Can Sheila's brother apply for custody of Stella? I'd think that a murder conviction would qualify as an unfit mother.

Child protection services should meet Heather at the airport to take charge of the child until Heather can prove that she can provide for the child without relying on the child's money.

That would provide time for the child's relatives to apply for custody.
 
Sheila’s brother Bill Weise had a few things to say to The Daily Mail.


In an exclusive interview, Wiese says: 'My real issue is the original ten-year sentence, which was a total travesty of justice. Heather murdered her own mother to get at that trust.

'This is just my opinion, and I have no proof, but I think the $150,000 that Chicago judge sent over there totally corrupted the whole judicial process.

'I have no idea what's going to happen [with the FBI]. But I don't think she's received justice from the ten-year sentence in Indonesia, so I would hope she'd face justice here in the United States.

'We spent a lot of time trying to tell the judge how much corruption there was in the Indonesian judicial system and he didn't seem to care.

'I also wonder how much of that $150,000 went to Heather; it seems like if you have money in Bali, you have a much better life in prison. It seemed like she was having a party in there.'

Throughout her incarceration, Wiese says Mack hasn't shown a shred of contrition and is unlikely to ever do so, with the family fearing she could try to make money from being a famous murderess.”

“It is believed that when Mack reaches Chicago she will be taken into custody again, this time by federal authorities.


"We don't believe that the U.S. attorney's office has legal authority to arrest Heather in Chicago tomorrow for a crime that she was already prosecuted for, and convicted, and spent significant time in jail in Bali, Indonesia," said her American attorney Brian Claypool.


Claypool said Mack expected that she, her daughter, and her daughter's foster mother would be spending some time in Los Angeles, where he is based. What will happen now is unknown.

"The federal government is permitted to detain and interrogate Heather for up to 17 hours and then determine whether they're going to release her or serve her with an arrest warrant," he said. "Those are probably the top options that are on the table."

An emergency guardianship hearing was held in circuit court Tuesday afternoon to determine what will happen to Mack's daughter when she lands in Chicago. A judge granted a request for her to be placed with a person of the family's choosing until her mother's fate is clear.

If she is charged in the U.S., it may not be double jeopardy. A 2019 U.S. Supreme Court decision stating that an exception to double jeopardy is given when the case is brought by "separate sovereigns."

We knew it but a friend has spoken out about how tough things have been for TS.

“Schaefer - who's turned to God during his time behind bars and is full of remorse - suffers from malnutrition while battling health problems, a close friend has claimed.

The pal exclusively told The Sun: "Tommy is doing okay, it's been a tough couple of years, he got TB in 2019 and was very sick for about nine months and then, in early 2021, he got Covid.

"His health has been a struggle, but he's hanging in there and trying to make the best of the situation.

"He definitely still uses his faith for his strength and to become a better person. He has grown up and matured a lot in the last couple of years.

"Tommy feels his sentence is fair for what he did, so he doesn't feel like he should be getting out, although he does feel Heather should have got an equal sentence.

No visitors have been able to enter the prison for over 20 months because of the pandemic and he has little money coming in from family in the US.

Money is vital in Bali's Kerobokan prison as it enables inmates to buy decent food and other provisions.

Schaefer's pal went on: "Their experiences in prison have been totally different, Tommy has definitely suffered more. Heather has bought her way through her time.


"Most of Tommy's hardships come from the lack of food and clean water, malnutrition, which makes him susceptible to the various viruses and diseases in the prison, and the lack of medical or dental facilities.

"You need money for everything - he hasn't had a phone for three years.”

It seems that the FBI are interested in talking with Mack.

“Let’s do this the right way, not in front of everybody, in front of the whole world,” Claypool said in a telephone interview. “They were playing hide-and-seek. Everything about how this has been handled has been inappropriate and reprehensible.”

Hopefully there is an arrest warrant for charges other than murder.

"With his client bound for Chicago for the first time since the 2014 murder of her mother in Bali, an attorney for Heather Mack warned “it’s gonna be a war” if federal authorities arrest the infamous Chicagoan who served a little more than seven years for the brutal crime.

“It’s gonna be a dog fight, because they are being punitive toward Heather,” attorney Brian Claypool told the Chicago Sun-Times.

Claypool said Mack was due to land at O’Hare Airport around 9:30 a.m. Wednesday on a flight from Seoul. He said he expects Mack will at least be detained by federal authorities for questioning about the murder of Sheila von Wiese-Mack of Oak Park.

But Claypool also said that “serving her with an arrest warrant seems to be on the table as well.” That’s because arrangements had originally been made for Mack to fly into Los Angeles following her release last week from an Indonesian prison, according to Claypool. He said the FBI contacted Mack a few days ago and told her she would be flying to Chicago.

Still, Claypool already has plans to challenge any charges filed against Mack. He said federal law prevents a U.S. citizen prosecuted in a foreign country from being prosecuted “for the same crime” in the United States. If prosecutors try to argue she is being charged here with a different crime, he said “we’re going to fight that to the bitter end.”

He appears to be an attorney who lists numerous media companies who he is “as seen on” , on his website. He’s the one drumming up a media frenzy in the US over HM’s return while simultaneously saying this should all be kept quiet IMO.

It sounds like Mack has another trick up her sleeve. By bringing her daughter's foster mother to Chicago, the foster mother can look after Stella if Mack is arrested. The foster mother will very likely apply for Stella to return to Bali within 6 months. Heather will then apply to go to Bali to be with her daughter.

Although Bali authorities have said they want a lifetime ban on Mack visiting Bali, the child falls into the 6 month rule.

I'm guessing he is already billing the trust fund. The argument will be that he's looking after the best interests of the child, which includes time with her mother.

"Heather Mack and Tommy Schaefer are charged with conspiring to kill Mack’s mother, Sheila von Wiese-Mack, in a federal indictment filed in 2017 and briefly unsealed Wednesday in Chicago’s federal court.

Mack and Schaefer are also charged with an obstruction of justice charge in the three-count indictment, which became public as Mack was expected to arrive at Chicago’s O’Hare Airport on Wednesday morning. The indictment was then re-sealed.

The five-page document lists a series of overt acts by Mack and Schaefer, including Mack’s boarding of an airplane at O’Hare on Aug. 2, 2014, her arranging for Schaefer to travel from Chicago to Bali, their exchanging of messages discussing how to kill von Wiese-Mack, and the actual killing of von Wiese-Mack.

Mack and Schaefer are charged with two conspiracy counts. They also face a charge alleging they “destroyed, mutilated and concealed objects” to impair its availability for an official proceeding “by forcing the body of [von Wiese-Mack] into a suitcase after she had been killed and removing the suitcase from the place of the murder; and by removing linens and items of clothing worn during the killing … from the place of the murder.”

Claypool told Fox News Digital he had a plan in place until a few days ago to have Heather, Oshar and Stella stay in Los Angeles with a woman by the name of Diana Laroque as Stella would continue virtual learning at the school she attended while living in Indonesia. The Chicago Tribune reported the FBI ordered Mack to return to Chicago instead of Los Angeles as she had first planned.

"They are inseparable. Stella loves Oshar like her own mom," Claypool told Fox News Digital via email. "The actions of the U.S. attorney and the FBI might jeopardize Stella’s stable and loving home.
