*Status Hearing (@ 1pm MT) - CO - Dylan Nicholas Redwine (13) (Nov. 19, 2012, Broomfield; found June 27, 2013 in Middle Mtn Road, 8 miles from Redwine’s home & Nov. 1, 2015 his skull was found 1 ½ miles away) - *Mark Allen Redwine (55), "father" indicted (6-20-17) of 2nd degree murder & child abuse resulting in death. Plead not guilty. $750K bond.

7/8/19: Prosecutors filed several motions late last month, some routine, others tailored to the unique circumstances of the Redwine case. One motion seeks to introduce statements Dylan made to family & friends prior to his death. The prosecution seeks to use statements Dylan made in the days, weeks & months before his death. The statements include conversations about his relationship with his father that led to tensions before his trip, the compromising photographs he observed & conversations regarding his thoughts on the visit itself. Included among the statements are conversations Dylan had with an attorney & a judge about the court-ordered visit, the documents say. Prosecutors also plan to use phone calls & text messages from Dylan’s phone. Another motion filed by prosecutors seeks to allow the jury to view the locations on Middle Mountain where Dylan’s remains were found.
7/17/19 Update: Judge allows evidence from dogs in Redwine trial. Status hearing on 7/25.

7/21/19 Update: A Colorado public defender John Moran assigned to the murder case against Mark Redwine was arrested Sunday on suspicion of misdemeanor assault and domestic violence. Next hearing for Moran on 8/26.

7/21/19 Update: A Colorado public defender John Moran assigned to the murder case against Mark Redwine was arrested Sunday on suspicion of misdemeanor assault and domestic violence. Next hearing for Moran 8/26.
7/25/19 Update: Status hearing held. Next Status hearing on 8/5, hearing on 8/8, status hearing on 8/13, pretrial hearing on 9/5, trial set to begin 9/19 to 10/18/19.
 
Judge to decide this week whether to delay Mark Redwine trial

The trial of Mark Redwine is up in the air.

But the trial was complicated last month after one of Redwine’s two public defenders, John Moran, was arrested on suspicion of misdemeanor assault and domestic violence.

Redwine’s other public defender, Justin Bogan, said during a court hearing Monday that Moran is on approved leave and could be gone until at least October. As a result, Bogan asked Judge Jeffery Wilson to delay the trial so a new attorney could be appointed to the case.

Moran was not in attendance Monday.

Bogan estimated it would take a new attorney six to nine months to get caught up on the case and be ready for trial.

As of Monday, neither Bogan nor Moran had entered an official motion for Moran to withdraw, which ultimately has to be approved by Judge Wilson.

Wilson asked Redwine if he had enough information to decide to waive his right to a speedy trial and if he had any objections if Moran were to withdraw. Redwine said he did not, and that he was only “briefly advised” of the situation.

After recess, Redwine, dressed in an orange jumpsuit and handcuffed, said he was willing to waive his right to a speedy trial and had no objections to Moran leaving the case.

(DA) Champagne offered two alternatives: keep Moran on the case and go to trial in early November after he gets back from leave, or approve a new attorney to the case and go to trial in November.

Champagne said he was concerned no official motion has been filed requesting Moran’s official withdrawal, as well as the fact Redwine was only briefly advised of the situation.
 
Well, if this goes to trial in November, it won't be of 2019. Maybe ... if the new attorney is some sort of a "quick study", November of 2020 would be more like it.

If this is "rushed" to trial (too late for that!), I can hear MR whining (after he is convicted) about the inadequate legal defense he received.

We've waited this long. Let's give 'em all the rope they need.

7/25/19 Update: Status hearing held. Next Status hearing on 8/5, hearing on 8/8, status hearing on 8/13, pretrial hearing on 9/5, trial set to begin 9/19 to 10/18/19. 8/5/19 Update: Still up in the air whether trial will start on 9/19 since his defense attorney was arrested. Redwine waived speedy trial. Hearing on 8/8 is cancelled. Next status hearing on 8/13 & will set new trial date. Pretrial hearing on 9/5, trial was set to begin 9/19 to moved 10/18/19, will probably be moved.
 
Well - this is strange - Redwine is no longer under LaPlata County court site. Comes up with "no results" ??
They didn't move him to another county did they?? Or his court hearing isn't for OVER 6 months??

Just checked vinelink and he's there now. I signed up for updates if he's moved anywhere. This state doesn't ask for your first born great grandchild's name etc...just email, text, phone or TTY #.

Judge sets trial date, appoints new defense lawyer in Redwine case


Mark Redwine is scheduled to stand trial next spring in a murder case linking the Vallecito man to the death of his 13-year-old son, Dylan, almost seven years ago.

Chief District Court Judge Jeffery Wilson postponed Redwine’s trial scheduled to begin Sept. 17 after public defender John Moran was arrested on suspicion of assault and domestic violence. The judge, in the order, also allowed Moran to withdraw from the case.

Moran represented Redwine for almost two years. He hasn’t appeared in Redwine’s defense since his arrest and hasn’t filed a motion with the court seeking permission for his withdrawal, according to court documents.

District Attorney Christian Champagne and public defender Justin Bogan agreed to schedule Redwine’s trial to April 2, 2020, for jury selection, with opening statements being made April 6.

Champagne said his office had hoped to schedule Redwine’s trial to begin sometime between Thanksgiving and Christmas, but the April date is the next best option.

Wilson said he’d schedule “some sort of non-appearance hearing” in two months to ensure attorneys are on track to start trial in April.

I just saw this, you have got to be freaking kidding me:

“Since the arrest, the attorney has failed to appear at two hearings, and the judge deemed him unable to properly represent Redwine.

It could be months before a new attorney is caught up on the case and ready for trial.”
