As we wait to learn what charge KK is going to plead guilty to, I have been wondering about the similarity to a get away driver that is involved in a murder.

So maybe one key thing is if she arrived on the day of the murder or not and whether she was anywhere near KB's house while PF went inside.

At what point is someone considered part of the murder itself or just an accessory after the fact. Seems there is a fine line there.

The timing of when she got to Colorado, who she was with, and whether she went to KB's house will be important to the type of charges I would think.

I googled and found other cases where a getaway driver has been charged with a murder charge even though they never left their car.

Like this example case

"....charged with first-degree murder and was denied bond during a bail hearing Thursday afternoon......Prosecutors said the woman drove two passengers in her white 2017 Dodge Journey to the scene of shooting in the South Austin neighborhood at about 7:30 a.m. April 29, but stayed inside the SUV while the fatal shooting occurred near the 4800 block of West Monroe Street, prosecutors said.."

My apologies. I knew they went to KB's place. Need to clarify that it was the SECOND time. THEN, LE went again on the eve of the 19th/20th after the visit to the dump. Said they collected some evidence/things of that nature at the dump. Went back to KB's. Large pieces of evidence removal began after THAT trip.

IMO, he didn't get out of the truck to avoid media. People TOLD KRDO news. LE were tipped off by someone at the dump remembering him there.
He may have made a trip to the dump on Monday after Thanksgiving Day, he had at least 6 working days to make dump runs before KB was reported missing. 6 days that no one was focused on him IMO

I am glad media has her face everywhere. I am hoping she is embarrassed and ashamed for what she did to KB, KB’s family, and her own family. I believe she is a huge part of this. JMO.
 
I am still wondering what would compel the DA to give such a plea deal that they are willing to overlook a murder charge and reduce the charges down to tampering with evidence? Perhaps one of our helpful attorneys could shed some light?
My assumption would be they don't have a murder charge for her - not that they are overlooking one. I would think if she had been present, or otherwise involved enough to be charged with murder, that would plead down to manslaughter, or some other related charge.
 
Maybe Ex-Inlaws spilled the beans. If they start talking we might get a bucket full of nails.
I don't understand why the local news is blurring out KK's face on the all of the new segments?
Because it's now a sealed case. The public should remember to forget all about the last six weeks of "Getting To Know You, Getting To Know All About You." When standing in the checkout line at WalMart, please ignore the tabloid rack. IMO

On or about November 22, 2018, PATRICK FRAZEE unlawfully and feloniously, acting alone or with one or more persons, committed or attempted to commit Robbery and, in the course of or in furtherance of that crime, or in the immediate flight therefrom, the death of Kelsey Berreth, a person, other than one of the participants, was cause by anyone.

Between and including September 1, 2018 and November 1, 2018, PATRICK FRAZEE unlawfully and feloniously commanded, induced, entered, or otherwise attempted to persuade another person to commit the felony of murder in the first degree, with intent to promote or facilitate the commission of that crime and under circumstances strongly corroborative of that intent.​

My assumption would be they don't have a murder charge for her - not that they are overlooking one. I would think if she had been present, or otherwise involved enough to be charged with murder, that would plead down to manslaughter, or some other related charge.

I hate to even say it, but if KK gets this deal but her testimony puts PF away and that keeps him AWAY FROM BABY K for LIFE, it's worth it. The poor baby needs to be nowhere near him.

And I hope that when all is said and done and PF is in prison for life, that the Berreths re-file the civil suit of behalf of Baby K when the timing is right as well as a civil suit directed towards KK, the BFF, and the lawyers who knew so much before poor KB was killed.

Everyone who knew ALLOT and could have prevented this senseless tragedy by raising a flag, notifying authorities, making Kelsey aware, ANYTHING was better than NOTHING. smh all just moo of course.

I am sure I am not alone in my confusion about and impatience with learning more details in regards to KK’s charge of evidence tampering/destruction on November 24 and the pings/texts on November 25. Was KK not the one who took KB’s phone to ID? Has LE dropped charges on her actions on 11/25 or will the tampering/destruction charge of 11/24 cover those actions? I am fairly new to WS, so forgive my lack of better honed sleuthing skills.
 
I actually think the evidence in this case will be more direct evidence such as eye witness and direct statement of witnesses with PF of his intent which is often more convincing than circumstantial evidence of physical evidence even DNA which is circumstantial, just my take based on what we have heard so far.
We'd have to check with one of our lawyers, but I think jurors like witnesses. AND they want motive AND they want the story line of exactly what happened. The DA in the Watts case (also CO) said you're not going to get the complete truth out of the perp, referring to Watts. And I'm sure it's frequently the case (that the perp isn't going to give you the why or how). Jurors want a lot. Maybe too much...
Now OH serial killer Shawn Grate recently seemed eager to give details, but I think the DA said even that was probably not all true...

KK has something in common with every person who's participated in premeditated murder...She believes her needs, rights, desires, feelings, etc. are more important than anyone else's.

KK was fearful? I'd love to ask her what about KB's fears? KK put herself first. And now that same self-serving trait she shares with others like her is benefiting the prosecution. She's looking out for herself and giving them everything they need to nail PF. So I guess there's the silver lining. Ugh.

I agree completely! Unfortunately, I think KK’s plea is self-serving, rather than out of remorse and compassion for Kelsey’s family and baby K. I believe anyone who could be solicited for murder and not report it, is not only NOT fearful, but is evil. At any point in this preplanning process, she could have acted to prevent Kelsey’s murder. I don’t think she gives a hoot about helping LE ... it’s all about helping herself ... what a selfish person she is! All IMHO of course ...
 
Whew, finally caught up. Several posters are saying this, too.

Nov 24 was the Saturday when it is believed KKL was at the Sonic in WP. But it is also believed per the R's interviews that KKL took the phone to ID and sent the texts.

I am going to posit that this charge is the limit of CO charges, or at least the limit to that specific date 11/24, when she was within the state of CO and committed a specific crime. I think she left CO on the evening if 11/24.

IMO that leaves the door open for federal crimes committed across state lines and perhaps any crime committed in Idaho on 11/25 or after. The deals would have to be separate for CO, ID and Feds.

So the CO charges may be a freebie, with the DA knowing KKL will go down for federal wire fraud or other communications charges, or transporting evidence across state lines.

I love the way you think! How great would that be if federal charges could be brought against KK ... we can only hope! I would love to see additional charges brought against her if she was involved as much as I believe she was. Of course, there’s always a chance on Friday that we may hear additional Colorado charges.
 
As of yet, KK is just facing CO charges correct? Wouldn't the transport over state lines become federal charges and/or ID charges? So this may not be all we see in the end.

For as much as everyone dislikes the TV interview couple, that was by now obviously approved by FBI since they shut down further interviews. So I'm giving them a pass because I figure it was highly edited on what was allowed.

My guess is KK was fearful that KB was stealing her man. MOO
