I am so relieved to hear of these arrests. I've been offline working on my girls' Grand Prix Derby Cars for their youth group race tonight. I needed to decompress, TBH.

Little Ahizya was totally on my mind and I broke down crying a few times, thinking that he should be enjoying such things himself. He won't ever able to again, as an innocent little boy, nor with his siblings, and it just breaks my heart over and over again.

I hope the investigation proceeds, and the DA throws the book at them. I feel there could be enough to justify Murder charges, but that's JMO.

May justice be harsh and swift.

I agree. I wonder if LE has the medical examiner's report yet. Maybe we'll find out from the chief's press conference in 15 minutes.

From the police chief's press conference:

Initially treated matter as both a missing child and an abduction. Abduction was added because Stepmom said the back door was ajar, her wallet with $160 cash was missing, and $3000 cash missing from the house.

Stepmom gave contradicting details while being questioned.

Ahizya was inside tied garbage bags in an 8 inch wide box. Garbage bags full of clothes were then placed on top of him in the box in an effort to conceal him.

Medical examiner determined Ahizya was not alive when he was placed in the box. How long he had been deceased is still part of the investigation for prosecution.

His body was bruised from top to bottom. Some of the bruises and injuries occurred over time, some were new.

The cause of death is blunt force trauma. Ahizya had damage to his pancreas and liver.

How much Dad knew is still part of the ongoing investigation for prosecution.

There is always the possibility of increasing charges as the investigation continues.

LE believes these are appropriate charges.

The chief was told there was no sign of emotion from neither Stepmom nor Dad when they were arrested.

They are both in custody.

I am so relieved that they were both arrested. I like the aggravated manslaughter charge for step-mom. I'm waiting to see what part dad may have played, as well as the two brothers and grandma the nurse.

I looked up the Florida statute for the most serious charge:

782.07 Manslaughter; aggravated manslaughter of an elderly person or disabled adult; aggravated manslaughter of a child; aggravated manslaughter of an officer, a firefighter, an emergency medical technician, or a paramedic.—
(1) The killing of a human being by the act, procurement, or culpable negligence of another, without lawful justification according to the provisions of chapter 776 and in cases in which such killing shall not be excusable homicide or murder, according to the provisions of this chapter, is manslaughter, a felony of the second degree, punishable as provided in s. 775.082, s.775.083, or s. 775.084.

(3) A person who causes the death of any person under the age of 18 by culpable negligence under s. 827.03(2)(b) commits aggravated manslaughter of a child, a felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

However, the mandatory sentencing guidelines may make the current charges a factor in what they will face, even if it isn't elevated (based in this) :

Defendant is a three time violent felony offender if s/he commits a violent felony within five (5) years of the date of conviction or release from sanction or while serving a sentence for any one of the enumerated felonies and who has two prior felony convictions in two separate criminal incidents. Offenders shall receive a mandatory sentence of 5, 15, 30 years or life, depending on degree of felony.

Kimi, I don't think that AO will be considered a repeat felony offender for sentencing purposes since she has been charged with all three counts simultaneously.

FWIW, I remeber Billy Bob Thorton's daughter was convicted of aggravated manslaughter of a child a few years ago in Orlando. She got 20 years.

However, @oraliaortega did state the possibility exists that charges could be elevated. I admit I hope this will be the case. The thought of either of these toe out on bail makes me literally ill. :sick:

If you will recall, little CR's forensic interview is scheduled for tomorrow. My thoughts and prayers are with him tonight. I hope his aunt is doing the right thing. No one should be trying to influence him in any way. The trauma he has experienced in his young life has already been unimaginable. This interview will be so very difficult for him, as he has experienced the violent and senseless loss of his brother. To be so young, and have so much weight on your shoulders :sigh: In all honesty, if this was being handled appropriately, he shouldn't be too aware of how much is riding on this, because the adults around him shouldn't be discussing the case with him in advance of him meeting with the forensic interviewer. My training tells me they should know better. My HinkyMeter is telling me something else. I hope I'm wrong. (Strictly :moo: )

We don't know if he has also been abused, and can only wonder what his life has been like, and what his future holds. His entire world has been completely and utterly shattered.

I wish him all the strength and support he will need, knowing it will never be enough. He and his siblings are the truest victims in all of this. This case is the epitome of missed opportunities, pain, suffering, selfishness, senseless loss, and heartbreak.

Signs unheeded before Hollywood boy’s cruel death | Miami Herald Miami Herald

The purple bruises on either side of Ahizya Osceola’s jaw were telltale signs: Someone, a child abuse expert said, had grabbed the 3-year-old’s face forcefully enough to leave fingerprints.

But Ahizya’s bruised jaw was only a small part of what the boy faced. The state’s abuse hotline received a report on April 21, 2014, that he had scratches on both sides of his neck, and a “large bruise and bump” on his forehead. Two weeks earlier, teachers saw a “pinch mark” on one ear, a bruise behind the other and two bruises on his face.

