1/19/22 Update: Virtual hearing date’s been set (1/24/22) for the court to hear Schoenhorn’s demand to see all of the files in KM’s domestic violence case, to see if he got a deal in exchange for the information he gave the State. Schoenhorn motions regarding affidavits & police searches on Tronconis’ home & possession. Hearing set on 2/15/22.
1/24/22 Update: No ruling by Superior Court Judge Hope Seeley today. Following arguments, she asked Hartford State’s Attorney Sharmese Walcott to reply “paragraph by paragraph” to Attorney Jon Schoenhorn’s motion on whether she has certain information and/or why it shouldn’t be turned over. Of note today: Schoenhorn dropping during arguments that during Mawhinney’s interview with State police, he made multiple misogynistic & racist comments. He says with his client being a Hispanic woman, those comments go to motive. State's attorney Sharmese Walcott told Superior Court Judge Hope Seeley that she felt Schoenhorn should have filed his motion in Stamford Superior Court where the conspiracy to commit murder cases are proceeding. But Walcott conceded that by law, Schoenhorn had a right to any documents or indication that a deal had been struck in her cases to gain Mawhinney’s cooperation in the case against Troconis. Next pretrial hearing re police searches) on 2/15/22.
1/30/22: Attorney Jon Schoenhorn had filed a writ of mandamus in Superior Court in April to compel a Norwalk Judicial District court reporter to turn over the transcripts of a two-day hearing in the Dulos divorce. If Superior Court Judge David Sheridan granted the writ, Judicial Branch court reporter Melodie Moss would have been required to provide Schoenhorn with the transcripts. Instead, Judge Sheriden has dismissed the case, effectively denying Schoenhorn’s writ by siding with the Office of Attorney General William Tong that it was filed in the wrong jurisdiction. “This court lacks jurisdiction to order a mandamus because it would require this court to invalidate a sealing order issued by another Superior Court judge in another case,” Sheriden said.
2/4/22 Update: Schoenhorn files an appeal to see transcripts. 2/14/22 Update: Pretrial hearing was rescheduled on 3/29/22. 2/23/22 Update: Schoenhorn wants all arrest reports & evidence in the domestic violence cases, along with any other evidence indicating whether Mawhinney struck a deal to testify against his client. On Jan. 24, 2022, Judge Seeley told Walcott she had a month to provide the court with the information Schoenhorn was seeking. Schoenhorn said Tuesday, 2/18/22 that so far no court date to discuss the information has been set but he believes Walcott has until next week to provide the data.
3/24/22: Consolidate fifth Motion to Compel disclosure & for sanctions for non-compliance with discovery. Troconis’ attorney has filed a 5th motion asking a judge to compel the state to turn over discovery that he’s been requesting. That includes reports, documents, photographs & analysis (primarily biology & DNA) from the state lab. In a second motion filed Thursday, Schoenhorn again asked the court to remove the GPS device that his client is required to wear. He hopes to argue the motions at his client’s next hearing on Tuesday, 3/29/22 in sSate Superior Court in Stamford.
3/25/22: Superior Court Judge Gary White will not drop some charges against Troconis. Attorney Jon Schoenhorn, who represents Troconis, sought to have those additional charges dismissed, in part due to errors in the arrest warrant. Among those errors, state police Detective John Kimball wrote that Troconis was seen on surveillance video leaning out of a pickup truck, either placing something on the ground or picking something up. Stamford Superior Court Judge Gary White ruled that the errors do not appear to be intentional or reckless but were "simply inadvertent." "The court finds that [Troconis] fails to establish that Detective Kimball's misstatement was intentional or reckless, as opposed to simply inadvertent," White wrote in his ruling. "Furthermore, assuming arguendo that the defendant had properly established that this false statement was intentionally or recklessly included in the affidavit, whether the Raptor made thirty—as opposed to three—stops along Albany Avenue is wholly immaterial to a finding of probable cause. As the state persuasively notes, no issuing magistrate would conclude that thirty stops to dispose of allegedly bloody evidence is sufficient to establish probable cause, whereas three—or even one—is not." Motion to dismiss charges-denied.
*Kent D. Mawhinney (54/now 56) – Murder: Judge John F. Blawie put the case on the trial docket but with no date yet. There is no future court date at the moment, but that will only happen if a new motion is filed or new information arises. Court hearing re awaiting disposition. 2/23/22: Plead guilty to a charge of violating a protective order that stemmed from an incident involving his ex-wife. Sentencing for violation on 4/20/22 & Review hearing for assault charge.
*Fotis Dulos (52) – Committed suicide on 1/28/20 & declared dead at 5:32pm on 1/30/20. 3/3/20: Charges dismissed. The case against Dulos will be officially dismissed in about a year, unless the state decides to reopen it. 1/17/22: After debt, no money left in Dulos estate for children. While Fotis Dulos’ estate has $395,687 in assets, it owes $548,280.75 in expenses, according to Farmington Probate Court records. Attorney Christopher Hug will be paid $189,525 for settling the estate & attorney Paul Knierim, who represented Hug, will receive $98,326, court documents show."
