Court is adjorned for tonight. I'm pretty sure the judge said that he will render his decision tomorrow at 10 AM. The audio was very low and very hard to hear.

From what I've seen and read - this judge has no other choice but guilty!!

Guess we'll see tomorrow.

I certainly don't envy this judge. This is very complicated, with levels of guilt and innocence, and levels of responsibility for what happened.

This is not black and white imho.
 

I haven't followed this case much at all - all I know is it's greatly divided the town.

Maybe these girls were nice friends. They knew her for awhile and had a history with her. This isn't an indication they were glad what happened to her - but when you're that age, you have to pick your crowd and if there are people who might be influences in bad directions, you probably should decide to distance yourself.

This case is just not clear cut, and it may be the former friends had seen a lot of prior evidence that convinced them it wasn't safe to be around her.
 
I wrote a huge reply about this...and it disappeared.
This is a sick twisted religious town. I have a 'friend' who is an 'esteemed ' educator at the college...you know which college im talking about...he blames the girl. He is a father of 8!!! I was stunned. Ruined our 20+ years of friendship....

Please let there be justice for this girl....

It's often amazing what we don't know about our friends, isn't it?

I guess I am unsure why some are saying it's not clear cut. I understand that her former friends might have ended the friendship because she drinks to much or ditches them to hang out with guys.

But to my knowledge she was not an active participant in her clothes coming off, sexual activities, being photographed. If at the beginning of the evening, while sober,she said she enjoyed or wanted these two boys to use her body any way they wanted then what was done to her that evening was with her consent. But she was just present. She was just there, drunk. This was not a pre- planned sex fantasy among consenting parties.
Jmo parents, and adults, need to be honest about sexual activity. Before you engage in any sexual activity consent must be given. In relationships, traditionally, sexual activity is gradually worked up to. With the more casual sex atmosphere today, getting consent is more important. Your level of what can be done might be completely different than your partners. Is this okay? Can I?
And never, never, never participate in any sexual activity with someone who is under the influence unless boundaries are set beforehand. BTW if you can't discuss sex with your partner then you shouldn't be having it. Jmho.

And maybe they were tired of babysitting her. Where is she, who is she with, etc. Maybe she gets drunk at parties often. I knew many, many girls and guys that did when I was a teen and in college. Good ole Ohio ;). It's no fun party after party weekend after weekend taking care of a drunk friend (college age and legal). I don't know if this was the situation in this case though.

That's what I was thinking, Yoda. Certainly no one wishes this awfulness on her, and it's awful that she was a victim. But I did have friends that I had to babysit if we went out, and after several of these episodes, we'd stop doing that. Sometimes, "nice friends" had to say enough was enough.

If you haven't followed this case much, how can you have any opinion as to whether it is clear cut or not? Because the town is divided?
The town is divided because they don't want to admit their "stars" are delinquents.
It is very clear cut. She was drunk, she couldn't consent. Clear as day!

It's just not. That's why the town is completely divided. It's not about football. It's about boys and girls, and attraction and availability.

I'm not trying to be argumentative or irritating. It's a divisive issue. You don't feel divided, but in fact, the public does. And it's not about football. It's about reality of sexual behavior - pure and simple reality. It's about teenage boys and teenage girls, and the dynamic between them.

Agree when both parties remember what happed the next day. MC testified that JD was "passed out" when he took a video. That is not a dynamic between boys and girls that is acceptable to most people and it's not acceptable by law.

I know you are not trying to be argumentative and you are just stating your opinion and that of others. This saddens me deeply. I have daughters and a son and this is not a reality of sexual behavior that is acceptable in their circle of friends and I suspect not in a lot of teenagers. The texts and comments on the video of the guys that said this is wrong proves that.
 
I didnt get a chance to follow any of the testimony today. Rape cases are always very difficult and you never know how they will turn out. In this case, it comes down to whether she was capable of consent or not and when. We dont know what those photos show and we dont know how the witnesses looked. So we really dont know how this will turn out. In my opinion, based on the limited amount that I have seen, I would say both boys should be guilty. In my opinion, I dont think its even close. From what I have read from the testimony today, most of it was irrelevant. But we will see.

How can you have an opinion just jumping in last minute?
Because it isn't painfully clear by just reading a little bit?

If she is not able to consent at the time of sexual activity it is rape. pure and simple. A person still has the right to say no...at any time. If not able to say anything it is not consensual.
