DUI requires certain proof such as failing a sobriety test at the time of a traffic stop, to the best of my knowledge

first thought is determining THC levels in blood and consent to be tested might be difficult to overcome with dui charge.

If they drew blood from her when first arrested and chain of evidence maintained that blood may be tested with a court order. THC Stays in serum up to 30 days. I do think that the da will use in a future case CE of her unborn child. Using drugs while knowing pregnant in first trimester.

She was initially charged with CE of Lucas for leaving him home alone. The DA stated when formal charges were brought in court, they had tabled those charges *for now* while the investigation into his disappearance was ongoing

DA holding it in abeyance to give LE every minute they need to compile a good case for murder charges. They’ll get to it.

Wont this posses a problem as to her being charged with DUI with the child in the car?

She hasn’t been charged with DUI which her attorney argued in preliminary hearings, the CE stems from drug use and driving/caring for the baby while high. But no DUI was charged

they are holding any charges re LUCAS IN ABEYANCE TO table a charge, the charge has to exist. While I believe there’s an evidentiary file with info re LUCAS child endangerment charges it’s their ace in the hole.

I believe charges will will be filed in this order.

CE against EG

Battery against JH

CE TRIAL EG

Conviction against EG

SENTENCING FOR EG

EG sentenced to 13 months w credit time served

CINC case moves forward against EG older boys.

EG eventually loses visitation rights for them

Search goes on for LUCAS

JH May negotiate plea ordered no contact with EG 2boys

EG gives birth

Baby taken into protective custody. Eventually EG LOSES PARENTAL RIGHTS FOR ALL CHILDREN.


One of 2 things HAPPEN HERE

If LUCAS NOT FOUND and prior to her release

CE charges filed against EG LUCAS same bond

EG he’s to trial same bond/bail

Convicted sentenced to 12 months

regardless LUCAS LOCATION

DA LE have prepared their best case after arduous effort

MURDER CHARGES FILED AGAINST EG.

CONVICTED NATURAL LIFE INCARCERATED.

END IF A SAD STORY.

LE TIME, DA PREP TIME, court appointed attorneys, judicial time

FAR IN EXCESS OF 1.4 MILLION DOLLARS.

MOST OF WHICH COULD HAVE BEEN MUCH BETTER SPENT IF DCF HAD REMOVED LUCAS AND MH A TEAR AGO.

There is no CINC case re:the older boys. A custody issue yes and parental rights may be terminated or visitation stopped etc but CINC means no parent is suitable and her ex has full custody and has proven to be a good father...

You think they'll wait to file charges re Lucas until she's served her time on CE? What if she's acquitted? Do you think they'll file charges right away or she'll go home and they'll wait to file charges?

i laid out my opinion of timeline for all 4 legal issues. da giving le time to compile best evidence for Lucas murder. Highly unlikely she’ll be acquired in anything. Possible but unlikely.

Thank you for stating this....it would be a disservice to other states and communities to focus outside of their own areas. This happens frequently and everywhere. It is especially a top priority news topic right now in Kansas, precisely BECAUSE the system is currently being closely scrutinized and revamped. There is a large state wide task force recently formed and working on the issue. Those who are concerned by the number of publicized cases in this area should be aware that it happens every day all around them....in every state....but most do not even cause a blip on their local news sources. This is because it is so common, plus the fact that child welfare cases are handled with as much privacy as possible to protect the children. If there are those motivated to help, please look at resources to do so in your own area. Become a CASA volunteer, find a summer recreation program in a local park that needs volunteers, or a clothing bank that provides free items for children, a church food bank, etc. ALL communities need as many eyes as possible focused on their local services and the children they serve.
