Boyfriend denies role in college student Mollie Tibbetts 2018 slaying (mercurynews.com)

Dalton Jack, the longtime boyfriend of Mollie Tibbetts, was a key witness on the first day of the first-degree murder trial of Cristhian Bahena Rivera, the Mexican national charged in her killing.

During cross examination, defense lawyers for Bahena Rivera worked to try to cast suspicion on Jack, painting him as an angry young man who had a tumultuous relationship with Tibbetts and had cheated on her with at least one other woman.

But Klaver said a homeowner’s surveillance video will show Bahena Rivera’s black Chevy Malibu appearing to circle Tibbets as she ran. Bahena Rivera, now 26, told police that he drove past Tibbetts and turned around to get a second look because he thought she was “hot,” Klaver said.

The brothers testified that they became concerned after learning on July 19 that Tibbetts had not shown up for work at a daycare, and she was not answering her phone. Both returned to Brooklyn to help search for her, before calling police.

Dalton Jack testified that he had been part of a crew building a bridge in Dubuque, about 140 miles from Brooklyn. He worked 12 hours on July 18 then drank beer and played yard games with the crew before going to sleep at a hotel, adding that he never returned to Brooklyn that night.

On cross-examination, Jack acknowledged he used to have a “short fuse” and would get into fights. He said that he had “screwed up” and cheated on Tibbetts once, and that she discovered the relationship after looking through his phone.

He also said he did not agree to voluntarily testify and required a subpoena because he didn’t want to be in “the same room” as Bahena Rivera.

“I am obviously not his biggest fan,” he said. “I wholeheartedly believe he’s guilty.”

Jack said he joined the Army three months after Tibbetts’ body was found because he was heartbroken and “wanted to pretty much leave” their hometown.

Cristhian Bahena Rivera's Defense Suggest Someone Else Killed Mollie Tibbetts (lawandcrime.com)
Defense attorneys for Cristhian Bahena Rivera appear to be suggesting an alternate suspect in the murder of college student Mollie Tibbetts — even though Bahena Rivera allegedly led investigators straight to Tibbetts’ body. Based on early cross examination, the defense’s alternate suspect appears to the victim’s boyfriend, Dalton Jack.

It remains to be seen how — or whether — the defense will try to put these details together. The defense tactically chose to postpone its opening statement until after the state’s case in chief.

DNA analysis of blood in Bahena Rivera’s trunk revealed it was Mollie’s, the prosecutor said. But the defense is pointing to unknown blood and fingerprints found in Bahena Rivera’s trunk as grounds for reasonable doubt.

An autopsy revealed that Tibbetts had been stabbed seven times.

This cause of death brings us to the defense’s approach to the case. Dalton Jack’s brother, Blake Jack, took the stand first. He testified to being out of town in the city of Newton at a job site for his construction company. During cross-examination, defense lawyer Jennifer Frese got him to acknowledge that both siblings are avid hunters who would field dress animals using a knife.

She suggested that Tibbetts and Dalton Jack had relationship problems, that Dalton cheated on Tibbetts, and that Dalton had anger problems. Blake said he was not aware of that.

Under cross-examination, Jack acknowledged having a temper at ages 16 and 17, but not anymore. Frese asserted through a question that Dalton had once choked a man out, but the state objected as to relevance. The judge sustained the objection.

Dalton Jack then acknowledged getting into fights. During re-cross, he said he did not remember telling Mollie he did not like other men looking at her.

Dalton said he never had access to Bahena Rivera’s vehicle and that he and Tibbetts never had a connection with the defendant.

The boyfriend of University of Iowa student Mollie Tibbetts testified Wednesday that he had nothing to do with her 2018 abduction and stabbing death, saying he had been out of town for work and was heartbroken by her slaying.

Dalton Jack, her longtime boyfriend, was a key witness on the first day of the first-degree murder trial of Cristhian Bahena Rivera, 26, the Mexican national charged in her killing.

Prosecutor Bart Klaver said in his opening statement Wednesday that video evidence, DNA analysis and a partial confession by Bahena Rivera, a dairy farmworker, will be crucial to proving his guilt. Tibbetts, 20, disappeared while out for a run in Brooklyn, Iowa, on July 18, 2018. Her body was recovered a month later in a cornfield.

During cross-examination, defense attorneys for Bahena Rivera worked to try to cast suspicion on Jack, painting him as a man with a temper who had a tumultuous relationship with Tibbetts and had cheated on her with at least one other woman.

The jury including three alternates comprises 12 white people and three of Hispanic, Latino or Spanish descent, according to demographic data released Wednesday. The case inflamed passions over illegal immigration, after then-President Donald Trump said Bahena Rivera had exploited lax immigration laws to enter the United States from Mexico as a teenager.

