Respectfully partially bolded by me...
Hey there :) Good to see you. I pick door C...am I right? And what does "mandatory reporter" mean?

The way I read it, the age of consent is 16. Thus, any 16 year old having sex with a 15 year old could end up facing a life in prison. The age difference goes to aggravated circumstances, and clearly would not apply to the particular case we are discussing because the girl was over 12 and the age difference is less than 10 years. Mandated reporters are the people who are obligated by law to report child abuse, such as teachers, physicians, etc.

another inconsistancy...

From the school...

"As we continue to review the new information that was released by the District Attorney at her press conference on Monday, we have taken disciplinary action with an additional small group of students and they have been removed from the high school" states Sweklo, who added that all bullying or harassment reports and the administration's response to them are now being electronically logged.

From the D.A...

"The investigation into Phoebe Prince’s death is ongoing. I do not intend to address Superintendent Sayer’s assertions point by point,” Scheibel said in a statement. “I will, however, say that Mr. Sayer does not have access to our investigative materials. Therefore, he can’t have a basis for some of his remarks

Anderson Cooper said none of the accused were disciplined. So what "names" is he referring to? WHO was "removed"? Were they removed today?

Heads up: Anderson Cooper is covering Phoebe's case, he's interviewing Gus Sayer. Hope someone can cover it, I might not be here...

Now, I don't agree with some other points in this piece, I think there should be charges. But I do agree the school officials need to be held responsible.

"Scheibel also said in the interview that at least four students and two faculty members tried to intervene in the bullying or report it to the administrators. No further action was taken."

No one charged has a ten year age difference with her so that one does not apply.

She is not under twelve so that one so that one does not apply.

And no one charged was a mandatory reporter so that one does not apply.

No one charged is looking at life in prison.

NYT...SO much more at link! You have to read it, they spell it out...

Officials did not realize that several other girls continued to harass Ms. Prince in the days that followed, according to Gus Sayer, the superintendent, and Edward J. Boisselle, the chairman of the school committee, as the school board is known here. And only after her death, they said, did officials learn that she had been threatened and slurred since October.

The officials said they had no record of Ms. Prince’s parents complaining to the school about the hazing, something that the district attorney and the parents say the mother did twice. They said they had taken districtwide measures to fight the problem of bullying well before Ms. Prince’s torment came to light.

“We were proactive, but unfortunately, accidents and tragedies can still occur,” Mr. Boisselle said in an interview.

Darby O’Brien, a friend of the Prince family, said Thursday that Ms. Prince’s parents had told him that they had twice tried to alert the school and protect their daughter. Anne Prince, the mother, told him that in one case she had contacted a school official in November asking “whether this gang of girls was a threat to her daughter,” and was told not to worry. The mother said she had contacted the school again in the first week of January as the taunting continued, Mr. O’Brien said. The parents, who are discussing a possible civil suit, have refused to speak to reporters. Mr. O’Brien, a parent and head of an advertising agency here, called for the superintendent, board chairman and principal to resign. “I can’t buy the story that they were unaware,” he said. “They are running for cover.”

"In interviews, some students and parents described bullying incidents that they said were witnessed by teachers. A few times in December and early January, for example, Ms. Prince arrived at a class late and crying; a teacher tried to console her in the hallway and then left her there, said a student who did not want to be identified, citing the criminal proceedings. "

"Susan Smith said that her son had watched as one of the accused bullies screamed insults in Ms. Prince’s face in the cafeteria while the teenager tried to ignore it — and that two teachers saw the verbal assault but did not act. "

I don't know if this has been posted yet, but this blog has tons of information about this case. Among other things, there is more information about the Sean Mulveyhill support page on Facebook.

Thanks. I have seen the blog but haven't seen this particular posting, yet. The comments are interesting...

Ms. Coloroso rushed back to South Hadley after Ms. Prince’s death. She said in an interview this week that the high school had not fully carried out her recommendations to ensure reporting of any potential bullying and to involve parents early on.

“This was a horrible wake-up call,” she said.

