence lawyer Alan Gold on Friday about the loud thumps and bangs he heard that evening.

The noises likely were the sound of Oland being bludgeoned to death.

Ainsworth insisted, angrily at times, that he does not know what time he heard the noises, beyond the general range of 6 to 8 p.m. That is in contrast to his friend, Anthony Shaw, who was with him that evening and believes the noises were made around 7:30 to 8 p.m.

The time is critical to Dennis Oland’s defence. If Shaw is right, the killer could not have been Oland, since he was caught on security video shopping at 7:30 p.m. Ainsworth’s testimony leaves open the possibility that the killing happened while Dennis Oland was at his father’s office, before he left at 6:30 p.m.

“I do not know what time it was,” Ainsworth exclaimed under intense questioning by Gold. “I have been suffering with it for eight years. I do not know.”

However, a videotaped statement made under oath by Ainsworth in 2011 for a private investigator working for the Oland family and entered into evidence on Friday, makes it clear that originally, Ainsworth also thought the sounds were made at 7:30 to 8 p.m.

“It was approximately 7:30, or quarter to 8,” he said during the interview.

Despite that, Ainsworth said once he had time to reflect on what had happened, he felt he could not be specific about the time.

“I was not paying attention,” he said.

Gold accused Ainsworth of wanting Oland to be convicted for the murder and that is why he backed off his original statement. But Ainsworth disputed that allegation.

“I am not that type of person,” he said. “I want to be honorable. That’s all. Integrity is everything.”

The testy exchanges between Gold and Ainsworth closed the prosecution case against Dennis Oland...."

Dennis Oland retrial set to hear first defence witness on Tuesday (with clip)

2/28/2019

"The retrial of Dennis Oland for the second-degree murder of well-known Saint John businessman Richard Oland is set to resume on Tuesday, with the defence expected to call its first witness....

The defence says it could be finished calling witnesses by mid-March. This is expected to be followed by a time period for final written arguments from both sides and then time for the judge to make his decision.

It could be late May or early June before a verdict is reached."

Dennis Oland expected to testify Wednesday at his murder retrial in father's death
Defence team scheduled to begin presenting its evidence Tuesday

Mar 04, 2019

"Dennis Oland is expected to testify Wednesday at his murder retrial in the 2011 bludgeoning death of his father, multimillionaire Richard Oland.

His defence team is scheduled to begin presenting evidence Tuesday, when the trial resumes in Saint John's Court of Queen's Bench following an 11-day break, weather permitting.

No witness list has been released, but lead defence lawyer Alan Gold said during opening statements that Oland would take the stand in his own defence, as he did at his first trial.

"You will hear him tell you, 'I am innocent. I did not kill my father. I did not do this cruel horrible attack on my father,'" Gold said on Nov. 21.

Gold confirmed Monday the "tentative plan" is for Oland to testify on Wednesday.

The defence has previously hinted other witnesses could include a cellphone tower expert regarding the victim's missing iPhone, a footwear impression expert regarding a possible partial bloody footprint found at the crime scene, and a toxicologist regarding alcohol detected in the victim's urine.

Gold has said the defence will also seek to have the court visit the crime scene because photographs of the victim's blood-spattered office at 52 Canterbury St. "don't do justice to the compactness of the location and that may well be a factor that the court has to consider in deciding what happened."...

Gold expects the defence to wrap up its case by March 14. That's about twice as long as the four days the defence took at Oland's first trial in 2015, when a jury found him guilty of second-degree murder....

He is being retried by judge alone...."

I missed this part, and I had questions about the drycleaning aspect.

... talked about an order dropped off the day after Richard Oland was found dead in his office.

Among the 16 dress shirts and one pair of pants were two jackets, one of which was a brown sports coat. The dry cleaning tag from the jacket matches the serial number of an order placed by Lisa Oland’s account on July 8.

.... Nam, when asked repeatedly by the defence if it was Lisa Oland who dropped off the order, said it was too long ago to remember.

Choi and her husband co-own the business and inspect each item of clothing that comes into the store for stains. When asked by defence attorney Alan Gold if there were blood stains on the jacket, both Choi and Nam said no.

Back at Saint John Law Courts for the resumption of the Dennis Oland retrial. The defence is expected to begin presenting it’s case by calling its first witnesses @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 3h3 hours ago
Saint John Harbour MLA and former city councillor Gerry Lowe is seated outside the courtroom @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Court underway. Gerry Lowe is called as the first witness for the defence @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Lowe says he knew Richard Oland. He says he doesn’t recall being interviewed in 2011...but a few years later @Global_NB #Oland

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
Retrial has heard Lowe was at Thandi's restaurant, across the street from Richard Oland's Canterbury Street office on July 6, 2011 - the night he was killed.

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Lowe can’t specifically recall the time and date he was at Thandi’s but doesn’t dispute it was July 6th, the night Richard Oland was killed @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
He says he had been to the restaurant hundreds of times @Global_NB #Oland

Robert Jones‏ @cbcjones 2h2 hours ago
Lowe says as he was in the restaurant he saw a man come out of the door leading to Richard Oland’s office and head toward King Street.

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Lowe tells the court “I believe I seen some male come out and make a left hand turn toward King Street”. He indicates the door in question as that leading to Far End Corporation. The left hand turn would be as Mr. Lowe saw it from the restaurant @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Lowe says he went to the racetrack after Thandi’s and after seeing the male leave Far End Corporation door. He says he placed some bets “a dollar or two” he says jokingly @Global_NB #Oland

Robert Jones‏ @cbcjones 2h2 hours ago
A major issue in the trial is whether the murder happened before 6:30, which is the crown’s position - or after 7:30 which is the defence position. Lowe seeing someone leaving the door to Richard Oland’s office between 7:40 and 8:20 helps the defence bolster its timeline.

