You know what, I'm really starting to think that it's the best option. We have a lot of members here concerned with the jury understanding premeditation when it's only a small factor in this case. The jury had second degree murder to look at. And it doesn't have to be premeditated.

The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.

And they could have found Dunn guilty of manslaughter which doesn't have a premeditation factor.

It will be interesting to hear from this jury if they decide to talk to the media.

I'm going by what the eye witness said MD yelled as he was grabbing his gun. Some like: "You're not talking to me that way...." Whole different meaning than "Are you talking to ME."

I am with you LambChop. I read all the police reports today line by line and all of the witness accounts.

This was no case of MD saying Jordan was coming at him or pointing a gun at him and Jordan's friends saying no he didn't. Independent witness who did not know ANY of the parties in this case stated clearly that no one was advancing on MD, getting out of the SUV to come at MD or brandishing a weapon. Those independent witnesses have no reason to lie. They were simply folks going about their business buying gas and such.

MD shot at that SUV and at the young men within because they dared defy him and they were "thugs". plain and simple. that to me equals first degree murder

You can see how much this case has weighed on Don Lemon it's refreshing to see a reporter earnestly showing their feelings.
 
DA addressing complaints that MD was overcharged and that is why the mistrial on count one occurred. cites their ability to file sworn motions to get over charges dismissed. Cites the availability of lesser charges for jurors who were not compfortable with Murder 1 in this case.

watching CNN for the press conferences following verdict.
 
On appeal all four counts of guilty can be turned to mistrial.

motion to dismiss does not answer the overcharged question imo

The motion to dismiss can be used if the defense feels that the defendant is being overcharged. Of course this requires the defense attorney to actually file the necessary paperwork and to make his case in a court of law, rather than repeatedly cry "overcharge" in the media.

I'm happy Dunn will spend the rest of his life in jail.

That said, I'm so sad that we still don't have an answer as to whether one can shoot a young black male in Florida carte blanche provided you say you were scared.

Jordan Davis deserves better, his family deserves better, Trayvon Martin deserved better, ALL of our children deserve better!

That is the exact charge and conviction that Marissa Alexander got.
