Barth: She doesn't claim to you at the door or in the car that SETH has done something, 'correct'. In fact when she gets in the car and you go around to another door, Seth is there... she gets out and runs to him. Barth: I think you describe Seth as silent. Gerkin says she doesn't recall and wants to read the transcript.

Witness: Cuz I am ADD and I notice moving stuff.

Attorney: Uhhhh...okay.

Ohhh my.

Barth: the momentous event was you walked in and saw a body on the floor. you described how it was situated, and you drew a diagram.
the underarm is not under her body... I believe it was one arm under the other.

Bombshell...Roberta has ADD #SethMazzaglia

I notice moving stuff too and I do not have ADD.

Once I noticed traffic moving so I stopped walking across the crosswalk.

How sure are you that you don't have ADD? That is some fine noticing that you are describing.

Roberta's brain was on overload and shut down according to her statement. Was she going to short circuit? #SethMazzaglia

Atty Barth: the next event is you say we have to get the bag off her head, you take out a pocket knife… Seth rips them off, and you try to get a pulse. When the bag comes off you check for a pulse, 'yes'. Lets be clear at this point, you’ve just seen a body… here’s what you told investigators, your brain shut down

Is it okay for a witness to ask the attorney 'Where is this going?'

IMO that is improper. If the witness is answering truthfully then there should be no apprehension with where this may be going and it is up to the lawyers to question not RG.

Someone needs to gag this wild card.

Barth: while you were able to tell this jury that you were surprised no one else tried to check her pulse… you had actually told investigators that both Seth and Paul had. ‘Where are you going with this?’ … it calls into question the accuracy of your testimony

:floorlaugh: It could have had me wondering about the ADD angle but this happened years ago when I lived in NYC and there were about 40 ish people at the same corner (downtown Wall st area). Everyone stopped so unless there is something called 'group ADD' I think I'm ok!

Thanks for asking! :loveyou: :floorlaugh:

Wanna bet that ADD is self diagnosis? So say someone with a big mouth, like me!, met her and something like 'earth to Roberta, earth to Roberta, come in Roberta' she could answer 'it's my ADD'.

Yeah, I was hoping he'd pull a Juan and tell her to nevermind where it was going, to just answer the question. This guy is a little too conciliatory.

I don't think ADD means what she thinks it means.

She annoys me more than so many witnesses I've seen in trials. Glad I'm not a juror because I would disregard her whole testimony on account of the cuckoo

I've followed quite a few televised trials and this is the first time I firmly believe everyone who has heard any of this testimony should be awarded a medal. And the jury, court and those poor attorneys should all get a paid two week dream cruise for enduring this.
