I do not think they can decide the murder was not especially cruel. That has already been established by the first jury and this would not be a death penalty case anymore if the first jury had decided otherwise.. All this jury can decide is whether there are mitigators that outweigh the aggravators.

This is what is so frustrating about this sentencing phase. We know how it should go, but the reality is the defense is going to re-try the "guilt phase" too. And I am afraid that Juan and the judge are not going to do near enough to stop them from that.

Anyone remember from the first trial is there was a defense witness who claimed TA's defensive wounds, standing at sink, and crawling down the hall were possible after being shot in his head?

I don't remember the DT ever having an expert that dealt with that.

Or one who countered the head shot came first.

But I could be drawing a blank.:)
 
I'd like to know if Friedman smiled/waved back at the murderer.
 
Oh yea....Unless I am dreaming this up, wasnt there suppesedly a friend of hers that may have been given a "gift" from JA of either the stereo or DVD player. It wasnt proven I dont think because the person was never called in to testify or something like that.

This whole thing is like a recurring nightmare to me.

I remember speculation it was Darryl Brewer that she gave the DVD player to and that it was the remote to that DVD player she found in her purse (or car) and drove back to give him (Juan asked her about this during first trial) I think it was only speculation, but seems to fit the details.

I'm feeling a little foggy regarding the remote but I thought there was a phone record from Darryl to JA after she left....she returned to his home after the call and the presumption was he called to tell her she forgot to leave the remote so she went back to do so

Nurmi just showed the witness a photo of the cabinet the gun was stolen from. Several other guns can be seen in the photo.

The other guns, which appeared to be hunting rifles, were "high powered and more lethal correct," Nurmi asked.

"Depending on which ones they are," Friedman replied.
 
I clearly recall the dust on the furniture in those "theft" :facepalm: pictures. The "thief" was really careful to not leave any prints, find a hidden gun, and leave everything else of value sitting out. I actually like the way this is playing out so far. This is about penalty not guilt. The prosecution is clearly slamming home all those amazing coincidences. I like it a lot. :twocents:

And this is precisely why we know JA stole the gun and used it to kill Travis. Any other "normal burglar" would have taken much more valuables.

Also we mentioned before that a .25 is not a very common type of gun to shoot someone with in a murder. Most gun murders would be a larger caliber like a 9 mm, .38 special, .357 magnum, .44 magnum, or a .380

A .25 is a pocket pistol which has a shell not much larger than a .22. IMO, it is very uncommon to be used in a murder. So a .25 is stolen from her relative and it just so happens a .25 is used to kill Travis. Duhhhhh.....I think she stole that gun and used it on Travis. Duhhhhh.

She claims Travis owned the weapon and it happened to be at the very top of the closet and she happened to be able to reach up there while being chased by him. Uh.....ok Jodie....we believe you. Yea right. Sheeesh.
