The Aug. 20/21 interview came after CBR worked a full day at Yarrabee Farms. Defense has established he worked 12-hour days, twelve days out of every two week period.

Video is being played at 3X speed. There's no audio as this isn't a portion that includes an interview. CBR is alone in the room. He checks his phone briefly, then sort of reclines in the chair, arms crossed, head down. He rubs his eyes every once in a while.
8:49 AM · May 21, 2021·Twitter Web App

Looks like he goes from head down to head up sometimes. I see his eyes blink but mostly they're closed.
8:50 AM · May 21, 2021·Twitter Web App

At one point he puts a ballcap over his face.

Hasn't moved much for a while (again this video is 3X speed) and his head is kind of lolling around.
8:52 AM · May 21, 2021·Twitter Web App

His head falls to the side and he stays that way for a bit before kind of jerking back.

He looks like he wakes up, sits up, adjusts, then goes into this position.

He adjusts his position, mostly shifting his legs, a few times. Rubs his eyes. Now appears to be leaning back and not moving.

Now he's laying on the table.

The movements look odd because of the sped up video but he stays like that, only moving his head a bit, then moves his face into the crook of his arm. Romero re-enters with some food.
8:58 AM · May 21, 2021·Twitter Web App

This was about half an hour worth of video sped up. Romero says she did not actually see him sleeping. Says she was looking down at the food and only saw him look up.

Now I get it- defense will claim location of the body came to CB in a dream that resulted from extreme sleep deprivation caused by LE. In fairness… if that’s the best they’ve got, they must go with it… imo

Frese: "So you're telling this jury you did not see him sleeping?" Romero says she was looking down to make sure a sandwich didn't fall off a plate. Now going back and forth over transcript and translation. Transcript says "you fell asleep."

Asking about different possible translations of "You fell asleep" in Spanish. Translation has been a point of contention in this testimony. Romero said yesterday she doesn't agree with some of the transcript translation, done by ICE.

"Isn't true that as you walked into the room you said, 'You fell asleep.'" "Yes," Romero says.

CBR is sitting in the courtroom listening on his headphones. He's not holding his head as high as I've seen previously but he's looking up and back and forth as conversation goes on.

Defense wants to show this to prove CBR was sleeping.
8:46 AM · May 21, 2021·Twitter Web App

Let the defense show CBR was sleeping -- they tried the same in the Evidence Suppression Hearing and the judge didn't buy it as a reason to suppress evidence. Watching the accused-- slouched in his chair, about to fall asleep during his trial, depicts the same.... MOO