Again, NYT...but it wasn't a wake up call! That's the problem, they still say everything's fine...

"Scheibel does not likely have grounds to prosecute South Hadley High School for the negligent and irresponsible manner in which they disregarded Prince’s welfare. That does not mean the school can not be held accountable. Once the D.A.’s investigation is complete, action should be taken against the administration. The principle of South Hadley High School should be fired. All other faculty aware of the bullying at the school that did nothing should be fired. Furthermore, the superintendent of South Hadley Public Schools should be removed from his position. He initially denied that Prince’s mother sought help from at least two staff members at the school, but the D.A. found she, indeed, had"

Opinion> Gus Sayer is saying no one reported the bullying! I cannot believe it. He's an idiot. I've read many people have reported. And he said the kids in the library wouldn't yell loud enough for the Teacher that was present to hear...YET...on Jan. 7th a student yelled INTO Phoebes full class! Those kids, imo, weren't afraid of anything! Sayer then went on to say Phoebe had other issues!

Gus, in his effort to defend Dan Smith, is now saying the principal recomended these students be EXPELLED, and is giving the impression they were...yet, we've heard they weren't...omg, this is nuts.

The bullying specialist is now saying she doesn't believe him...someone had to know...

Lisa Bloom's ripping a strip off the school...thank goodness.

Do read the first abstract from the link you yourself had posted.
The girl was under 16, and so she was below the age of consent. 10 year difference, under 12 and mandatory reporter goes to aggravated circumstances, and somebody would face no less than 10 years in prison. Without these aggravated circumstances, somebody who had sex with a child under 16 is facing up to life in prison, but the minimal term isn't set.

Unfortunately, I think it's also going to be an uphill battle to prosecute the bullies even close to the extent that we'd find just. :(

I'm preparing myself to be livid at the relative slaps on the wrists they'll get by the judge.

This school sounds as bad as the one who spied on their students through their webcams.

Sayer, dated Jan. 16th/2010...
"What I know is that the young woman was having some difficulty adjusting at the school, and she was getting some help from our staff regarding that," Sayer said. "I don't think we know why she did what she did."

Sayer said school officials are cooperating with investigators to learn more about Prince and any circumstances that may have led to her death.

"We may learn more from the family about what was going on," he said. "We will probably try to find out from students about what she was experiencing."

Didn't he JUST say no one knew there was problems? On AC360, he did. He made it sound like no one knew there were problems, imo...and "probably"? Between this and his conflicting statements...he sure doesn't inspire confidence, imo.

Another trend that seems to be widespread among the residents of South Hadley (and especially among its high school students) is blaming the media for their supposed unfair portrayal of the situation and the people involved. Some have said that police officers have to be posted outside of the school to keep reporters from hounding students between classes and after school. Knowing the media, that wouldn't surprise me in the least, and I don't think it's right for them to harass people who had nothing to do with this.

That being said, I definitely do not think the media portrayal has been unfair or warped. The media has given us very few details about the bullies and the school administration. The media more or less named the offending parties and listed the charges against them. No devious media spin there. My doubts about the school administration have come from contradictory statements by Dan Smith and Gus Sayer and from the district attorney's statement, not from scathing, sordid articles from a supermarket tabloid. I think blaming the media is just another tactic adopted by South Hadley residents to deflect the blame from themselves.

Thankfully, not all students feel this way. Check out what a student said on Dan Smith's Facebook support page:

dan, i'm sorry, but you don't go here any longer. you aren't fully in tune to all the ins and outs of this investigation. the media is doing their job, that's what it takes to be a journalist or a reporter.. you stick with one story. if people had done their jobs, the media wouldn't be here.

Oh, snap! You tell them, girl!

Dated Feb.04/2010

According to Superintendent Sayer, neither Phoebe, nor her family, nor any other students reported the bullying prior to her death. He also says that some students were uncooperative with the investigation at the advice of their parents. Disciplinary hearings are on-going but the school will not be releasing the names of the students reprimanded or the punishments handed out. Those punishments can include suspension, expulsion, and referral to the police for further investigation.
