AZ Lawyer...At what point do the current defense attorneys step back and not represent FJA unless she hires them privately. Is it right after the sentencing, or do they 'stay on' until she hires a new lawyer or the state appoints an appeals lawyer? I also would assume state payments to the attorney stop at some point.

I just get the feeling that FJA will 'milk' the system all she can.

Also, if the Alexander Family file a civil lawsuit, who would represent FJA in that? State appointed lawyers or does she have to hire her own?

Yes. That's the opposite of evidence that she slashed his tires. It's evidence that she didn't slash his tires. Even though the truth is very likely that she did.

According to to the book by Jane Velez-Mitchell, she can over the next day to take him to a mechanic:

Then, also in December, there was vandalism against Travis’ car when his tires were slashed. Even more strange was the fact that, the next day, Jodi called him nonchalantly on his cellphone, and when he told her about his four tires being slashed, she came right over to pick him up for the trip to the mechanic, sort of like the arsonist phoning in about the fire.

I believe they are responsible for filing the notice of appeal (although if she gets the DP it will be automatic). Then they are relieved from responsibility. She will be appointed appellate counsel who will stay on unless and until she hires a private lawyer.

At this time, I believe the state pays only for the first direct appeal. The feds used to pay for post-conviction counsel, but I think that stopped in the 90s sometime.

If she is sued for wrongful death, she will not get an appointed lawyer.

Because her testimony IS "evidence." She doesn't say she "knows" he looked at child *advertiser censored* or strongly suspects it; she says she SAW him look at child *advertiser censored*.

And... if I may interject... according to Joey Jackson, the defense (through the defendant or not) can claim anything they want. They don't have the burden of proof. The burden of proof lies with the prosecution, which makes their job doubly hard; to prove their case, and disprove the defense's.

Some of them are positive it was DR who slashed TA's tires. Wow! If I was a shady salesmen of any kind, I'd be peddling my wares on that site. Talk about gullible.

Ok, fascinating take on the letter. Much of this has already been figured out on WS. Sorry all, but I have an issue with this guy dragging the Ramseys into his evaluation. I believe they were cleared, the woman is dead and unless he has something new to offer, they shouldn't be accused. JMO.

The Ramsey's were never cleared by ones who actually investigated that crime.

If she could testify in surrebuttal, would it be limited to issues raised only in the rebuttal phase? I can understand why she would choose not to but was just curious if that option is available to her.

Right. But I was hoping someone had that exchange. I also recall a diary entry where ja started "Travis thinks I slashed his tires but I didn't". Was there a diary entry as well or am I making things up at this point? Lol.

I agree. They've learned a lot of real info in one day from Juans 3 witnesses. In 1 day. Real people. Who knew Travis. Not experts who are just giving their paid opinions. Not opinions from Jodi. Not opinions from scared witnesses written on paper. Real, live human people who actually know Travis and can speak for themselves to clear up the BS the defense tried to sell. I don't think it gets any better. The only way she's not getting death is if there is an anti-death on the jury and then, there's nothing else that could have been done anyways.

A win for me in this case isn't necessarily a DP sentence. A win for me, is having his name cleared. And Juan made sure that happened this week. I'm good now.

This is a case I am all too familiar with, and just goes to show how the wheels of justice turn way too slowly. A 16 year male was involved as well, but he skated when he turned 21. Some say he was the one who committed the murder.

Surrebuttals are not automatic and are normally limited to issues that the judge permitted to be raised for the first time in rebuttal. But in the mitigation phase it would be the state asking for surrebuttal. Defense goes first in the mitigation phase and gets a rebuttal at the end. It was somewhat confusing in this case, because Juan went first only to get this jury caught up on the premeditated 1st degree murder and cruelty, then we had victim impact statements, then the defense started their mitigation case. Now we are in the state's response case. Next comes the defense rebuttal (if any). Then allocution and closings. Jodi certainly can offer allocution even if she doesn't testify in the rebuttal phase.
