WORCESTER - A Worcester Superior Court judge has ruled that the murder charges against a Blackstone mother who lived in a house where authorities found three dead babies will stand.

These poor children. It sounds like the older of the "hidden" children is still in pretty bad shape. This case makes me more outraged than any other case I've ever read about on Websleuths (or anywhere for that matter). I have never been one for pitchforks and town squares.....but ugh. :kickcan:

It will be a large road to recovery for those kids. I pray they are still able to be emotionally and intellectually rescued. :grouphug:

Oh my........:gaah:

Frison noted the 3-year-old was found with maggots in her earwax, with the back of her head flat and that Murray referred to her in an interview as "it."

This case is absolutely unbelievable. All these months later, I am still floored by it all. I hope the DA goes for the max punishment possible on all 6 counts!

Oh my God... That is so horrendous... I'm itching all over just thinking about it :(

This made me cry so hard. That poor little angel. The fact that she referred to her as "it" does anger me.

I am obese now, but when I was 5"7, 190 and wore 14 I was not obese, my BMI was 28. ppl are built differently. and im not sure why this needs to be pointed out.

Off topic - I have the same height and clothes size and I am obese. If your BMI is over 30 (so weight over 190 pounds), you are medically obese.

when does this one go to trial?!

also would like to see a comparison (never gonna happen, but i'd like to) comparing the 6 yo girl from VA and the 3 yo girl in this case. The 6 yo seemed to do really well and was older with serious neglect. The child from this one is 3 and seems to be doing not so well. I followed 'the girl in the window' pretty close as well.. a 6 yo in FL who was severely neglected. Her adopted parents put out a book. She didn't learn to speak, but is able to feed/dress etc herself. The effects of early childhood neglect interest me tremendously.

"BOSTON - The state’s highest appellate court has ruled - against the Commonwealth - that a hearing to determine the validity of a search warrant will be held in the case of a Blackstone mother accused of murdering two infants."

"....A Franks hearing, a court proceeding originating from a 1978 Delaware case, is to determine whether authorities made false statements in a search warrant affidavit."

"...On Monday, when informed of the ruling, Murray's attorney Keith Halpern said the purpose of the hearing “is to develop the facts that are relevant to the motion to suppress the fruits of the search

(BBM) This guy...Oy! Sorry, Mr. Halpern, the "fruits" of that search have been suppressed enough. It's time for this woman to go to trial (scheduled June 7)! However, since the Frank's hearing is weeks away, according to the article, I bet this gets pushed again. :gaah:

Loopholes!!! I'll give Halpern this much, he's determined to make everyone believe EM is crazy. Before it was PTSD/trauma from an abusive partner. I'd believe the PTSD/trauma label before an insanity defense. There was nothing that indicated, to me that (was reported or sleuthed), she wasn't in control of her faculties. She seemed well enough to do many things that made this whole thing evil...just plain evil.

So, defense can't drum up enough support for either of those things - now, now we go after the officers and "higher ups" that issued and served the warrant. I'm definitely looking up how many times DNA testing has been/required to be completed before issuing a search warrant in a suspected child abduction or child trafficking situation. I feel LE did a great job in this case. For them to have witness and experience, first hand, that house of horrors only to have their integrity challenged....I can't "stay" on this case like I used to, because it makes me so angry. We're coming up on two years - enough already!

EM's trial is supposed to start June 7, 2016. RR is May 23, 2016.

Here is the latest (June 20th) that I could find on this case. I hope they cover it better than they have been in the future when things start picking up.

I wish there was more information available on this case. I haven't been able to find anything recently. Anyone else? I'd love to know how all the surviving children are doing now.

Ramon Rivera, 39, formerly of 23 St. Paul St., Blackstone, faces several charges, including two counts of assault and battery on a child causing substantial bodily injury.

His lawyer, Nicole Longton, penned a motion to dismiss the charges in August, claiming that Rivera never had custody or care of the two neglected children – a 3-year-old and 5-month-old - found living in the home.“Although he claimed that she said no, when police interviewed him, he said that he believed (the children) were his children,” the prosecution writes.

Prosecutors say Rivera "did nothing to alleviate the dangerous conditions" the children lived in with their mother, Erika Murray, who's also charged.

Worcester district attorney's office confirms Erika Murray's attorney filed a motion last week, which contends one of the search warrants resulting in the discovery of skeletal remains of three infants didn't establish probable cause.

The search of the home, Halpern wrote, exceeded the scope of the search warrant, which he called “vague, overbroad and fatally defective.”

The hearing on a motion to dismiss two charges of assault and battery on a child causing substantial bodily injury was held in Worcester Superior Court Monday, as lawyers for Ramon Rivera argued that he never had "care and custody" of the two children...

Rivera, who DNA tests prove fathered all seven children - living and dead - "had no ability or opportunity to appreciate his rights and or responsibilities and that was entirely because of the deception of Ms. Murray," Longton said...

Monday, the state was accusing Rivera of "willful blindness" to the fact that two starving children were being kept in filthy bedrooms.

BS! Didn't they live in a very small house and he hung out in the basement? Allegedly. How do you not hear babies in a small house? It seems they would make noise at least until the silence of constant neglect sets in. Grrrr!
