Whatever money he has left in his Estate could still go to the families of de Abreau and Furtado in a wrongful death suit...he does not need to be alive for that civil suit to take place. Maybe Hernandez had a reality check that his daughter would grow up dirt poor for the rest of her life and with the stigma as her father as a killer...he may have been found "not guilty" in court but he was definitely "guilty" in the court of public opinion.
I think the hope Judge in Lloyds civil case will settle with the family rather then get into further legal issues and petitions.
I am not so against the abatement law but I think more safeguards need to be put into place in terms of restitution for the victims who will most likely file civil suits or, if that money isn't used for restitution, to provide for any children he or she may have (put in a trust where mom/dad has no access). I think once a person has been convicted, most people (including many victims I have worked with in an prior high-profile case in MA, were content the individual was found guilty, considering he was not even charged with all of the crimes he committed, and the fact he was dead offered some comfort...)
Kraft is a classy individual. If he has to pay out the rest of Hernandez's bonus, he will. Then again, I would not be surprised if he has not set up a small trust or something for Hernandez's daughter (and I would expect we would never know, because he is that kind of guy) because she is just as much a victim of this as the three who lost their lives.
Finally, there should be a law on how long a person can be Excector of an estate before they start making big financial decisions especially when a sudden death occurs. Especially when the newly named executor is the defense attorney who had just finished defending your case...If Hernandez was so close to his brother, why isn't he Executor and why isn't he contesting this?
Instead of fighting over brains and belongings, his family should be having the will examined. I m sure Hernandez signed a lot of documents...did he actually read what he was signing? How much of his estate is going back to Baez in legal fees? And most important, when was he named Executor?
