A defense lawyer with no affiliation to the case has told The U.S. Sun that key evidence (e.g., Haspil being armed with a taser) points to Saleh's murder being premeditated and that Haspil's defense team will likely argue self-defense.

Haspil is expected to appear in New York Supreme Court on July 20.

How bizarre. What is going on with this case? Is it normal to take this long, 3 years and still no idea of when a trial might take place??

I feel for fahims family, they have been waiting for justice for 3 years and are still in limbo.

I wonder what all these miscellaneous hearings are all about? It’s been 3 years. What is actually going on with this trial? ???

Haspil's court appearance was the latest hearing in a prolonged case that has been delayed due to the Covid pandemic. Included are the first images we’ve seen of him since his arrest in July 2020.

First of all - the "ninja" description is simply tabloid fodder. The kinds of masks many wear in NYC amidst Covid-19 can easily look creepy; ninja-esque. Some turn them into works of art, or draw skulls on them.

Mr. Saleh had just returned from a run, and was likely surprised to see his (I believe former?) employee who was on a payment plan show up unannounced (so it seems) and enter the lift with him.

The ninja description refers to the fact that he was dressed all in black, i.e. a 3-piece suit and face mask. He was on a mission to kill so I can't believe it would be either "creepy" or "ninja-esque" as it would only draw attention to himself. IMO it was in all probability a plain black mask as these were "hot" during the pandemic and very commonly worn.

Why would TH fumble/fake using a key fob if FS recognised him?
 
Sawing or chopping someone up is a standout in the realm of depravity and says a lot about the person wielding the blade. Experts and historical records indicate there are few, if any, cases of a body being dismembered without the victim being murdered first. One thing experts do know is this: Dismembering a body is a strenuous task that’s almost always done to hide evidence in a way even most hardened criminals couldn’t stomach.
 

Wow. Excellent new article with a ton of new information!
  • TH allegedly embezzled $400,000.
  • Four months after being hired, TH allegedly opened a PayPal account under the name Nethertek Switzerland, which would mimic normal business transactions for FS’s businesses. TH continued to steal money from FS after being fired using this PayPal account.
  • TH allegedly searched for saws and “Where are your joints?” and then downloaded an image of a skeleton on his iPhone while inside FS’s apartment around the time of the murder.
  • Any time a taser is fired, “confetti” identification tags are ejected from the device. While footage shows the masked killer vacuuming up the “confetti” that was ejected when tasing FS, one piece was recovered from the scene. That piece can be directly linked to a taser that TH signed for at his home a month before FS’s murder.
  • TH allegedly left the crime scene to purchase a charger for the electric saw, which ran out of battery power mid-cleanup, after leaving the one previously purchased at home. It was coincidentally during this trip that FS’s cousin arrived at the crime scene and notified authorities. TH is allegedly seen on surveillance footage arriving back at the building and standing in the crowd outside.
  • In TH’s storage unit, law enforcement recovered a backpack filled with fire starting and accelerating materials, which law enforcement posits may have been used to burn evidence if the cleanup had not been interrupted.
  • TH is allegedly caught on surveillance footage the evening of the murder throwing a bag into the Hudson River in Jersey City, NJ. After a search, the bag was not recovered by law enforcement.
  • TH allegedly used FS’s credit card after the murder to buy three gold balloons (two “2”s and a heart). The party supply business had TH’s cellphone number on file for the purchase, and the delivery address was an Airbnb where TH and his girlfriend had recently moved in and were celebrating his girlfriend’s 22nd birthday.
  • TH may seek an extreme emotional disturbance defense, which could push the trial into 2024.
  • The next court date is September 28.

I have NO IDEA "what" a "Control" hearing is.... so looked it up.

What is a Control hearing?
It means that something will be happening in the future (hearing or trial or even motions) and that this is a control date to pick the future date. Often this is done b/c the judge doesn't want too long between court dates.

The judge wants to "control" his calendar to make sure he knows what is going on with each case and to make sure cases don't get postponed endlessly for no reason. A control date is for both sides to let the judge know what is happening and to plan out what will be happening in the future.

The personal assistant charged in the home-invasion killing and dismemberment of his tech-CEO boss is set to argue at trial that he was "emotionally disturbed" in the weeks surrounding the grisly slaying, it was revealed in court Thursday.

News that Tyrese Haspil, 25, was considering what's called an "extreme emotional disturbance" defense in the 2020 killing of Fahim Saleh was first reported by Business Insider in August.

If Haspil could convince a jury he was emotionally disturbed — a tall order given a trove of video and forensic evidence pointing toward weeks of premeditation — he'd face far less prison time.

A successful defense of extreme emotional disturbance would reduce the top charge to first-degree manslaughter, which carries a sentence of anywhere from five to 25 years.

A trial date has not yet been set. But in a hearing Thursday, the lead Manhattan prosecutor, Linda Ford, offered a progress report, saying experts from her office had completed two psychological examinations of Haspil in preparation for fighting his emotional-disturbance defense.