Two weeks before that, Ahizya had a busted lip, another scratch on his face, a bruise on his shoulder blade and pinches and bruises on his ears. Ahizya told his preschool teacher that “daddy” hit him with a belt. His father, Nelson Osceola, instead described an active and clumsy toddler who frequently injured himself in run-ins with furniture, walls, a toilet and other children during an Easter party.

Broward County child protection investigators discounted the possibility of abuse and left him with a father who had a lengthy rap sheet — including aggravated assault charges — and a history of alleged drug use. The Broward Sheriff’s Office had one last chance to intervene in December, when the state’s abuse hotline was told that Ahizya’s stepmother had beaten his bottom, and he had bruises and abrasions on his face. But that call, too, went unheeded.

The report added: “The father smokes marijuana daily,” and Ahizya “smells like smoke” when he’s around him. “Whenever the mother drops Ahizya to the father’s house, he has unexplained bruises and appears to be lighter.”

The state’s Child Protection Team, which examines children for signs of abuse, concluded that Ahizya’s injuries were consistent with the family’s explanation that the toddler had hit his head on a bunk bed. Cypress signed a “safety plan” agreeing to accept better-parenting services from the tribe.

When Ahizya was observed by an investigator, he sported a “red mark on the side of his left eye.”

But the reports kept coming (after 1/21/14). The next allegation arrived on April 21, 2014. Though the source of the complaint is confidential, the report makes clear that Ahizya’s preschool teachers were concerned that he kept arriving at the Nob Hill Academy covered in bruises. Ahizya, the report said, “has been observed with several bruises on a weekly basis.”

Ahizya told his teacher that his dad hit him with a belt. He later told an investigator he fell in his room.

Osceola said the boy “hit his head” at an Easter party. And he had explanations for all the other bruises, as well: Ahizya bumped his head on a bed at home. He fell in the bathtub. He fell off a toilet. He “falls all the time [and] sometimes does not pay attention to where he is walking, and will walk into the table, the counter tops and other things.”

“The father also advised the child will bruise easily as his immune system is low,” a report said.

The Child Protection Team found no evidence that most of the child’s extensive bruising resulted from child abuse. But the fingerprints on Ahizya’s jaw were worrisome, a report said, and “positive for physical abuse.” Someone, a report said, had grabbed the boy’s face with “enough force” to cause oval-shaped bruises.

The investigation was closed in June 2014 when Osceola signed a “safety plan” pledging to keep Ahizya safe, and a counselor from the tribe was assigned to monitor his compliance. The safety plan itself was not included in the documents provided to reporters Wednesday. Generally, they are written promises to avoid drugs, violence or other behaviors that are dangerous to children. Lawmakers essentially banned “promissory note” safety plans last spring as part of an overhaul of child welfare laws.

On Dec. 7, DCF received one last report, once again alleging physical abuse. Cypress picked up her son for a visit and noticed a bruise on his cheek. The boy’s bottom was hurt, too, and he said his “mommy” — referring to Analiz Osceola — was responsible for his sore bottom. When Cypress asked Osceola about the bruising, he said, once again, that the little boy had fallen.

“There is concern that Ahizya is being abused at the father’s house,” the report said. “There is concern that anytime something happens to Ahizya, the father will say that he has fallen.”

Nelson and Analiz Osceola denied harming the boy, and the investigation was closed, once again, without findings of physical abuse.

Kenneth Tommie, the toddler’s maternal grandfather, said he did not understand the state’s decision not to act on the December report.

Inexcusable handling of this case by DCF - IMHO. There must be a full internal investigation of the "handling" (or lack thereof) of these complaints. :furious:

Ahizya shouldn't have had to die for people to actually pay attention! No one can help him now! :tears:

He's already out. :furious:

When I checked late last night his status stated "surety bond pending." This morning he's no longer listed in the jail system.

All the bonds listed are the standard bonds for the crimes. This morning (or afternoon), they will appear in front of Judge Hurley in Broward Bond Court. He can raise or lower the bonds, depending on how he views the serious of the crime.

Any person who has been charged with a life possibility can be held under no bond if the judge believes there is proof BEYOND a reasonable doubt that the person committed the crime. I expect her bond will be revoked. I don't know about his bond.

An interesting fact is that, should a person is able to post bond prior to being seen in bond court, there can be no changes. I don't see this happening for her. It's possible for him. And it seems he did.

Tune in to Broward Bond Court this morning and/or afternoon. Based on the seriousness of the crime, they may be presented early, but, it could be postponed if step-mom hasn't gotten a lawyer yet.

CR's interview will be very important. Like when the last time he saw or spoke to Ahizya was, or if he heard anything unusual in the middle of the night (early morning) on the 19th. I'm still having a very hard time with the whole grunting/CPR/pedialyte/induced vomiting/back in bed details Stepmom gave. How could all that occur at 4am in a house full of adults and children, but no one else got up to help or see what was going on? My suspicion is it didn't. And if it didn't, that would mean Ahizya was killed earlier, which means Dad lied about seeing him in bed sleeping at 8:00. MOO

I hope CR feels safe and protected and that he finds the strength to tell investigators everything he knows.
