I too, do not post often-but this crime has really upset me. Probably because it was all preventable.
First of all, this convicted felon should not have been anywhere without a monitoring bracelet.
What the hell is that about?
Secondly. This is a victim friendly site-so I will bite my lip a bit but not too much.
I am floored that this Mother willingly put herself and her 3 children in such a dangerous position with this strange man.
I would like to know if she had drugs or alcohol in her system.
We will probably never find out.
But I personally can not believe that a stone cold sober woman would allow herself to put herself and her children in such danger for over 4 hours.
Additionally, 40 minutes is a damn long time to report your child missing in this situation.
If....one is clear and sober.
I want to see the Wall mart videos big time.
If the video shows that the mother was stoned then she needs to be charged with every law that can be thrown at her.
I wonder what she and Smith were really doing in that van for hours on end? Drinking? Smoking pot?
I do NOT see this mother as an innocent victim in any of this.

It's still been bugging me why Smith is considered a sexual offender, not a sexual predator. Good summary of Florida's definitions and the timing of their introduction can be found at the Broward County Sheriff's Office site:
http://www.sheriff.org/faqs/displayfaq.cfm?id=54934ef5-c69b-4771-9035-cd5d75b5554d

According to Florida statutes, a sexual offender is a person convicted of (or who has pled no contest or guilty to) a sex offense involving a minor and who is released on or after October 1, 1997 from the sanction (e.g., fine, incarceration, probation, etc.) imposed as a result of the offense. Offenses include, but aren’t limited to, child *advertiser censored*, sexual performance by a child under 18 and procuring a person under 18 for purposes of prostitution. Consult the Florida statutes for a complete listing of offenses.

A predator designation requires that a person be convicted of a first-degree felony sex crime, or two second-degree felony sex crimes (with offenses, convictions or release from court sanctions occurring within 10 years) and which occurred after October 1, 1993. In addition, the court must issue a written order finding for predator status.

From this is sounds like his 1977 convictions, and perhaps even his 1993 one might not have been able to factor into the designation, though his behavior over the longer time period is exactly what that designation's intended to protect society from. The 2009 arrest, what were the convictions that he actually served time under?

Going back over the posts about the McDonalds...

Momrids6, I believe you've been in the actual Walmart in question, correct? Or have I misread somewhere along the way? I mean, like others have pointed out, there are a number of layouts for Walmarts. Heck, I live in Wallyworldland, and no two are alike up here.

BUT

Your descriptions are of the actual Walmart where Cherish and her mother and siblings were that night, right? Just wanting to clarify! :)

Yes- I shop occasionally at this Walmart- as it is an easy store to get back on the highway from on my way out of that area.

Please notice the photo below. The time stamp is 9:34 pm. If you enlarge this photo, there is another still shot. RP is in the shoe dept.

In fact, I would imagine after spending approx 90 minutes in this small walmart, she had many many opportunities to see Mc Donalds closing and closed.

It is fact, proved by these still shots, that she was in more than one department. And, as mentioned in MSM- the perp asked her if she wanted a dress, which means she was in, or was going to the woman's dept also within the time frame she was there.

Smith, whose registered address is 2495 Segovia Ave., was last arrested in 2009 where he was accused of impersonating a Department of Children and Services officer and making obscene and threatening calls to a 9-year-old girl.

The arrest report said he had called a 12-year-old boy on his cellphone asking to speak to his sister, whom he knew by name. The boy gave him his mother's cellphone. The man called her saying he was with DCF conducting an investigation regarding her daughter.

The girl was visiting grandparents, so he called them and spoke with the daughter for about 20 minutes. He had asked questions about whether she wore a bra and what her privates looked like. Then he told the grandmother the child's father and grandfather were suspected of molesting her and that if she told anyone of their conversation she could go to jail.

He demanded she bring the girl to a McDonald's so he could examine her. She did so, but went inside instead of waiting in the parking lot as instructed. The man did not appear. The mother later gave police the man's phone number and traced it to Smith.

He also served prison time for attempted kidnapping and lewd and lascivious assault on children. The first time he attempted to lure a 13-year-old girl into his van and chased her as she ran away. The second time involved Smith trying to lure two girls into his van with pornographic magazines, according to Times-Union archives.

So - this guy is a convicted pedo, but is permitted to live near a --school-- because he's listed as a "sex offender" rather than a "predator"? WTH.

If the behaviour in the quote above is not distinctly "predatory" than I'm a monkey's Auntie. Whoever allowed this monster to live in proximity to a school full of kids needs a swift kick in the pants and a different job.

I'm an Aussie, too. While I do think this is a great country and we're pretty safe and well off in most ways, we do have a poor way of dealing with repeat offenders of the very worst kind (see the Jill Meagher case.. ) and so I am definitely not the trusting type when it comes to my daughter. I am not a helicopter parent, as such, but I don't put my child in the way of danger, either - and it's out there, in abundance, thanks to the courts and the laws that force the courts to let these monsters walk free, time and again.

It was a comment on a news page and one of those comment sections that you can't post anonymously, so it links to the woman's fb page. Then her sister-in-law, who she was shopping with, comments a few posts later and confirms.

Am I allowed to link?

I believe that you are allowed to post links to mainstream media websites and then tell people to read the comments.

I see them in the shoe department on the second shot. Thanks for pointing that out. I barely gave that second photo a glance.

Speaking of these photos...can anyone tell what is in the shopping cart at this point?

Why did only Cherish go with Smith to McDonald's? Were the other little kids completely uninterested?

I think it's more like he was completely uninterested in them. :(

He only wanted her to go, and the mother let her at his request. That's what I think. Or, she knew they weren't getting food, at all. I don't know...

After being inside the store for a couple hours, the man then offered to buy some hamburgers," Michael Williams, director of the sheriff's investigations department told reporters.

"As he walked to the front of the store, he took our 8-year-old victim with him. They walked to the front of the Walmart toward the McDonald's. They did not stop at the McDonald's. They walked outside, got in his van and left the location."

According to Jacksonville.com, two other children, ages 4 and 5, were with the family and remained with the mother.

Police originally said Perriwinkle's mother, Rayne Perriwinkle, allowed Charish to go to the McDonald's with Smith but Ms. Perriwinkle denied the allegation.

Maybe the other kids were too young for his "preferred age range" (blerk, makes me sick to think about it).

Admittedly, I have not yet read every nuance of opinion and fact regarding the child's mother, and really prefer not to hang her out to dry for anything but a stupid choice just yet. She's lost her daughter, and it's partly her fault. I couldn't live with such guilt and pain, I really couldn't. Not excusing her obviously stupid choice here, but I'm also not going to go wack on her like she's a perp - unless there's proof she is one.

That said - this PREDATOR (I am severely irked at his "classification" if you can't tell, ha) has had many many years practise in preying on mothers and kids -- his MO in previous crimes shows he has no fear or shame in doing whatever he (inhumanly) can to get a child on thier own, and will do so in the most aggressive manner if he thinks it's necessary. He's a con-man, and clearly the cons have paid for him in the past (the ones that we can see, I dread to think how many there actually are..).

Again, not an excuse for the mother's choice here -- but the fact that this man is serial predatory child rapist and con-man might have factored into her making that choice somewhat, yannow? They DO pick their targets. They pick on the vulnerabilities they can see, in order to get what they really want, and can and do 'groom' whole families for months, even years, in order to get access to children.

Is this the "truth coming out, as it always does"?