Jack, 23 and now an Army sergeant stationed at Fort Bragg in North Carolina, testified that he met Tibbetts at high school and had been dating her for three years. He described her as "happy, bubbly, goofy," saying she liked to have fun and that she went running most days.

On the day she disappeared, Tibbetts was staying at the Brooklyn home where Jack and his older brother, Blake Jack, lived. She had been watching Blake Jack's dogs while the brothers were out of town that week for work.

On cross-examination, Jack acknowledged he used to have a "short fuse" and would get into fights. He said he had "screwed up" and cheated on Tibbetts once, and that she discovered the relationship after looking through his phone.

Jack said the two worked through the problem and never broke up but acknowledged Tibbetts told him three days before she disappeared that she remained sad and upset about his infidelity. On the day before she went missing, she had discussed one of his previous relationships with a second woman, Jack admitted.

With friends and police searching for Tibbetts, a woman with whom Jack has previously had a relationship sent him a text message asking, "Dalton, is Mollie alive?" defense lawyer Chad Frese said, calling the question "odd."

Jack admitted that he initially told police that he was watching a movie in his hotel room on the night she disappeared and that he withheld information about his infidelity, calling it irrelevant. He also acknowledged that he told police his last communication with Tibbetts was a Snapchat he received at 10:30 p.m. that night, but phone records show it was after 1 a.m.

He also said he did not agree to voluntarily testify and required a subpoena because he didn't want to be in "the same room" as Bahena Rivera.

Poweshiek County Deputy Steve Kivi said the homeowner’s surveillance video collected during a canvass showed a black Chevy Malibu with chrome door handles “just kind of lingering” near where Mollie Tibbetts disappeared while running on July 18, 2018, in Brooklyn, Iowa.

Kivi said he reviewed the video on Aug. 15, 2018, while investigating what happened to Tibbetts, a University of Iowa student who was back in her hometown over summer break. The next day, Kivi said he spotted the vehicle just outside of Brooklyn getting off of Interstate 80 and later interviewed the driver, a local dairy farm worker named Cristhian Bahena Rivera.

Bahena Rivera’s defense team tried Thursday to cast doubt on others who had initially come under scrutiny, including Tibbetts’ boyfriend and local residents who had been investigated because of their past behavior toward women.

Kivi acknowledged that investigators never found a murder weapon. An autopsy found that Tibbetts had died of stab wounds.

He acknowledged that several other county residents had come under scrutiny during the monthlong investigation, including a man who lived next to where Tibbetts’ body was found. But he said no evidence was found linking anyone else to Tibbetts’ death.

Riessen said he made a spreadsheet logging every person or vehicle that could be seen on the video around that time, and the first four entries were of a distinctive Chevy Malibu.

"We wanted to know who was driving that vehicle," he said.

Kivi said that just two days before his encounter with Bahena Rivera, an undocumented immigrant from Mexico, other investigators on the case were combing through security video they had collected from homes and businesses in Brooklyn, Iowa, and came upon footage of Tibbetts jogging in the rural farming community. Investigators also noticed in the footage that a black Chevy Malibu with chrome side mirrors and chrome door handles kept appearing over and over again in the same area and around the same time Tibbetts was out exercising.

Agent Derek Riessen of the Iowa Division of Criminal Investigation testified he and other investigators were going through about 30-days worth of video taken from the home of Brooklyn resident Logan Collins, 27. Collins testified that he turned over to authorities in mid-August 2018 video taken from four security cameras he had mounted on his garage.

He said investigators determined the jogger seen in the video was Tibbetts, testifying that another witness had seen Tibbetts jogging not far from Collins' home just before she went missing.

Riessen said a black Mailbu was seen going past Collins home six different times and that the last time it was seen it was headed in the direction Tibbetts was running.

Acting on the information Kivi had gotten from Bahena Rivera, Special Agent Michael Fischels of the Department of Homeland Security said he and other investigators went to the dairy where Bahena Rivera worked on Aug. 20 and questioned him and other employees with the permission of the dairy owners.

Pamela Romero, a former Liberty City, Iowa, police officer, said she was asked to help interview Bahena Rivera because she speaks Spanish.

Romero said that during an 11-hour interview, Bahena Rivera confessed when he was confronted with a still image of his car captured on Collins' security camera.

She said the interview continued into the early morning hours of the next day, Aug. 21, and that Rivera went with her and other investigators to his home, his place of work and then directed them to a cornfield on the outskirts of Brooklyn.

