I don't know how many times a mix up like this (taser/gun) has happened but I've read a lot of news stories of police officers being dragged by a motorist fleeing arrest. (Resulting in an officer's death or serious injury). Maybe this is simply comparing apples to oranges, though??

I’ve seen this too but I don’t think this guy was trying that or they surely would be using it in the defense. I know that officers have enough stuff to carry around but I’ve wondered why not have a smaller version of the “stop stick” to place at a tire when the car is stopped? If the car pulls away it won’t get far.

Jurors in ex-cop Kim Potter's manslaughter trial will need to decide which police use-of-force expert they believe

When jurors in former Minnesota police officer Kim Potter's manslaughter trial begin deliberations, they'll have to weigh conflicting testimony about whether her actions in the fatal shooting of Daunte Wright were justified.

The prosecution rested its case on Thursday morning, after a police use-of-force expert testified that Potter's use of deadly force during the traffic stop was "excessive and inappropriate."

The defense then called its own use-of-force expert, who said Potter's actions were "consistent" with Taser training, to the witness stand.

On Friday, Dr. Matthew Miller, a clinical neuropsychologist and professor at Florida Atlantic University, explained to jurors how officers can confuse their weapons through what he called "action errors" and "slip and capture" errors.

Miller explained to the jury that an "action error" happens when an intended action has an unintended effect, such as incorrectly writing the date when signing a check after the turn of a new year. Action errors have nothing to do with "outside interference, willful neglect, or conscious manipulation," Miller said.

"Slip and capture" errors are a subsection of action errors coined by a police psychologist, Miller said, and these errors occur in police work when officers are involved in fast-moving situations with a heightened sense of stress.

The most common example of a slip and capture error in police work is weapon confusion, according to Miller, who said confusing a Taser for a gun is "the most typical example of what's meant by weapon confusion."

Would it have happened to a white guy? Any examples?

I know of a white guy who was killed by police. The cop put gloves on his hands, lifted them up and said, "See these hands, they are getting ready to f- you up", and then they beat him to death. His name was Kelly Thomas. Nothing happened to police even though it was all caught on video.

I think bad cops will go after any color or race as a power high. I don't think Kim Potter is one of the bad cops and the color of Duante's skin was irrelevant to her. imo

State asks Potter if Wright attempted to assault Officer Luckey, or said that he had a gun, and Potter said he didn’t.

State calls up video of Potter’s body camera footage right before shooting, and Potter is becoming increasingly emotional. State is asking about a piece of paper that she took from Wright and asks if she’s holding it in her right hand. She says she is.

After the state shows more video of the seconds before the shooting, and asking if Potter was holding a pistol in front of Wright, Potter begins crying and the judge asks if she needs a break.

Potter agrees that she needs a break and court takes a break.

I agree, any race but not economic status. LE in my area treats the poor and wealthy quite different tho they will swear the opposite.
 
I found a comment by one of the TV attorney commentators interesting and had not given much thought to the dueling experts...Seth Stoughton who proudly declared he serves as an expert without charge and then you have defense expert Stephen Ijames who disclosed a flat rate of $30,000.00. The consensus was the paid witness had more credibility . In this case I tend to agree with that assessment. I think the State got what they did not pay for. Any thoughts on this?

Stephen Ijames was not paid (defense). Seth Stoughton was paid $295/hour (approx $10,000) (prosecution). Both were testifying about use of force.

Dr Laurence Miller (psychologist) (defense) was paid a flat fee of $30,000.00.
 
I dont know that prison is even the answer given that she has no criminal record or -I think I heard today- that she doesn’t have any kind of discipline problems at her job. I have a lot of sympathy for her since one of my greatest fears is having to use force to defend myself and living with that. I agree, it’s a tough situation. I even lean with her a bit because this man was in a car that could be driven, as a weapon, if he wanted. I would feel much better about her getting off light had she pled it to something.
She may not have been given an acceptable plea offer. imo.

How many times has a mix up like this happened (if you know). I can think of one other time but I think that involved a volunteer police officer. Any other instances like this one? Some police officer or supervisor who testified in this trial, said he didn't know of any other times this had ever happened.

In a rebuttal, prosecutor Matthew Frank told the jury there is “no mistake defense.”

“The judge will not give you an instruction that says a person is not guilty if they commit a mistake. That’s not the law no matter how often the defense says mistake,” Frank said.

After listening to closing arguments, the jury deliberated for five hours Monday afternoon before adjourning for the night. They will continue to deliberate Tuesday morning.

Jury is sequestered during deliberations.
