I wonder what #2 refers to and why it is dated 7/16/09.

I think to prove that he started his examination a long time ago for discovery reasons. I seem to think I heard the state want to find out why these were late add's and AF saying "we just got the final report".

Now this has me wondering if JBarrett's interviews w/family members and whomever else started #2s interviews and will what infomation JBarrett under covered match with what the current Drs. discovered.

I seem to recall that ICA and JBarrett were really close, considering all the times they spent together for months on end.

Anybody have a clue what the "MPH, MOV, WMV" stuff is?

I wonder also!
The records which were not attached to the Motion that was filed with the Clerk appear to refer to evidence in the Inmate's case, which the Defense had the mental health doctors look at, or which the mental health doctors created after interviewing the Inmate.

We have not heard of Dr. Weitz being on the case until a few weeks ago, when the Defense filed a motion on March 21, 2011 to add him to the Penalty Phase witness list, then requested he be added to the Guilt Phase witness list the next day.

I went back to see what events happened on or around "July 16, 2009" in this case.
I think the label of "7-16-09" has something to do with the mental health doctors possibly viewing the jail hyperventilating video, or some other material in the case.

George's suicide attempt was January 23, 2009.

The Death Penalty was put back on the case in March 2009.

July 1, 2009 - Judge S. said the jail hyperventilating video [taken Dec. 11, 2008] was too inflammatory to be released and sealed it.

July 7, 2009 - media WKMG filed a motion to intervene regarding the jail hyperventilating video to be released.

July 8, 2009 - Judge S. deferred the scheduled trial date of Oct 12, 2009 and set a Hearing for a new trial date in January.

July 16, 2009 - Motion filed to delay check fraud case and to keep Padilla and crew from taking depositions or testifying.

July 18, 2009 - mitigation specialist Jeanene B visited the Inmate in jail for 3 hours. [JB also visited WITH AL and Mort S. on June 19, 2009 for 1 hour]

Since Dr Weitz never visited KC himself, I'm thinking that maybe he reviewed the mitigation videos and came up with a preliminary report on 7/16/09. If that is the case, the DT was either not eager to use his report or purposely waited until the last minute.

Fridays hearing should be interesting. I hope that this subject of late witnesses is not handled at sidebar, but I think it might be.

They are File Extension for Pictures or Video/Movie files..

.mpg-MPEG Video file
.mov-Apple QuickTime Movie
.wmv-Windows Media Video

That makes a LOT of sense!
Curious to me that Finnell joined the DT in September 2010 for the mitigation phase, and was not able to convince JB to add this psychological evidence/witnesses until a few weeks ago!!!

I'm sure the Defendant was adamant about not allowing her attorneys to insert ANY type of mental/psychological disorder into her case.
Now that they are running out of theories and cards up the sleeve .... they may feel forced to go along with what AL told them to do to begin with?

Back in October 2008 when Baez brought on DP Attorney T Lennamon..they did not agree on this very issue..mental health route...Lennamon wanted to go this route and Baez & Casey objected to it.

And isn't this what Terry Lenamon (sp but you get it) suggested almost from day 1 but got immediately shot down? He strongly recommended the psych defense from the get go.

beat me to it :D ... I posted the same thing.

The other fact that leads to suspicion that the Defense team plans to use the NEW Guilt phase doctors in some kind of Defense theory to offer reasonable doubt that the Defendant did not do the crime, is that the Defense Motion filed on March 22nd, included the two mental health doctors AND the George protester shoving witnesses. The timing of the Defense adding all FOUR of these NEW witnesses at the same time, sent up red flags. Looks like the Defense plans to blame George and use mental health doctors to shore up that Defense theory.

do posters think that they will use the MD's to show Casey DID NOT kill Caylee OR to explain away WHY she acted the way she did for 31 days?

Does anyone think this 'alleged' fight with Cindy on the night of June 15th may be brought up by the DT..Casey was traumatized by both her parents?
Just throwing that out for discussion.:truce:

I'm confused...if Baez goes with a mental defense...will it be used to
a) explain why Casey didn't call SOMEONE when her daughter went missing...or
b)why Casey made up imaginary people (and jobs)...or
c) why Casey killed her daughter?
Where would he be going with this kind of defense?

IMO, it may be to try and explain all 3.
But :dunno:

Does this look like someone suffering from PTSD?

Nope..and her eyes are looking at the camera

Lenamon's reasons for not seeking the death penalty - his thoughts relate to the penalty phase of the trial.

