Should Norm Pattis Have to Return $250,000 From Fotis Dulos? Attorney Retainers Under Scrutiny Amid Lawsuit | Connecticut Law Tribune

If you can't get this article, go to CT Law Tribune Twitter--can get it from there. Lawyers who weighed in didn't really consider the issue of the civil case against Dulos at the time the $250,000 retainer went to NP and that he claimed to be insolvent, nor that it wasn't the retainer given at the beginning of the representation--when Pattis said in the WFSB interview that "Mr. Green is in the house."

Thanks for the link. And big thanks for access via twitter!

There would be no reason for the lawyers to consider the civil case because Pattis did not represent FD here. It's not Pattis area of expertise. Fotis attorney for the civil matter was William Murray.

Also, my post was not about whether or not Pattis has merit for keeping the retainer (i.e., the article), but in response to whether HF's Estate had standing to sue Pattis. I think it does.

If the courts determine Pattis is not due the retainer, HF Estate, a creditor, demands Pattis return the funds to his client c/o Dulos Estate, and HF Estate wants to be first in line to collect their judgment as awarded to them in their civil suit.

I, too, think HF's estate has standing to sue NP. What I meant was that the lawyers who weighed in about the retainer didn't consider that at the time NP took the $250,000 from FD he knew the civil court would probably conclude FD was indebted to the HF trust.

NP actually did file an appearance in the Farber civil case, to work on the post-trial brief with Murray. And he attended the trial. So he was well-informed about the civil case.

I second the thanks for the Twitter access hint!

I also remember NP putting his face in his hands when the forensic accountant testified that FD and MT were traveling together as early as 2015. I think CTgrammy got it right about the possible conversation between NP and Attorney Weinstein in which NP responds, "so sue me" when asked about the large retainer. I wonder if the third party payments involved his private investigator. Hmmmmm....

Following by Greek trend in reading (relying on Google translate), I found this wonderful summation from another source. It explains MT's role in the FD-JFD relatonship:

"It looks like a Hollywood drama. A child who grows up in a prosperous loving family, beautiful, successful, knows a beautiful girl falls in love with her make five children live a dream life together but a third person enters their life and separates them.

And the drama does not end here. The couple is now separated by an abyss and one day the wife and mother of his children mysteriously disappear. Authorities believe it is a crime and even with the perpetrator himself but he stubbornly denies it. Courts, guarantees, and the eyes are on the charming middle-aged man who, however, cannot withstand all this pressure and ends his life in a dramatic way."

Yes, MT was the impetus for the unfolding of the tragedy that involves the disappearance and presumed death of JFD.

Jennifer Dulos' mother is now suing the state's chief court administrator for keeping the courts closed.
Gloria Farber holds the mortgage on the Farmington home that Fotis Dulos and Jennifer once shared and she wants to foreclose and sell the Jefferson Crossing property but because of Covid-19 the courts are closed and judges can't render a decision.
Since Fotis' death Farber has been paying for maintenance and other expenses and wants to recover some that money

Hear, hear, Mrs. Farber!

If MT can petition every court in the area to whine about her ankle monitor then please let Mrs. Farber hold the court responsible for delaying the foreclosure and sale of Jefferson Crossing.

Those of us awaiting justice for Tylee & JJ are watching court via ZOOM:

Found Deceased - ID - Joshua Vallow, 7, & Tylee Ryan, 16, Rexburg, Sept 2019 *Arrests* #52

Nice & secure, the inmates stay in jail for their arraignment, hearings, etc. Sure, this would not be an ideal format for a jury trial but this will work to trim the growing backlog of cases.

Even my county here in Ozarkstan uses video hearings.

Come on, Connecticut, the power is back on, modernize for hearings!

