*Motions Hearing (Closed Hearing) (@ 10am MT) – ID – Joshua Jaxon (JJ) Vallow (7) & Tylee Ashlyn Ryan (16) (JJ last seen 9/23/19 & Tylee on 9/9/19, Rexburg; found 6/9/20 buried in Daybell’s yard in Salem, ID) – *Chad Guy Daybell (51/now 52) arrested & charged (6/9/20) & arraigned (8/21/20) with 2 felony counts of destruction, alteration or concealment of evidence & concealing remains. Plead not guilty. $1M bond. Fremont County
*Charged (7/1/20) & arraigned (8/21/20) with 2 felony counts of conspiracy to commit concealment, destruction or alteration of evidence. Plead not guilty. Bond stays at $1M. Fremont County
Trial set to begin 7/12/21 thru 8/6/21 all @ 9am

10/22/20: Notice of submission of authority re severing of cases. Notice of motion hearing on 10/29/20 at 10am. 10/29/20 Update: During the hearing, Chad Daybell, alongside his attorney, John Prior, appeared over Zoom alongside the judge & Special Prosecutor Rob Wood. The jury trials for Chad & Lori Daybell will be combined following a ruling by District Judge Steven Boyce Thursday morning. State's motion granted. Both Prior & Wood mentioned that a motion for severance could be filed at a later date such as if a plea agreement or other resolution to the case was met by one of the defendants. The next motions hearing for the case is scheduled for Chad on Nov. 24 when Prior is expected to argue the case should be dismissed. Prior is also planning to ask a judge to move the trial out of Fremont County due to potential jury bias concerns.
11/4/20: State’s Motion for Joinder filed. Motion hearing on 11/24 re change of venue.
11/13/20 Update: Idaho court records show a date has been set for the trial of Chad & Lori Daybell. The trial will begin on July 12, 2021 at 9 a.m. with Steven Boyce presiding as the judicial officer. A pre-trial conference has also been set for June 2, 2021 at 10 a.m. This comes two weeks after Judge Boyce ruled to combine the trials.
11/13/20 Update: Previously, the hearings for change of trial location & dismissal of charges was set for Nov 24. Now, they will be held Jan. 6, 2021. Daybell’s attorney John Prior files memorandum to support change of venue. Prior says fair & impartial trial can’t be had in Fremont, Madison or Bonneville Counties in Idaho. His argument mentions recording of Vallow justifying right to harm her third husband Joseph Ryan. Daybell requests all articles & media coverage submitted to court ahead of this memorandum be admitted in its entirety to support motion to change venue.
12/9/20: Daybell filed Supplemental request for Discovery motion. Request to obtain approval to video/audio record, broadcast or photograph a court proceeding-granted.
12/17/20 Update: Closed motions hearing re Attorney Means filing regarding DA Woods on 12/18/20. Judge sealed affidavit.
*Lori Norene Vallow aka Lori Norene Daybell (46/now 47) arrested (in Kauai, Hawaii), Charged (6/30/20) with 2 counts of conspiracy to commit destruction, alteration or concealment of evidence. Bond set at $1M. Fremont County

10/22/20: Notice of submission of authority re severing of cases. Notice of motion hearing on 10/29/20 at 10am. 10/29/20 Update: Hearing was only for Chad. Vallow's attorney Mark Means sent an eight-page letter to Madison County Prosecutor Attorney Rob Wood last week as a follow-up to Wood’s response to three requests Means filed in March & April. In those requests, Means asked for audio & video recordings, emails, text messages, social media posts, voicemails, notes, reports, and other information regarding Daybell, her husband, Chad Daybell, and a variety of other people. Wood responded by providing Means with some of the information, objecting to parts of the request, saying his office did not have some of what was asked for & stating portions of Means’ request were “vague, overly broad & unduly burdensome.” Means also requested jailhouse recordings & letters for Chad & Lori Daybell, and autopsy & toxicology reports for JJ & Tylee, as well as the Daybell’s former respective spouses, Tammy Daybell & Charles Vallow. Pretrial hearing on 2/25/20.
11/5/20: Order of assignment by Administrative District Judge: the Honorable Steven W. Boyce, District Judge for all further proceedings.
11/9/20: NEW: Phoenix PD spokeswoman Sgt. Mercedes Fortune confirms investigators will review case of Joseph Ryan’s death. He was Lori Vallow’s 3rd husband & Tylee Ryan’s dad. He died of a heart attack in 2018. Audio of Vallow allegedly saying she wanted to murder him led to this move. Phoenix PD said investigators will review the death of Joseph Ryan, but it doesn't mean it's being re-opened for investigation. 11/11/20: Phoenix PD have named Vallow a person of interest in Ryan’s death.
11/13/20 Update: Idaho court records show a date has been set for the trial of Chad & Lori Daybell. 12/16/20: According to court documents, Vallow's lawyer, Mark Means, is accusing special counsel Robert Wood of having committed prosecutorial misconduct, based on an audio recording made in October 2020 between Wood & Vallow's biological sister, Summer Shiflet, that was recently discovered, in addition to an audio recording that was made at around the same time between Wood & Zulema Pastenes, who was the wife of the late Alex Cox. Means accused Wood of violating Vallow's due process rights by engaging in what Means describes as "coercive, unduly influence, coaching, & intimidating tactics" to manipulate material witness or witnesses to the case. In addition, Means accused Wood of violating professional rules, and that the misconduct could be construed as criminal acts under laws against witness tampering & witness intimidation. The motion, dated Dec. 15, 2020 was filed with the District Court of the Seventh Judicial District of the State of Idaho.
Madison County: Pretrial hearing on 1/4/20. Trial set to begin on 1/25/21 (thru 1/29/21 @ 9am).

ETA: It's a very interesting conversation. Eric Grossarth said that about a week after the kids were reported missing, he got a tip (including coordinates) from an anonymous fb account about Lori and Chad being in Hawaii.

Scott Reisch: "The Arizona Attorney Ethics Advisory Committee considers most non-consensual recorded conversations by attorneys to be unethical... I would not surreptitiously record a conversation in anything related to my law practice."


ETA: Scott is in Colorado, like Arizona also a one party consent state.

Judging by the Order to Close Hearing, today's hearing was about the Motion for Judicial Protective Order filed by the prosecution on Dec 16 and perhaps also about the Defendant's Motion for Judicial Protection Order filed by MM today. MM basically asked for RW to be taken off the case until the hearing about the motion for his dismissal.

From the Order to Close Hearing:

The Court therefore finds good cause for the expedited hearing request to be granted, and the State's Motion for Judicial Protective Order shall be heard on Friday, December 18 at 10:00 a.m., by remote hearing. It is further ordered that the Hearing is CLOSED.

In the Dec 16 Motion for Judicial Protective Order the prosecution asked for a lot more things to be sealed than they were sealed with the Order to Seal on Dec 17.

Great discussion by the reporters. Very respectful. Justice can’t come soon enough for these killers. Hoping the DA can charged them with murder.
