Barth says posting their comings and goings puts them in the position to testify. He says it was the day after the public defenders pig roast... at his family's farm... that the situation with Seth was fluid... that he shouldn't have to testify what they talked about ... simply to rebut their own appearances. He points out the lead counsel had not been assigned yet... so there wouldn't have been any discussion of the facts of the case, but he doesn't believe he should have to be put in the position to rebut....

Barth knows things are not looking good. He is just doing his job. It sure sounds like some rebuttal is likely and jury getting this case today probably not happening or tomorrow if rebuttal is extensive. Judge really wanted to keep this moving as they are over the time they told the jury. I don't know why they don't over estimate the time they will be in trial and then if less great. It seems they always give them the minimum and then get nervous when it goes over. Its summer and people have plans and the judge is aware of it but I would think the complete trying of the trial including rebuttal trumps vacation.

Barth can't have it both ways - he claims to have told KM repeatedly that his office was representing SM but she talked anyway. Now he wants to say he was not representing SM "officially" & hadn't taken his statement before talking to KM.

Is that right?

On prison recorded phone calls to KAT at this time, Seth claimed he had not made a decision on whether to choose the PD's office (Barth) or a private attorney. He was about to use a tarot reading to help him make a decision.

I'm glad he didn't though.
If the judge denies the mistrial, I wonder if they might be more compelled to put Seth on the stand.

I wanted to personally thank you also. Living in the middle of the country I don't understand why some churches focus so much on going to foreign country's when we need ministry also in the U S.

In the real world, that doesn't consist of Public Defender Pig Roasts, wouldn't his office of called the police as soon as KM started blabbing and said to them, " hey, you guys better get over here, I got SM's girlfriend confessing to the murder in my office right now"?

can't make this up...and I believe she is not just a judge but a supreme court judge or something very high up. And...I'm sure this happens non stop every day in every state.

So then why did the Judge adjourn? Did he go lay down because Barth gave him a migraine?

I tend to doubt the judge is going to allow the rebuttal chart of the comings and goings of defense counsel at the jail, just opens up too big a can of worms. Motion to dismiss will likely be denied and probably no curative instruction to the jury (what could judge tell them?).