Norm Pattis Sued For Fraudulent Conveyance - LARRY NOODLES

Here’s Larry Noodles’ take on Pattis’ big retainer fee. I disagree with Larry on one detail: Judge Noble didn’t deny Weinstein’s subpoena of Norm on “attorney-client privilege,” but on grounds that it wouldn’t lead to any relevant evidence. Noble had already ruled that FD had to testify about how he was paying Pattis, rejecting NP’s objection re attorney-client privilege, so Noble couldn’t use Norm’s ACP argument to quash the subpoena and had to find other grounds to grant NP’s motion to quash.

“I’m not looking for a fight, I just want this poor lady to get some closure,” Weinstein said. “She is taking care of five children and she has to provide for them.”
The property is racking up tax, insurance and utility bills for the Fotis Dulos estate, which is insolvent, “and doesn’t have the financial wherewithal to pay any of the ongoing expenses,” Weinstein said.
At least one person has expressed interest in purchasing the home, which would allow Farber to recoup some money, but the buyer’s attorney advised his client to look elsewhere “because of the uncertainty as to the status of the foreclosure,” Weinstein said....
The estate of Fotis Dulos recently asked a Farmington Probate Court judge to declare Jennifer Dulos dead so the $194,000 from an individual retirement account could be used to pay creditors.

The estate is unable to access the IRA unless it is determined that Jennifer Dulos predeceased her estranged husband because Fotis Dulos did not name a beneficiary, probate documents said. A probate judge is expected to hold a hearing in the coming weeks before making a decision...

No kidding...Due to the "no foreclosure" order, courts cannot foreclose properties in which there are no tenants or, in FD's case, the tenant is dead. One size fits all, does not work all the time. This is absurd, IMO....MOO

The house is currently appraised at $1.9 million. The cumulative debt including original loan, interest, taxes, association fees, etc. was $2.4 million as of June 29, 2020.

Look at page 3 in the link below. There's a summary of costs of maintaining 4JX. Interest on the loan since it was taken over by GF is over $100K.

It makes a good point and one beyond this: Why throughout all of this have the people (FD, MT, KM) who schemed in the murder of JD been granted all kinds of breaks and things that affect the five orphaned kids seem ignored by all the people who want money that originated with GF? I’m not at all complaining about LE or the good lawyers and judges who have worked so hard for justice for JD; I’m talking about the long list of people who took money and now want more that, again, was Farber money. FD didn’t make money. He slid it around maybe but where did it originate? Who paid MT? Who kept FORE going? The audacity here is stunning. MOO.

Absolutely right on. And you know that he didn’t make money, but as you said, only slid it around, because he had nothing on e Jennifer left. I loved the wording regarding Fd’s paying of the mortgage “he stopped paying the mortgage when she left.” He never stopped paying it, because he never started paying it. Jennifer paid for everything he had, and then paid with her life, when all that was left of value to him was the childrens’ trusts, and possibly a life insurance payoff, since they were not yet divorced. I don’t think we know about the possibility of life insurance, naming him as beneficiary or even the children, but she had a value to him in death-at least with the kids’ Farber family trusts that he thought he would control. Everything originated with the Farbers-all of those people do have some nerve, as you say.

I am truly amazed at the Audacity of NP and Crew. I did Not think they could stoop any lower.

Any Self Respecting Attorney would have ALREADY returned the balance of the $250,000, other monies due, and a detailed expenditure report.

Any Self Respecting Attorney would have said, 'Yes, we will provide detailed expenditures and return any monies remaining.'

Any Self Respecting Attorney would NOT be trying to Keep/Hide the money.

Which leads me to believe that something Very Fishy IS going on.

Instead, what we see is a Plum Bag who ATTACKS an 80+ year old grandmother, that is only protecting the future of her 5 orphaned grandchildren.

How, EXACTLY, is an 80+ year old grandmother responsible for Fd's demise?

Fd committed suicide because Fd MURDERED his estranged wife and it was catching up to him. Fd's reasoning, in His suicide note, for committing suicide was that he could not spend another night in jail (for Murdering his wife). It had absolutely Nothing to do with Dr. GF.

