All this information about impulse control difficulties and Smiths compromised brain are offset for me by the cunning premeditated and patient way he went about taking control of Cherish. Sounds like he spent about 4 hours with the family , driving them, waiting in the store .planning the McDonalds trip . Hardly an impulsive snatch and grab . At any time he could have dropped his plan and walked away but he did not.
I know they have to put on a defence here but Smith knew what he was doing and feeling was wrong as evidenced by his attempt to Baker Act himself weeks earlier. He made conscious and calculated choices that reflect his innate evil . jmo..

NEUROPSYCHOLOGIST: DONALD SMITH IS A “PSYCHOPATH”

"...Unlike prior witnesses, Sesta met with Smith for more than five hours- and it was as a result of that meeting that the brain scans were actually done on Smith. Sesta says those scans validated his in person assessment.

“Compared to people who are just like him, his brain doesn’t function normally,” he said.

Sesta differed from other witnesses in that he doesn’t believe Smith is suffering from CTE. He has diagnosed mild to moderate brain injury, but is unsure of the cause.

Beyond the physiological elements, Sesta says he believes Smith is a “psychopath”, meaning he’s at a high threshold of both committing bad acts and being a bad person, which manifests through personality traits like a lack of empathy, remorse, and compassion. .."

It’s all part of the defense's effort to show that Smith not only has mental illness, but his brain is physically abnormal. ..

“So, Mr. Smith, he’s stepping on the gas. He has his left hemisphere works fine. But the brakes don’t work well," said Dr. Joseph Sesta, who testified as an expert witness in neuropsychology. "And therefore, things like anger, aggression, sexuality ... in order for us to all live together in harmony, we have to be able to put the brakes on behaviors that aren’t socially appropriate.

"Mr. Smith has deficits in the parts of his brain that help him to brake or control behavior."

Honestly, what is to be gained by sparing his life? Is he going to go on to finally do great things to atone for his past life of crime? He doesn't have that many years left. Besides, he has no remorse.

Well, it's his dad and the only one he's got, so I give him a break for saying this. His "life advice" might be limited to what kind of tires are the best to buy for his used vehicle, we don't know.
 
I worry his Son will only end up getting hurt out of this. No amount of Prayer, forgiveness etc. etc. will help his killer father. He is a psychopath and only seeks what he can get from others including his Son. I wouldn't be surprised if killer has nothing to do with him in the near future. Killer needed him. Today. IMO
