Dear Ms. Burdick:
I am writing this letter to ask you not to seek the death penalty against Casey Anthony in the above referenced matter. I am not going to go through an exhaustive list of all available mitigation in this case; however, I have sufficient information that will convince you not to seek imposition of the death penalty. I am continuing to investigate and further develop the mitigation evidence that I have available.
You will see that death is not appropriate for this young woman for many reasons. Firstly, the evidence certainly cannot support death aggravators; moreover, several evidentiary problems exist in the case. Second, at most, only one of 15 aggravators applies in the circumstances of this

Recently, Local 6 News in Orlando posted a story entitled Baby Photos of Caylees Mom used in Request to Avoid Death Penalty.

Media had gotten a copy of a memorandum prepared by the defense for the prosecution. Local 6 News quoted extensively from the defense memorandum, stating that, Anthonys defense team also raises the possibility that Caylee may have been poisoned by chloroform, saying, Death may have occurred while the child was sedated or from an unwitting overdose of a sedative.

The report from the defense is part of the process Florida prosecutor go through in deciding whether or not to seek the death penalty.
Filed by Miami attorney Terence Lenamon, it is not a public record under Florida law.
Parts of the report, given to the media by Lenamon, may give a clue to Casey's defense at the murder trial.
Lenamon writes in the document that Casey was "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth. Even the lack of emotion after her child's disappearance and the arrest is not normal."
The report outlines several other reasons the defense believes it is not a death penalty case.

Report argues against death for Casey Anthony
A Miami lawyer hired by Casey Anthony's defense team gave prosecutors a report Wednesday outlining arguments on why the single mother accused of killing her child should not face the death penalty.
The 30-page packet highlights problems with some of the evidence and describes how aspects of Anthony's case do not fit the state criteria for the death penalty -- a sentence reserved for the worst of the worst homicides.

named Lenamon that left Casey Anthony's legal defense team. The publication