NP's thinking on this matter is Identical to Fd's. They both thought and think that Dr. GF should overlook the fact that a THEFT has taken place.

I can say with a tremendous amount of certainty that the request by the Estate was made in private and NP may have used these exact words in response - 'So? Sue Me.'

Can anyone say the word - Entitlement in regards to these plum bags?

Why shouldn't Dr. GF go after All monies Due to the 5 CHILDREN?

Definitely NOT due to NP and Company. Definitely NOT due to Rena and the Greek Family. Definitely NOT due to AC.

The Monies Belong to the 5 Children.

Give the Children THEIR Monies Back.

It is That Simple.

Shortly after Fd committed suicide, NP announced that he would be representing AC and the Greek family.

Hmm? I wonder if AC had to provide her own retainer or was Fd's retainer transferred to her?

Hmm? I wonder if the Greek family had to provide their own retainer or was Fd's retainer transferred to them?

Where Exactly did this $250,000 come from? Safe Deposit Box perhaps?

This money was paid to NP After the Murder charge in January of 2020, so I Highly Doubt it was part of the June 2019 Transfer from the 'Unknown' Greek Benefactor through Atty Phufas.

(Hmm? Perhaps the money did come from the mysterious Greek Benefactor. IF NP and Crew let the cat out of the bag and explain that the money from the Greek Benefactor, should be returned to the Greek Benefactor, we All would see whom this money originated from. Perhaps that is opening it's own can of worms that NP is trying to avoid?)

Message to NP and Crew:

Just because the defendant decided to commit suicide does NOT Give you the Right to KEEP the Money.

You Might get a bit of respect from me IF you behaved in a manner consistent with a Respectable member of the Court and politely say 'Yes, we will be happy to make an accounting of the monies involved in this case and we will be happy to return any portion remaining.'

Don't forget NP and Crew, you are Not allowed to use any of the monies in question for Your Own Defense.

You Personally and Your Practice are the defendants, so you must defend yourself out of Your Own Pocket.

IMO.

Have not heard a word from him recently in the vanessa Morales case.... hmmm.

Jennifer Dulos’ family sues CT judge over court delays due to COVID
Why is scheduling a CT court hearing so attorneys (Murray, Hug) can get paid top priority? The wheels of probate court are swift compared with criminal court. Holding a trial and obtaining convictions against accomplices MT and KM, for aiding and abetting a carefully planned murder, can move slow as molasses, fraught with no body, no conviction defenses but lo and behold we get an attorney claiming JFd is in pieces in order to get paid pronto. The probate court hearing declaring Jennifer Farber Dulos deceased for the purposes of liquidating the IRA to pay attorneys as creditors of FD's estate and probate administration fees is the first order of business. Figuring out how Attorney Hug has come to his alarming statement without benefit of a full criminal trial is astonishing. For the family, this is anguish, without getting any justice for the victim in criminal court.

How about putting MT, an accomplice to murder behind bars, before she disappears on a plane to South America? Before any attorney takes another bite out of the Estate(s), the beneficiaries of which are the five children of the victim.

And then, in the whole system of court priorities, how about prosecuting FD's bail fraud upon the court (remember how an insurance dept whistleblower found no unencumbered security, dude was insolvent, NP knew and continued to associate himself with a fraudulent application for bail). Fd was broke. All this time. As for the $250k given to NP from...well, never mind. Let's just take the IRA money from the children because it is less damaging to the CT justice system than disbarring NP and depriving society all the great defenses of... Hmmm. Recall, NP wanted the IRA money as collateral, for his fees from the very first bail hearing.

Not a peep from the CT Grievance Committee. Production of itemized legal invoices is standard practice in federal courts. Shouldn't be that hard NP to itemize hourly rate times hours billed for work performed. Hug, Murray and any other attorney gathered at the trough should produce itemized bills too. Oink. I mean MOO.
