I read the minutes. Jodi and her counsel are assuming in advance, there is going to be a guilt phase, correct? Is providing notice of their intention to call LaViolette as an expert witness a preemptive move of some sort? Why not just wait and see if she is convicted, then call her as a witness?

And as always, Knox, you are kind. As for my ability to decipher legal jargon, I'm not certain that my Oregon lawyer best friend would agree. To me, your reading seems on target. My guess is that her lawyers will try to lay the groundwork of a battered woman defense in the first stage of the trial and then bring out specialist La Violette in the penalty phase. I think that they are anticipating making the ultimate goal line defense: trying to save Jodi from the electric chair.

I would not be surprised if they argue in the penalty phase that Jodi had also been a victim of physical abuse by men other than Travis; perhaps her father, another family member (a la Casey Anthony) or a previous boyfriend. Lacking contemporary documents, this is likely to be a hard-sell.

It's possible that this proposed defense might factor into her family's eagerness to attend.

I'm not a big Jodi fan, but the trial delay is probably justified. The defense has had limited time processing the photos (and perhaps videos) on the recovered computer files. (My guess is that Jodi herself attempted to destroy the hard drive before her arrest.) Since her last stand defense is that she was the victim of an abusive, presumably sexual abusive relationships, I'm certain that she and her team are doing everything they can do to spotlight the most compromising and embarrassing erotic photos on the computer. (They are probably betting that older jury members will be startled and appalled by the explicit pictures that younger couples like Travis and Jodi exchange quite informally.)

I'm now convinced that Jodi will testify, but only at the post-conviction phase. During the pre-conviction phase, they will maintain that it was an act of self-defense and that after the murder, she slipped into an almost trance-like state.
 
Since this has been called the biggest thing since the Casey Anthony trial, I'm going to go there- with all the new computer search evidence, I think that there is going to be no- and I mean no- technological stone unturned. I want to see her testify, I think she wants to get dolled up and testify, but if her defense team is smart she won't. Comparing this to the CA trial again, they'd be smart to shut her up and school marm her in cardigans and buns the whole trial. And tears galore. But you know Jodi A won't play that at all. Having the death penalty and only the death penalty might shoot the prosecution in the foot, but there's so much evidence it's crazy. If this were any state but AZ, I'd be nervous. Well, maybe TX. But I think they may have a shot.

Her testifying in the main trial would be disastrous: One can only imagine the prosecution unleashing barrage after barrage of her previous statements and contradictions. Testifying in the penalty phase, however, would make sense; I think that anyone would have difficulty sending a young woman like her to her death.

But, people like Jodi don't think the same way that normal people do. She is such a narcissist/psychopath, that I wouldn't put it past her at all to demand to testify, if only for her 15 minutes of fame. People with distorted visions of themselves don't see the problem. I wouldn't be surprised to see her testify or NOT testify. I think she's a wild card.
 
I think the difference between her and CA is that allegedly CA came from a background of abuse- I didn't live it, so I can't dispute and I am not going to say that anyone is lying about sexual abuse (I am a sexual abuse survivor myself). I've never read anything stating that JA has any abuse issues stemming from childhood. Also, you can clearly see from the beginning that the Anthonys were a few crayons short in the box of Crayolas. Add that to Jose Baez and company probably being way more competent at their job than the public defenders that JA has- one of which quit already. Hell, wasn't CA's case Baez's first murder case? Plus, AZ is notoriously cheap and ready to get convictions. But they are under the radar now. So, I'm sure that JA will drag this out. If she's smart she'll testify to get attention, and if her lawyers are smart they won't let her testify. Take that as you will, but I think that this case is going to be weird as can be. It seems like a slam dunk conviction, but with a good argument, she could get a light sentence. Depends on how good her attorney is. I just hope Travis and his family gets justice. She does not need to be on the streets. She needs help because there's a reason people do stuff like that and it's not good.
 
From what I read, I think Jose actually had tried a few murder cases. Some were first degree and I believe he was at least able to get them down to second degree. I'm pretty sure CA was his first death penalty case.
 
Yeah, I remember hearing that CA was his first something trial. I think that the delay is going to benefit the prosecution and defense now that I think about it with JA's trial. I don't think that the prosecution will leave any room for error with an appeal, and I think that the defense is looking for any way to reduce time. It looks like a slam dunk- but so did CA, but with the right defense, it could go anyway.

Thanks, Tiger09, for these points about the differences between the trials and your very gripping comments about sexual abuse. I followed the Anthony trial only in the most cursory manner, but it did seem to me that the prosecution (with the help of the defense) exhausted and overwhelmed the jury with minutiae, finally leading to the verdict.

As for Jodi and a previous poster's comments, yes, I do think that she is narcissistic, but I think that she's relatively bright and now knows that her life is at stake and not a good way. She backed down from running her own defense and acceded to what seems to me to be a very realistic back-up, "Yes, I might be guilty, but please don't execute me" strategy.
 
I hope this trial will start someday----I want to see Travis's family finally get some justice....it has been a long, long wait for them....guess I am just a victim's advocate at heart....Now they get to see their child's name dragged thru the mud by the defense. May God be with them.

Well, it seems that the trial is about to start. Counting the hours so to speak. Monday jury selection starts.

It will be interesting to see how the defense strategy unfolds during the forensic presentation. For example, it would not be to their advantage to contest the violence of the scene, because they will ultimately be arguing that Jodi was fighting for her life.

On the other hand, they will no doubt rigorously cross-examine any of the prosecution witnesses who knew Travis and observed Jodi's fixation on him.

I cant see them arguing that she fought for her life. She shot him (as I understand) by standing above him. The bullet went in behind his eye and exit in the opposite side's cheek. It rendered him unable to fight. Then came the stabs? Not sure what came first though...

Were the stabs first? I heard he had stab wounds to his back. She stabbed him in the back as he was trying to get away from her.

I hate this woman. I have no connection whatsoever to the victim, just a crime sleuth, but I hate her. Her smugness makes me wanna smack her face.

I've been following this case since she was arrested. There used to be a very comprehensive discussion of the case on another web site, that I used to join in with, however, I am not sure if the thread still exists there.

I hate this woman too. She has lied, lied, lied and changed her story too many times and tried to evade justice for so long it is disgusting.

I can't remember whether Travis Alexander was shot first, I think possibly he was (when she was still trying to blame her two intruders in black clothes, she said Travis was shot first and the gun didn't fire or misfired when it was pointed at her). If there is an element of truth in that, if she did indeed try to shoot Travis once then finish off the job with a second bullet, her gun may well have blocked (or whatever you call that in technical terms?) Travis Alexander suffered multiple stab wounds. His throat was cut. I am not sure whether he was shot or stabbed first. I would be inclined to think that he was shot first though.

I hope the Alexander family shortly get the justice that they have waited so patiently for.
