Jury selection has proven difficult for attorneys because of the amount of publicity the case has garnered. Guerrero-Torres has been the sole suspect in the disappearance of 9-year-old Diana Alvarez, who went missing last year on May 29.

At lunchtime, attorneys had selected 12 possible choices, while excusing 24 others, the majority of whom said they were familiar with Guerrero-Torres as a suspect in the disappearance of Diana.

At least 18 of the 24 people excused so far were given a reprieve after they admitted they were familiar with the girl's name. The remainder had scheduling conflicts.

A jury was seated Friday afternoon in the federal child *advertiser censored* trial against Jorge Guerrero, also accused in the disappearance of Diana Alvarez.

In opening statements, the government described it as a case of betrayal after Guerrero lived in Diana's family home and took advantage of the circumstances. The defense suggested the jurors should consider whether the photos involved are in fact pornographic images that involved a child.

We do know before the trial started, Guerrero had no interest in accepting a plea deal that would ensure him a lower sentence.

The jury was released for the weekend after the government moved through a quick four witnesses before 5 p.m.

The court is in recess now until first thing Monday morning. It's expected to last nearly a week.



'A case about betrayal': Trial begins for Diana Alvarez suspect

[U.S. Attorney Jesus] Casas’ opening statement told the story of Guerrero-Torres, a man who “claimed he loved Diana and that she loved him,” Casas said. Guerrero-Torres, the prosecutor said, rented a room in the home of Diana’s parents and during that time he would go into Diana’s room and “the two would do things."

Keep an open mind,” Roger Azcona, Guerrero-Torres’ attorney, said during opening statements. “When you see and hear the evidence, you will see the government will not meet their burden.”

A Florida Department of Law Enforcement agent had already interviewed Guerrero-Torres once on the day Diana went missing. Two days later, on May 31, 2016, Lee County Sheriff's Office Detective Fortunato “Fred” Mazzotta boarded a helicopter and landed in an Orlando municipal airport. He was scheduled to meet with the man about the missing child case.

But in the almost 20-minute ride from the airport to Guerrero-Torres' home, the defendant fled, Mazzotta testified. But, Guerrero-Torres left behind his phone. He threw it into a flooded swill about a mile away from his apartment, Mazzotta said. It was later found by a landscaper.

Guerrero-Torres was finally captured in Okeechobee on June 3 after a woman who was asked to help him flee turned him in instead, Casas said. Her husband saw Guerrero-Torres was wanted by law enforcement after he fled his Orlando apartment to Okeechobee. The woman, named Antonia Aguilar, was directed to pick him up and after she did, the vehicle they were in was pulled over by waiting law enforcement.

She testified in Spanish about what she called an affectionate relationship that had been developing between defendant Jorge Guerrero and Diana Alvarez, the missing girl. Guerrero is accused of possessing lewd images of Diana, who was 9 when she went missing nearly a year ago. He has not been charged in her disappearance.

The prosecution plans to show those photos to the jury on Tuesday. Prosecutors will also be allowed to show interrogation video of Guerrero admitting to a sexual relationship with Diana.

Hernandez told the jury about her five children, the oldest being the missing 9-year-old. She said she allowed Guerrero to move into her home on the pressing of her brother-in-law, even though the family was already cramped into a three-bedroom trailer home on Unique Circle in San Carlos Park.

After trusting Guerrero "like a brother," Diana's mother said she questioned him once after what she described as a hug that made her uncomfortable. She told the jury that's when she noted to Guerrero that she didn't like that.

Several photos on the phone were entered into evidence showing Guerrero and Diana at a local pizza shop not far from the family's home. Hernandez told the jury she'd never seen the pictures before, and said she was unaware of a time she approved Guerrero to take Diana to that location during the 11 months that he lived with the family. (my sidenote- so was the photo from the pizza shop?? strange.)

He denied ever having sex with the child but said things of a sexual nature occurred between the two nearly once a week for the 11 months he lived at the home.

Rita Hernandez collapsed Monday on the steps at U.S. District Federal Court in downtown Fort Myers. (by me- awwww. So sad)

The Alvarez family had known him for about seven years, working together in the Okeechobee fields. He asked to move in with Rita Hernandez and her partner, Uribe Jimenez, in June 2015, when he found construction work nearby. He worked, watched TV and took the couple's four children to eat and to the park on weekends.

In the tape, Guerrero-Torres tells investigators the abuse started almost immediately.

Guerrero-Torres, now 29, is the sole suspect in Diana's disappearance.

Landscaper Steven Morehouse, 37, was operating a weed-eater at Orlando's Millenium apartment complex when he went behind construction tape to take care of a problem. Taking down weeds at least 2 feet high, he found the Samsung Galaxy S5 resting on top of them above a water-filled canal. With little battery life left and registering 27 missed calls, he charged it in his boss' truck.

It was among the photos that Guererro-Torres thought he deleted that included at least four sexually graphic images of Alvarez. (by me- so he DID try to delete them! They were found in a hidden, deleted folder).
Other photos included Alvarez holding a cat and selfies of Guerrero-Torres and Alvarez, their heads resting together or his arm around her shoulders.

"Did you love her?" Payne asked.

"Yes, I really loved her," he said.

I sincerely hope that now that he's officially been charged with this part of the puzzle, in relation to Diana, LE can use this conviction as a stepping stone to use towards moving forward with abduction and ultimately murder charges. I hope he gets the whole 45 years.
I doubt I'm the only one following this case that believes poor little Diana is no longer with us in "earth form."

Diana, sweetheart, please use your spiritual energy to direct LE or somebody who can get the proper authorities to your location where this monster, whom you very unfortunately trusted (in someway), has hidden you. Your mommy and siblings need you to come home sweet girl. However long his sentence(s) may be, it will never be enough, you were worth more than this. 😇💗💐🌹🥀🌻🌼

We haven't found sweet Diana yet, but JG' phone being found and tracked was a miracle. Hopeful we can get a plea to find Diana.

He's a filthy, evil, demented *******, And I'm betting he's feeling so sorry...for HIMSELF.

One of the 43 total pictures features Diana and the man who is the prime suspect in her disappearance, Jorge Guerrero.

The rest of the photos were found on Guerrero's phone. They include pictures of the apartment complex where the phone was found, views of inside Diana's home, one of her underwear, and a piece of paper depicting the photos of the child *advertiser censored*.

I wish this monster could be denied basic comforts until he gives up her location.
No mattress. No toilet (a bucket that HE has to clean every day). Wash his own clothes. No fans or AC. No TV. No books, no visitors. Etc.
