The sound is awful!
Sure is, awful streaming quality.
Cardiza has denied the jury misconduct part re how they communicated to court and is now talking about how everyone deserved to enjoy Christmas.

Sounds like Judge is Denying all request for a new trial!

Yep! And says if that creates the "perfect appeal record," So be it.

Love that Denied emoji, jewels, perfect.

Anyone hear at the ending " where is she ?" . I'm pretty sure it was Kim asking Steven.... heartbreaking

Steven Capobianco Motion for New Trial March 6, 2017

The most interesting new information (possibly) that came out IMO in Cardoza's ruling is that Juror #3 possibly argued that his professional experience led him to believe that's Steven's hand injuries were caused by using a ligature (rope or wire) to strangle Charli.

Having endless trouble with this site today, so excuse my posting bits of thoughts, but if I wait, the site reloads and wipes the post.

We have noted that SC uses bits of reality to spin lies. He did say to someone he was injured by a cable for a truck window, right? Which is a ligature of sorts. Maybe he created that lie because it really was a ligature injury to his hands.

I am remembering how the expert said the blow to her jaw was done at or just before the time of death. Maybe he hit her jaw from the side and then threw a ligature around her neck and strangled her.

It's also sadly possible that he marched her from the SUV to the death "clearing" in the jungle with a halter around her neck. As we see in films sometimes, where the person being marched cannot bolt without cutting off their own air. We know she was strong and had a lot of spirit, so he likely had to control her somehow to get her there.

No words for his evilness.
I'm sorry Kim had to hear more painful stuff, but very happy for family that they cleared this hurdle.

Yes! The Youtube video is clear.
"Where is she, Steven? Where IS she?" Kim's voice. He had to hear.

I would imagine if he strangled her and did that first then the jaw segment was beaten off of her. I hate saying that. I really think he dismembered her, and I hate saying that also. With the cutting marks on the jaw bone that is what leads me to that. Maybe someday the family will find out, and then maybe they really don't want to know, other than where he put her.

So when can the jury be interviewed or calk about the case and their experience?

I believe at any time after the verdict. Defense attorneys talked to them, it became known today. Rivera said it was improper because the court had not given the OK, but Apo said it was OK, and the judge said nothing about the defense acting improperly, so it would seem it was allowable.

Does anyone know what juror # 1 looked like? She (I think) was the one who contacted the court and said they weren't necessarily a hung jury.

I don't recall seeing the jury members?

Right, we did not on video, but some on this forum attended in person. Not wanting to be nosy about jurors' identity, just wondering if she stood out or showed emotions.

I meant when can the jury be interviewed by reporters? I remember the judge putting a hold on that so they could get back to normalcy.

Yes, she says "Where is she, Steven? WHERE IS SHE?"
And Steven looks toward her, then looks away dismissively...then as he's exiting, it appears he puts his hand palm up in a shrugging, "I don't know" gesture.
He's just awful, he will never in a million years come clean about what he did. I think he's impulsive, dumb, and kind of fatalistic/apathetic.

So grateful that the jury convicted him of the murder and of the enhanced sentencing for exceptional cruelty. Nothing can bring Charli & Joshua back, but it's so awesome that justice was served in this horrible case. He will never see the light of day again. Nothing but love and respect for those jurors, they did good.

Regarding his aunt bringing him drugs in prison...apples don't fall far from the tree in his family, apparently. They all seem to make really poor, ill-thought-out decisions. I remember someone posting that the aunt would show up to court to support Steven and give flippant looks to Charli's family. :-(

Where is she Steven, where is SHE?
I know Ms. Kim won't give up. Give him hell Kim. Keep asking. You are in control not him.

Capobianco’s Request for New Trial Denied

snipped

After court had recessed and as Capobianco was being escorted out of the courtroom, Scott’s mother, Kimberlyn turned toward the closing door and asked, “Where is she Steven? Where is she?”

I adore a wise jury with common sense and serious purpose. I adore Juror #3. SC's hand injuries were caused by the ligature and were ligature marks.

"According to information presented in court today, the juror seated in seat #3 used personal or professional experience to determine the injuries sustained by Capobianco on his hands were ligature marks. The information was reportedly shared among other jurors."

"The court further revealed that during deliberations, a juror who claimed to be 6 feet tall, stood as the bailiff held a pair of jeans that was entered into evidence, and based on the experiment determined the blue jeans would have fit Capobianco."