Romero said that while sitting in a police vehicle parked near the cornfield, she read Bahena Rivera, who had been placed under arrest, his Miranda rights. He said he waived his right to remain silent and agreed to continue the interview.

Romero said Bahena Rivera allegedly claimed Tibbetts said she was going to call the police.

"Mr. Rivera said that he got angry," Romero said. "After he said that he got angry, he stated that they started fighting. He said that Mollie tried to slap him and was screaming at him."

Romero said that Bahena Rivera allegedly claimed that when he gets angry, he usually blacks out.

"So the next thing that he told me was he remembered driving and looking down to his legs and finding the earbuds that belonged to Mollie and that is when he remembered he had Mollie in the back of his vehicle, in the trunk," Romero said. "He stated that he did not remember putting her inside the car. He did not remember how she got there but he did remember how he took her out of the vehicle."

Romero said Bahena Rivera allegedly said he drove to the cornfield, opened the trunk and saw blood on Tibbetts' neck.

During his opening statement at the trial on Wednesday, prosecutor Bart Klaver told the jury that an autopsy determined Tibbetts was stabbed seven to 12 times in the neck, head and chest.

Romero testified that when she pressed Bahena Rivera for more details, he allegedly replied, "I brought you here, didn't I? So, that means that I did it. I don't remember how I did it."

Bahena Rivera told Romero during their interview he used the Nissan Altima on gravel roads because it wasn’t up to date on registration, but used the Chevrolet Malibu to drive around town.

When initially in the interview room, Romero showed Bahena Rivera pictures of the vehicle from three security videos. Bahena Rivera told her it was his car and he was alone in the car at the time of the photos.

Romero showed the photograph of the security camera catching a jogger, but the gender of the jogger is unidentified. When showed the image, Bahena Rivera referred to the jogger as a female and recalled seeing her that day. He then told Romero he saw the jogger three times.

The investigators and Bahena Rivera then went to 2478 460th Ave. at about 4:30 a.m. Aug. 21. Authorities located Tibbetts’ body in the cornfield.

He told Romero he took Tibbetts to a cornfield at 2478 460th Ave. Bahena Rivera said he carried Tibbetts over his shoulder, and she felt like “a person who had just fainted.”

Romero testified that Bahena Rivera acknowledged injuries to Tibbetts’ neck, however defense attorneys said her injuries don’t reflect that. Romero told the defense that she couldn’t testify to Tibbetts’ injuries, only what Bahena Rivera told her.

Defense attorney Jennifer Frese said Bahena Rivera fell asleep multiple times during the interview and his breaks, however Romero said she did not witness it. Romero said by the end of the interview everyone was tired.

Jennifer Frese said Bahena Rivera’s family came to the sheriff’s office that evening. Romero said she didn’t know how long the interview would go for and said they could go home for the night. She then told Bahena Rivera that his family had visited.

The defense said as he was being interviewed, his vehicle was being processed. At a point during the interview, an investigator told Romero that a hair was found in the vehicle. She asked Bahena Rivera why there was hair in the vehicle and he claimed it was from his daughter.

Referring to the transcripts, Jennifer Frese mentions Bahena Rivera spoke about a date he was going to have on July 18, 2018, but it didn’t happen due to the tornado that hit Marshalltown. The date correlates with testimony given Wednesday by Bahena Rivera’s cousin.

Court adjourned for the day while Romero’s testimony had not yet concluded.

During testimony, Kivi stated that FBI cell phone analysis helped authorities narrow down where Tibbetts may have disappeared.

“There was some kind of what (the FBI) called an ‘event’ at a certain point along 385th Ave., and all of the sudden (Tibbetts’) phone is traveling, like, 55 to 60 mph down south down a gravel road,” Kivi said. “And then it just shuts off.”

Collins’ security footage showed the black Chevrolet Malibu affiliated with Bahena Rivera.

Riessen obtained the footage of the black Chevrolet Malibu from Collins. Attorneys played the footage during Riessen’s testimony, which also showed what investigators believed to be a runner.

The car affiliated with Bahena Rivera appeared on the surveillance multiple times.

Fischels said he was proficient in Spanish and spoke with Bahena Rivera who provided permission to search his residence, a black Chevrolet Malibu and a Nissan Altima, another vehicle affiliated with Bahena Rivera.

Fischels testified that Bahena Rivera told authorities he hadn’t met Tibbetts, but mentioned “something about Facebook.”

Authorities also testified to taking a DNA sample on Aug. 20, 2018 from Bahena Rivera.

The defense questioned Scott Green with the Division of Criminal Investigation about their canvassing practices. Green said they had canvassed all of Brooklyn and Yarrabee Farms.
