It was still unclear as of late Friday which parent would be tried first.

Pontiac — Jury selection has begun in Oakland County Circuit Court for the nationally watched trial of Jennifer Crumbley, the Oxford mom being tried on four counts of involuntary manslaughter in connection with a mass shooting her teen son committed in 2021.

Jennifer, 45, and her husband, James Crumbley, 47, are both charged with involuntary manslaughter in connection with the shooting. She and James will be tried separately, and their trials mark the first time in the country's history a parent has been charged with manslaughter charges in connection with a mass shooting.

Oakland Circuit Judge Cheryl Matthews will preside over the trial, which is expected to last three weeks.

Pam Heiligenthal, Matthews’ staff attorney, said they called in a pool of 340 jurors for Jennifer Crumbley’s trial, which is larger than usual. They will be seating 17 jurors starting Tuesday morning: 12 for the actual jury and five alternates, she said...

"Early in the court process, the Crumbley parents asked to have the trial moved outside of Oakland County because they feared they wouldn’t get a fair trial from jurors so close to Oxford High School. That request was denied.

“As a general rule, if a juror is able to set aside preexisting knowledge and opinions about a case, that is sufficient to support denial of a motion to change venue,” Oakland County Judge Cheryl A. Matthews said."
 

Jennifer Crumbley wants the judge to order her son to testify at her trial, along with three psychiatrists he spoke to following the deadly mass shooting he carried out at Oxford High School in 2021, according to a new court filing.

While waiting for jury selection to begin Tuesday, the filing shows, the mom got bad news at 9:29 a.m. That's when her lawyer got an email from her son's lawyers, "confirming that the shooter will not waive any privilege or confidentiality." That means he doesn't want any of his medical records used at his mom's trial on confidentiality grounds.

That would mean whatever he said to his psychiatrists is also off limits — though Jennifer Crumbley's lawyer has asked a judge to order the doctors to testify, maintaining her client will not get a fair trial without their testimony, or the testimony of her son.
 
Can you appeal a case when you chose to plead guilty?

Can you refuse to testify against your parent, or is that being in contempt?
I'm another interested in Ethan's appeal after pleading guilty. Could he be appealing the sentence of LWOP?

You cannot appeal your guilty verdict when you yourself pled guilty. You can appeal it if a jury found you guilty.

Ethan's attorneys are appealing his LWOP sentence.

Good questions. I'm also wondering how James will get a "fair" trial when the outcome of Jennifer's trial will be known prior to his. :confused:

It's interesting - if Jennifer blames James, and she is found guilty, does he still get a fair trial? It's hard to imagine his jurors not finding out that she was found guilty. Can they really leave that out of their decision regarding James' guilt?

On the other hand, if Jennifer blames James and she is found not-guilty, will his jurors subconsciously think, well then he must be guilty?

Then there's subconscious beliefs about gender roles -- will their roles as parents be seen as the same by both juries? Or is one of them more likely to get the benefit of the doubt or more likely to get the blame?

It's possible one will be found guilty and the other not guilty, and that's mind-blowing to me.
 
PONTIAC, Mich. — School shooter Ethan Crumbley, 17, is appealing his life sentence for murder, and his lawyers will encourage him not to testify if he is called as a witness at his parents' trials, one of which opened Tuesday in a Michigan courtroom.

The filing Monday from Crumbley's new legal team came as defense lawyers for his mother, Jennifer Crumbley, began gearing up for her trial after she was charged with involuntary manslaughter in the deadly 2021 shooting at Oxford High School. Her lawyer, Shannon Smith, has previously said she planned to call Ethan Crumbley, who was 15 at the time of the shooting, as a witness.

It was initially unclear which parent would be tried first, but Crumbley's father, James Crumbley, will face a separate trial for the same charge at a future date.

"Given Ethan Crumbley's ongoing appeal and the substantial overlap in the subject matter in these three cases, we will advise Ethan to invoke his right to remain silent, should he be called to testify in either pending trial," his lawyers with the State Appellate Defender's Office wrote to Oakland County Circuit Judge Cheryl Matthews...

In Michigan today covering the trial of Jennifer Crumbley, mom to convicted mass shooter, Ethan Crumbley. Parents Jennifer and James face involuntary manslaughter charges for failing to intervene before Ethan shot four students and wounded 7 others in 2021.Breaking this morning: Ethan Crumbley will appeal his conviction of life-without-parole and his lawyers have advised him to remain silent if he is called as a witness during his parent's trials.



The prosecution's argument: Jennifer and James are partly responsible because they bought a gun for Ethan to use freely, they ignored his repeated pleas for help and they refused to take him home from school on the day of the shooting, when teachers discovered this worksheet with drawings of a gun, dead victims and the words, "The thoughts won't stop. Help me."

The defense will argue that the shooting that killed four students and inured seven others, while a tragedy, was not foreseeable by the parents. Ethan Crumbley had no documented instances of violence and is said to be a loving son, grandson and dog-owner.

Below is the letter the State Appellate Defenders Office filed to Judge Cheryl Matthews, informing her that Ethan Crumbley plans to appeal his conviction and that they are advising him to remain silent if he is called to testify against his parents.

Yes, the trial will be livestreamed but jury selection will not. Jury selection is expected to take a few days.
