I keep wondering why they haven't charged JN with a felony probation violation. Clearly he violated his release multiple times. I would think that if they are buying time for whatever reason before charging him with murder, a federal felony probation violation would hold him longer than the tampering charge. I also question as to how often this agent checked on JN. Apparantly not enough considering how much damage he did in the short time he was released from prison.

Good thought regarding the probation violation. Law enforcement must have a strategy in mind on how they intend to handle any possible future charges. I have to hope that the silence is to protect their case. JMO.

Actually it isn't, not where I'm from. They wouldn't issue a bench warrant if the person is in custody elsewhere and they know it because the person did not purposely fail to appear.

A writ of habeas corpus is what we do here to have the another jurisdiction transport to the court date.

KINGSTON, Mo. - A Missouri man tied to the disappearance of two Shawano County brothers waived his right to a preliminary hearing in a related case and is scheduled for arraignment next month.

Nelson was bound over in Caldwell County Circuit Court in Missouri for an arraignment on Oct. 7, when he is expected to enter a plea to the tampering charge. He has been jailed without bond."

We are all here for justice. Opinion is opinion. Being of sound mind and body which is highly suspect I search for facts. Although JN is highly suspect and TSF is alleged to be a co-conspirator at this point we have many unanswered questions. I pray that LE has come up with the facts. JN has many issues at hand Tampering with Vehicle, Kansas Lawsuit, possibly once we are informed of the DNA found a couple of murder charges and possibly the abandonment of a corpse possibly 2. Not sure what the charge would be for doing what we all think he may have done? Any response here is greatly appreciated. In respect to the Family of those whom have lost.

Missing Wisconsin brothers: Man tied to disappearance pleads not guilty to vehicle tampering charge

KINGSTON, Mo. - A Missouri man tied to the disappearance of two Shawano County brothers pleaded not guilty Monday morning to a vehicle tampering charge.

Garland Joseph Nelson, 25, is accused of tampering with a pickup that Nicholas Diemel, 34, and Justin Diemel, 24, rented during their business trip to Caldwell and Clinton counties in Missouri. Nelson drove the truck from his farm and abandoned it in a commuter lot on the day the brothers went missing in July, police said.

Nelson waived his formal arraignment in Caldwell County Circuit Court in Missouri and was granted his request for a change of judge, according to court records. The Missouri Supreme Court will assign Nelson a new judge. He has been jailed without bond.

Nicholas and Justin Diemel were reported missing after they failed to board their July 21 flight back home to Wisconsin. The brothers own Diemel's Livestock in the Shawano County community of Navarino.

Clinton County, Missouri, Sheriff Larry Fish said authorities found human remains July 30 on Nelson's farm. No charges have been filed in connection with the remains.

Caldwell County Sheriff's Office Maj. Mitch Allen told USA TODAY NETWORK-Wisconsin on Sept. 16 that the sheriff's office has turned over more evidence to the prosecuting attorney and expects additional charges to be filed in the case.

Nelson is also facing charges in Kansas where he is accused of transporting disease-infected domestic animals across state lines and endangering their food supply.

I ran across a post that said JNs mother is selling stuff off the farm, I posted the link to craigslist add. My question is, can she sell items even though there is still an active investigation going on?

BRAYMER, Mo. —

The Caldwell County prosecutor and sheriff will hold a news conference Wednesday morning to announce new charges against Garland “Joey” Nelson in connection with the July disappearances of Nick and Justin Diemel, a source told KMBC 9’s William Joy.

Nelson currently faces tampering with a motor vehicle charges in connection with the case. Nelson pleaded not guilty to the charges in early October.

Nick Diemel, 35, and his brother Justin, 24, were in Braymer, Missouri, on business when they went missing on July 21. According to court documents, Nelson admitted to moving the rental truck, which was signed out to Nick Diemel in the rental agreement.

Authorities in Braymer said they discovered human remains during their search for the missing brothers.

Clinton County Sheriff Larry Fish said authorities were assisted by a forensic anthropologist from Frontier Forensics who confirmed that human remains have been located at the search area in Braymer.

"The cause of death has not been determined," Fish said. "This is still an active investigation and the human remains have not been identified at this time. Investigators are still working with Frontier forensic doctors to figure out what took place."

Authorities said the missing persons investigation in this case was changed to a death investigation in late July. Fish said he could not comment on how or where the remains in Braymer were found.

Documents state Nelson eventually told authorities when he arrived back at the farm, he found two bodies believed to belong to Nick and Justin Diemel, each dead and stuffed inside a 55-gallon metal barrel in a pole barn just south of the residence.

The affidavit states the bodies were moved through a pasture one at a time in a skid loader bucket to an adjacent pasture where they were covered with diesel fuel and burned. After they were burned, Nelson said one or both of the bodies were placed in a manure pile by a metal barn. He said a skid loader was used to crush the barrels and the remains were placed elsewhere on the property.

Documents show Nelson said he returned to the pole barn at one point and used a shovel to remove what he believed to be blood from the floor where it is believed the brothers were killed.

During the course of the investigation, Nelson reportedly admitted to having access to and using a .30-30 rifle to kill two small animals July 20. Authorities noted Nelson is a felon.

In the area of the affidavit relating to evidence, authorities state burned human remains were found in a manure pile on the property in Braymer, and based on DNA comparisons, it is believed the remains are those of Nick and Justin Diemel.

Authorities also noted blood stains were found on clothing belonging to Garland Nelson. DNA confirmed that blood belonged to Nick Diemel. Murder charges filed against man at center of missing Wisconsin brothers case
