Barth says posting their comings and goings puts them in the position to testify. He says it was the day after the public defenders pig roast... at his family's farm... that the situation with Seth was fluid... that he shouldn't have to testify what they talked about ... simply to rebut their own appearances. He points out the lead counsel had not been assigned yet... so there wouldn't have been any discussion of the facts of the case, but he doesn't believe he should have to be put in the position to rebut....

Hinckley calls it peculiar that defense would bring this up now, since the defense injected themselves in the trial in opening statements. That attorney-client privilege was broached by the defense team itself, including by calling Lisa Greenwaldt. He says the state would not do that.

Moving for a mistrial...... Again.

They're doing what all defense teams do -- planting those little seeds for appeal later. Never hurts, however futile it may be. Sometimes it does work itself into an appeal point... Using the shotgun approach -- lots of little shots with one big boom, or maybe not so big in this one.
 
Well, Barth called her. What did he think would happen? Why no objections yesterday?

:floorlaugh: I try to stay focused but for some reason I tune Barth out after a few minutes when he is off on a tirade. Like right now when he is pulling a filibuster! What does he think he is up front and center and the world is his stage? Does he really think a bunch of flowery phrases strung together, ad nauseum, will break the other person's sanity and he will get his way?

Hinckley says the records show that Lisa Greenwaldt's memory does not match the facts that she met with defense team at the jail on the 15th and not the 14th... and with an Atty Sloan and not Davis.. and that it points to her reliability and credibility.

Barth sure seems to have a lot umm and ahhs right now.
 
Barth is talking thru the machinations of their schedule that weekend... cleaning up from the pig roast on the property... going in and out of the jail... and he says the actual records of comings and goings are inaccurate, that he's listed as Anthony Barth... and Mary Davis and not Melissa... the notion that the jury should be invited to speculate... is ... ?

Barth can't have it both ways - he claims to have told KM repeatedly that his office was representing SM but she talked anyway. Now he wants to say he was not representing SM "officially" & hadn't taken his statement before talking to KM.

Is that right?

Agree! I can't believe that for two days a few weeks ago, I was beginning to admire him. Whatever was I thinking?

I liked him going after kat because I dislike kat and her 'deal' much more but Barth attacks everything like it is his last meal. I wish he'd reserve his 'fights'.

This is exactly how I feel, his witness and employee didn't hold up so well yesterday. So now he is crying fowl. I wondered last night if she still had a job.

I guess that should be foul not fowl!