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Lowe also mentions a potential photography event going on outside Thandi’s but can’t give specifics. Defence ends it’s direct examination. Jill Knee cross examining for the Crown @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Knee asks Lowe if he has any recollection of the specific date he saw what he saw . Lowe says he doesn’t remember @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 2h2 hours ago
Justice Morrison allows defence lawyer Alan Gold to refresh Lowe’s memory of that night. Crown objects. Morrison tells Gold he is on a short leash. Gold asks Lowe to read from police narratives. Crown objects so Morrison calls for a five minute break. @Global_NB #Oland

Lowe was confused about many details under cross-examination. 'I’ve wracked my brains the last couple months... I've thought and thought - it’s just been so long, 8 years is a long time.' Richard Oland was found bludgeoned to death in his office on July 7, 2011.

The Crown and defence are arguing Lowe’s recollection of a photo shoot on July 6, 2011. Defence argues Crown is trying to undermine Lowe’s memory reliability and Davidson should be allowed to be testify to his interview with Lowe in 2015 @Global_NB #Oland

Andrew Cromwell‏ @Andrew_GlobalSJ 48m48 minutes ago
The photo shoot is called anchor evidence because an agreed statement of fact was entered of a photo shoot on the evening of July 6, 2011 at Thandi’s @Global_NB #Oland

Presumably Baumeister was going to offer insight into the significance of Richard Oland’s missing cellphone connecting to a cell tower in Rothesay far from the murder scene at 6:44 the night of the killing and the phone returning a “roaming error” message during searches for it.

Gold making a submission without the witness present. He’s arguing issues of fairness, trial by ambush. He suggests that by extending the witness expertise the Crown could be looking to induce new opinion evidence. Gold withdraws Baumeister as a witness. @Global_NB #Oland

Veniot is asking Babin about his findings in report to Saint John police, dated April 24, 2014

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
Report indicates it's "possible the patterns seen...could have been made by footwear." Veniot questions how he could eliminate footwear as being the source of the patterns if he isn't even sure they were created by footwear

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
You're not saying it's probable or certain pattern was created by footwear? No, says Babin. Appears to be footwear, but can’t say 1000 per cent - pattern missing, clarity missing

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
Have you ever gone to crime scenes where a body has already been removed? asks Veniot. "Once or twice," says Babin. Where officers have gone in and stepped in and around? "It didn’t happen a second time," Babin says with a smile. But it has happened? Correct

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
Sgt. Mark Smith, head of SJPF forensics, has previously testified he initially believed the possible partial footwear impression had been created by Const. Duane Squires when he helped him remove the body.

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
It was only later, when reviewing photos of the crime scene, that he realized the pattern was there before the body was removed, he said.

Bobbi-Jean MacKinnon‏ @BJMCBC 2h2 hours ago
Defence is suggesting it could have been created by the killer. Court has heard several people were in and out of the crime scene that day, including several police officers, 2 paramedics and 2 funeral home employees. Most wore no protective shoe coverings.

New Brunswick politician testifies at Dennis Oland’s murder trial

March 5, 2019

"A New Brunswick politician who may have caught a fleeting glimpse of Richard Oland’s killer on July 6, 2011, has told a court there’s little he recalls from the night of the murder.

“I’ve racked my brains the last couple of months,” Liberal politician Gerry Lowe told Dennis Oland’s murder trial on Tuesday.

“I’ve thought and thought … It has been so long. Eight years is a long time.”

Lowe, who represents Saint John Harbour in the New Brunswick legislature, was the first witness for the defence as Dennis Oland’s trial moves into its final stages...

Directly across the street from the building where Oland’s office is located is Thandi’s restaurant. Lowe told the court he probably visits the eating establishment “300 or 400 times a year.”

Lowe said that while he cannot recall for sure what night it was, what the time was or what the person looked like, “I know I saw a man come out the door (from the Oland office) and walk to the left towards King Street.”

The court already knows from video shown earlier at the trial that Lowe was at Thandi’s restaurant on the night of July 6, 2011 between 7:40 p.m. and 8:35 p.m.

The question is, did he see the person on that night or during one of his other many visits to the restaurant?

The issue is critical to Oland’s defence. He has long been described as the last known person to have seen his father alive. The prosecution maintains he bludgeoned his father to death between 6 p.m. and 6:30 p.m. during a private visit to the office.

If Lowe saw a person leaving Oland’s office at a later time, between 7:45 p.m. and 8 p.m., it opens the door to murder by someone other than Dennis Oland.

The accused was caught on security video shopping at Rothesay, on the outskirts of Saint John, at around 7:30 p.m.

Following Lowe’s testimony, defence lawyer Alan Gold called Saint John police officer Stephen Davidson to the stand. Davidson interviewed Lowe in May 2015, prior to Oland’s first trial – although he did not testify during that trial....

There were at least two people who came and went from the office building that night, from the ground floor printing shop. One of the men went out for a smoke and Lowe said it is possible that could have been the person he saw.

But he was sure it was not a customer who arrived at the printing shop around 8 p.m. that night.

Later in the day, retired RCMP forensics officer Brian Babin testified about one, faint footprint found on the floor of Richard Oland’s office....

Babin told the court he could not say when the impression was made, meaning it could have been on the floor before the murder.

“In summary, no footwear impressions could be identified,” Babin said.

Dennis Oland, the star witness for the defence, is expected to be called to the stand as early as Wednesday."

Listening to this stuff, the more I hear, the more I find the actions of the police incredibly appalling.