Casey Anthony to Face Murder Trial First
Thursday November 6, 2008
(clip)
Meanwhile, an attorney hired by Casey Anthony's defense team presented a 30-page report to prosecutors outlining reasons why she should not face the death penalty. It points out problems with some of the evidence and argues that the case does not fit the state's criteria for seeking the death penalty.
Extreme Emotional Distress?
(clip). Filed by Miami attorney Terence Lenamon, it is not a public record under Florida law.
Parts of the report, given to the media by Lenamon, may give a clue to Casey's defense at the murder trial.
Lenamon writes in the document that Casey was "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth. Even the lack of emotion after her child's disappearance and the arrest is not normal."
The report outlines several other reasons the defense believes it is not a death penalty case.

Report argues against death for Casey Anthony

Sarah Lundy | Sentinel Staff Writer
November 6, 2008
excerpt:
"Casey Anthony is a unique individual. A close inspection of her case clearly supports not filing a notice seeking death," attorney Terence Lenamon wrote in a report obtained by the Orlando Sentinel."

summary:
- hair and air samples are not good enough for penalty of death
- she has no criminal record, no history of child abuse (of Caylee), crime was not cold, calculated, and premeditated, noone knows how death happened, in the months leading up to Caylee's disappearance Anthony behavior described as erratic and not entirely rational
- reasons why mothers kill their child are complex (Filicide)
- juries are more likely to show mothers mercy
- she was "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth," ... Even the lack of emotion after her child's disappearance and the arrest "is not normal,"
- another woman in Orange County, who beat her 8 year old child to death only got 42 years in prison - and other cases with life sentence (not death)

excerpts:
"Attorney Terence Lenamon now says he stopped representing Casey because he did not agree with the legal strategy of her lead attorney Jose Baez."

"We had a difference in what I believe should have been done with the approach that is mental health related," Lenamon told CNN's Nancy Grace during an interview Tuesday night (watch it).

Lenamon explained he would have had Casey plead not guilty by reason of insanity."

NANCY GRACE
Casey Anthony Defense Ignores Police Tip Collection
Aired December 8, 2008 - 20:00:00 ET

GRACE: Mrs. Lenamon -- Mr. Lenamon, have you seen the photos of tot mom dancing in a mini-skirt and a push-up bra in the days after little Caylee -- Casey --
after little Caylee went missing? It hardly suggests that she`s having a depression or any type of a mental illness.

LENAMON: Well, I disagree with you, Nancy. I think if you`re familiar with
bipolar disorder...

GRACE: I`m very familiar.

LENAMON: ... mania is symptomatic of someone who is not sleeping, who`s acting
irrationally, who`s spending a lot of money, and whose brain thought process is
different from ours. And I think that that could explain some of the things
that were going on in Miss Anthony`s world at this time.

GRACE: Interesting because those are the symptoms of bipolar.

To Jason Oshins, defense attorney. Bipolar is in no way -- while Lenamon is
correct, she exhibits some of those characteristics, she`s never been diagnosed
as bipolar. Bipolar is not a mental defect defense and it is not insanity.

Fifty percent of the people in Manhattan claim they`re bipolar.

Defense Team: Caylee Could’ve Been Poisoned By Chloroform
Posted: 11:18 pm EST November 5, 2008
Updated: 11:33 pm EST November 5, 2008
excerpts:
"But Eyewitness News has learned that behind the scenes, the defense sent 30 pages of documents to prosecutors. In those documents, Casey’s lawyers argued that if Caylee is dead, “it was almost certainly a tragic accident.” The documents also said Caylee could’ve been poisoned by Chloroform or she could have died while she was sedated. They said the cause of death could have been an unwitting overdose of a sedative."

"The defense documents went on to describe Casey as troubled, possibly depressed. They said her behavior had been erratic ever since Caylee’s birth and particularly in the months before the little girl’s disappearance. The documents also said Casey’s lack of emotion after Caylee’s disappearance is proof that Casey is not normal and could possibly be suffering from mental or emotional stress."
(clip)

"Eyewitness News learned that dissention among the defense team may be behind the release of those documents. The death penalty-qualified attorney, who is helping Jose Baez, said he wanted Casey to be evaluated by a nationally known psychologist who was involved in the Unabomber and the Elizabeth Smart cases. The attorney thinks Casey is mentally ill, but we’re told Baez rejected his suggestion."

Yes and he then left or was fired.

Is the 'nationally known psychologist' Dr. Xavier Amador?

Now I lay me down to sleep.....Dear Lord, please, please please let the defense team introduce a shrink to witness list-so that the state can do the same.

Amen

New Docket entries:

04/12/2011 Motion for Transcription Services
04/12/2011 Motion In Limine as to Testimony of Mental Health Experts

Can't wait to read that Limine motion! :great:

So??? Do we get to hear what caused this disorder? What "trauma" did she have?

just a wild guess...by all accounts she was rather normal prior to Caylee. Her refusing to name the father instead making up all sorts of ridiclous lies about trust funds & whose the daddy and such. Maybe she will claim little Caylee was a product of a rape?

Casey seems to make up her own reality instead of living in the real one.
